CALL TO ORDER AND ROLL CALL Mayor Putaansuu called the meeting to order at 7:00 p.m. Roll call was taken by the City Clerk as follows: Councilmember Ashby Councilmember Chang Present Present Present Present Present Present Present Present Councilmember Cucciardi Councilmember Diener Councilmember Donlin Councilmember Lucarelli Mayor Pro-Tern Clauson Mayor Putaansuu Staff present: Public Works Director Dorsey, City Treasurer Martin, Community Development Director Bond, City Attorney Cates, City Clerk Rinearson, and Deputy Clerk Floyd were also present. A. Pledge of Allegiance Mayor Putaansuu led the audience and Council in the Pledge of Allegiance. 2. APPROVAL OF AGENDA MOTION: By Councilmember Ashby, seconded by Councilmember Clauson, to add Business Item 7E Discussion on Tonight's Multifamily Tax Public Hearing. The motion carried. MOTION: By Councilmember Ashby, seconded by Councilmember Donlin, to add Business Item 7F Discussion on McCormick Village Park. The motion carried. MOTION: By Councilmember Ashby, seconded by Councilmember Clauson, to move Consent Agenda Item C to the July 26, 2016, Council meeting. The motion carried. CITIZENS COMMENT Patrick Lucas spoke about business item 7 A and how this is a good example to get the Council and Mayor to ask the citizens how they feel before voting things in. Jerry Arnett discussed Business Item 7B and asked the Council when they are going to abide by the Comprehensive Plan and start representing the people of Port Orchard. Nick Whittleton would like to see a road to the center of the park engineered rather than spending an extra quarter of a million dollars on upgrades and make them later. 4. CONSENT AGENDA A. Approval of Bi-Weekly Check Nos. 66821 through 67016 totaling $1,920,098.26; June's Electronic Payment dates 6/1/2016 through 6/30/2016 totaling $18,530.09; and Bi-Weekly Payroll Check Nos. 147064 through 147085 totaling $266,586.87. B. Adoption of a Resolution Amending Resolution No. 003-13, Social Media Policy (Resolution No. 061-16) C. Approval of a Contract with South Kitsap School District for a School Resource Officer D. Approval Authorizing the Mayor to Execute a Letter of Commitment for Kitsap Regional Coordinating Council Membership for 2017 E. Approval of a Public Event Application: Taste of Port Orchard MOTION: By Councilmember Clauson, seconded by Councilmember Lucarelli, to approve the consent agenda as amended. The motion carried. 5. PRESENTATION There were no presentations. 6. PUBLIC HEARING A. Public Hearing on a Proposed Ordinance for a Multifamily Tax Exemption Code Minutes of July 12, 2016 Page 3 of 8 Mayor Putaansuu opened the Public Hearing at 7:08 p.m. Nick Whittleton kind of supports this program but still has concerns about the possibility of barging in foreign made housing units, this needs to be addressed and would like a commitment from the Council that this is the only exemption to be given. Elissa Whittleton would like this to be more stringent. Right now she is concerned there is no derelict building ordinance. We also need to establish that local workforce, as well as local sourcing of materials needs to be involved. Also would like to see tighter constraints on enforcement. Scott Fitzsimmons recently got a plat approved by the theatre. The tax abatement area is all around his property. Right now he is looking at 28 lots. If something like this is adopted, he would consider moving it into apartments. This would be good for the area. Stuart Grogan Executive Director of Housing Kitsap expressed his support for the property tax exemption. He encouraged Council to move this forward for final adoption. Rick Gehring is representing his mom who owns 17 acres behind the Town Square Mall. They are planning for 136 garden style units. This would help them and allow someone to pencil it out better, and say Port Orchard is a less expensive location to build in. He is in support of this exemption. Gerry Harmon questions with all the taxes and fees added to the average citizen, we are giving people who probably have a much higher income more ways to make more money. There being no further testimony, Mayor Putaansuu closed the public hearing at 7:20 p.m. 7. BUSINESS ITEMS A. Adoption of a Resolution Approving a Contract with Transpogroup for the Old Clifton Corridor Study and Anderson Hill Roundabout Design MOTION: By Councilmember Lucarelli, seconded by Councilmember Cucciardi, to adopt a resolution thereby approving a contract with the Transpogroup, Inc. in the amount not to exceed $155,000.00 for the 2016 Anderson Hill Road SW - SW Old Clifton Road Roundabout 60% design and documenting the professional services procurement procedures pursuant to RCW 39.80. The motion carried. (Resolution No. 