011-15 - Resolution - Amendments to the Countywide Planning PoliciesIntroduced by: Development Director Requested by: Development Director Drafted by: Development Director Reviewed by: City Attorney Introduced: May 26, 2015 Adopted : May 26, 2015 RESOLUTION NO. 011-15 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, RATIFYING THE PROPOSED 2015 AMENDMENTS TO THE COUNfYWIDE PLANNING POLICIES SUBMITTED BY THE BOARD OF THE KITSAP REGIONAL COORDINATING COUNCIL AND APPROVED BY THE KITSAP COUNTY BOARD OF COMMISSIONERS WHEREAS, The Growth Management Act (GMA), RCW 36.70A, requires that each county planning under GMA must adopt county-wide planning policies to be used as a framework from which county and city comprehensive plans are developed and adopted; and WHEREAS, in May, 1992, the Kitsap Regional Planning Council, made up of elected officials of the county, cities, and tribes of Kitsap County, adopted the first county- wide planning policies pursuant to GMA; and WHEREAS, the Kitsap Regional· Coordinating Council (KRCC) initiated revisions to the county-wide planning policies through multijurisdictional collaboration including planning staff, planning commissioners and council and board members; and WHEREAS, beginning in 2013, the KRCC began an update process for the Countywide Planning Policies, to establish population and employment targets for the 20 year planning horizon; and WHEREAS, On March 3, 2015 the KRCC held a work study session on the proposed Countywide Planning Policies; and WHEREAS, On March 3, 2015, the KRCC submitted the proposed amendments to the Department of Commerce for State Agency 60 day review; and WHEREAS, on April 7, 2015 the Kitsap Regional Coordinating Council held a public hearing on the proposed Countywide Planning Policies; and WHEREAS, on April 7, 2015 the Kitsap Regional Coordinating Council forwarded the proposed Countywide Planning Policies to Kitsap County to begin the County's review process; and Resolution No. 011 -15 Page 2of8 WHEREAS, on April 13, 2015, a State Environmental Protection Act (SEPA) programmatic checklist was completed and submitted to the Kitsap County SEPA official; and WHEREAS, on April 15, 2015 the Kit sap County SEP A Official issued a Determination of Non -significance. A fourteen day appeal period was opened. No appeals were submitted by the requisite date ; and WHEREAS, on May 11 , 2015, the Kitsap County Board of Commissioners held a hearing to consider the proposed revisions to the countywide planning policies ; and WHEREAS, the Kitsap County Board of Commissioners adopted Ordinance No. 522-2015 , amending the County-wide Planning Policies, and these Policies were then forwarded onto the City jurisdictions for ratification; now, therefore; THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: The City Council of the City of Port Orchard, Washington, hereby ratifies the adoption of the Kitsap County-wide Planning Policies, as adopted via Kitsap County Ordinance 522-2015 , dated May 11, 2015 (Exhibit A) PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested by the City Clerk in authentication of such passage this 26th day of May, 2015. ATTEST : ORDINANCE NO. s-2-Z--2015 Resolution 011-15 Exhibit A RELATING TO GROWTH MANAGEMENT, AMENDING THE COUNTY-WIDE PLANNING POLICIES BE IT ORDAINED: Section 1. The Kitsap County Board of County Commissioners makes the following Findings: A. The Kitsap County County-wide Planning Policies (CPPs) are intended to establish a county-wide framework from which county and city comprehensive plans are developed and adopted pursuant to RCW 36.?0A.210 of the Washington State Growth Management Act (GMA). B. The CPPs are developed through a cooperative and collaborative process that involves the Cities of Bainbridge Island, Bremerton, Port Orchard and Poulsbo, as well as the Suquamish and Port Gamble S'klallam Tribes, through the Kitsap Regional Coordinating Council (KRCC). C. Kitsap County has adopted County-wide Planning Policies that promote contiguous and orderly development and establish provisions for urban services to such development, as well as policies for siting public capital facilities of county-wide or statewide nature, affordable housing, coordinated county and city Urban Growth Area (UGA) planning, economic development and employment, and participation with local tribes. D. Planning is an iterative process; therefore, it is appropriate that the County-wide Planning Policies should be reviewed and assessed through the KRCC at least every five years, with revisions, if necessary consistent with the State Growth Management Act, Ch. 36.70A RCW. Section 2. General Procedural Findings. The Kitsap County Board of Commissioners makes the following findings regarding the process and public participation aspects of amending the County-wide Planning Policies: A. The Kitsap County Regional Coordinating Council is an organization consisting of elected officials from Kitsap County, the four Kitsap County cities, Bainbridge Island, Bremerton, Poulsbo and Port Orchard, as well as the Suquamish and Port Gamble S'Klallam Tribes. One of the functions of the KRCC is to coordinate land use planning throughout Kitsap County. B. Beginning in 2013, the Kitsap Regional Coordinating Council began an update process for the Countywide Planning Policies in order to establish Population and Employment Targets for the 20-year planning horizon. C. On March 3, 2015, the Kitsap Regional Coordinating Council held a work study session on the proposed Countywide Planning Policies. Resolution 011-15 Exhibit A D. On March 3, 2015, the Kitsap County Coordinating Council submitted the proposed amendments to the Washington State Department of Commerce for State Agency 60-Day Review. E. On April 7, 2015, the Kitsap County Coordinating Council conducted a public hearing on the proposed ,amendments. Two residents of unincorporated Kitsap County testified. D. On April 7, 2015, the Kitsap Regional Coordinating Council approved the proposed amendments and forwarded the proposed Countywide Planning Policies to Kitsap County to begin the County's legislative process. E. On April 13, 2015, State Environmental Protection Act (SEPA) checklists were completed and submitted to the County's SEPA official. F. On April 15, 2015, the SEPA official issued a Determination of Nonsignificance. A fourteen day appeal period was opened. No appeals were submitted by the requisite date of April 30, 2015. G. On May 11, 2015, the Board of Commissioners held a hearing to consider the proposed revision to the countywide planning policies. H. Pursuant to Appendix_ A of the CPPs, Ratification Process, the Cities of Bremerton, Bainbridge Island, Port Orchard and Poulsbo, and the Suquamish and S'Klallam Tribal Councils must ratify the amendment within 90 days of the date of the County's adoption of this Ordinance. If at least three Cities fail to ratify the amendment within this timeframe, the amendments to the CPPs shall not take place and the matter shall be referred back to the Kitsap Regional Coordinating Council for further discussion. Section 3. The Kitsap County Board of Commissioners find that the following proposed revisions to the CPPs are appropriate and should be adopted. These changes are summarized as follows and set forth in Attachment A, which is incorporated by reference herein: A. Changes: 1. Appendix 8-1: i. Corrects a scrivener's error regarding the Silverdale Urban Growth Area 2010 Census population. ii. Finalizes a shift in Population Growth of 1,000 people from the Central Kitsap Urban Growth Area to the Silverdale Urban Growth Area. iii. Extends the Planning Horizon to 2036, reflecting Washington State Department of Commerce recommendation. 2. Appendix 8-2: Amendment adopts 20-Year Employment Targets for all Resolution 011-15 Exhibit A Kitsap jurisdictions extending to 2036. B. All other provisions in the CPPs, as adopted by Kitsap County Ordinance 509- 2013, remain unchanged. Section 4. Effective Date. This ordinance shall take effect upon the earliest date that it is ratified by at least three Cities within the County. Section 5. Severability. If any provision of this Ordinance, or its application to any person, entity or circumstance is for any reason held invalid, the remainder of the Ordinance, or the application of the provision to other persons, entities or circumstances is not affected. Section 6. Clerical/Typographical Error. Should this Ordinance, upon being enacted by the Kitsap County Board of Commissioners during its deliberations on May 11, 2015, have anything inadvertently left out or in error upon publication, the explicit action of the Board as discussed and passed shall prevail upon subsequent review and verification by the Board.