059-16) Minutes of July 12, 2016 Page 4 of 8 B. Adoption of a Resolution or Ordinance for the Imposition of Vehicle License Fees by Seeking Voter Approval or by Council Action MOTION: By Councilmember Diener, seconded by Councilmember Donlin, to adopt an ordinance establishing a $20 annual vehicle license fee. MOTION: By Councilmember Diener, seconded by Councilmember Lucarelli, to add the word sidewalks to the sentence under the second WHEREAS paragraph which states 'preservation of City streets and sidewalks and related infrastructure ' The motion carried. MOTION: By Councilmember Diener, seconded by Councilmember Ashby, to add another WHEREAS sentence which states 'WHEREAS the annual vehicle license fee will help insure the City is competitive with grant funding opportunities; and' The motion carried. Councilmembers Ashby, Lucarelli, Cucciardi, Chang, Donlin and Diener briefly discussed why they adopted the ordinance establishing the $20 vehicle license fee. Councilmember Clauson concurs with everything that was said but he believes this should go to a vote, so he will be voting against this. The main motion, as amended carried. Councilmember Clauson voted no. (Ordinance No. 019-16) C. Approval of the June 21,2016, Council Work Study Session Minutes MOTION: By Councilmember Ashby, seconded by Councilmember Lucarelli, to accept the minutes as presented. The motion carried. Councilmember Clauson abstained. D. Approval of June 28, 2016, Council Meeting Minutes MOTION: By Councilmember Lucarelli, seconded by Councilmember Clauson, to approve the June 28, 2016, Council Meeting Minutes. The motion carried. Cucciardi abstained. Minutes of July 12, 2016 Page 5 of 8 E. Discussion on Earlier Public Hearing of the Proposed Ordinance for a Multi Family Tax Exemption In response to Councilmember Ashby, Development Director Bond agreed that the tax exemption on the increased real estate value in Port Orchard is Port Orchard's portion. They will still pay full value to the schools, county, fire, etc. Councilmember Ashby noted this was not the City's idea. This is something that has been vetted through the State legislature. It is a tool that will allow us to encourage redevelopment of some of our underdeveloped areas. Also, the ordinance states that anyone with the exemption has to provide us with an annual report, and we have a right to go down and verify they are in compliance. Councilmember Clauson said all of these areas are on the transit route and will provide easy access for mobility. Councilmember Chang stated builders are exempt for paying for improvements for the buildings. On everything else, including the land they are building on, they still have to pay property tax. Councilmember Diener encourages everyone who is interested to review RCW 84.14.005 which are the three findings the legislature made when establishing this program. In response to Councilmember Diener, Community Development Director noted the Council can administratively amend the map at any time. This is something that can change easily. The Council can also discuss if there are areas that are undeveloped that are more difficult to develop than other areas that need this extra help to make the project viable. Council Direction: Bring this discussion to the next Land Use Committee to discuss the process to amend the map. 7F. McCormick Village Park Development Director Bond said he has met with the landscape architects several times and has refined the low level design. They are ready to move forward with development of more construction level designs. He provided 2 drawings of the proposed park which include an off leash dog park, trail improvements, bridges, spray play area, tot lot, and parking alternatives. Also, we applied for a grant to do this project and we have to deliver the project as we applied and need to build this in one chunk. Minutes of July 12, 2016 Page 6 of 8 Council and staff continued to discuss the park design and accessibility. Councilmember Clauson would like to have the gravel pathway along the west side of the parking be extended out to the road. Public Works Director pointed out that in the last 8 years the City has been improving parks and open spaces within the City including Clayton Park, the Active Club and Dekalb Pier. Council Direction: No direction. Council agreed staff is on the right track. 8. COMMITTEE REPORTS Councilmember Ashby reported the Economic Development Tourism Committee is scheduled to meet July 18 at 2pm. Councilmember Lucarelli reported the Utilities Committee canceled their July meeting. The next meeting is scheduled for August 15. Councilmember Lucarelli reported the Sewer Advisory Committee is scheduled to meet July 20, 6:30pm. Councilmember Diener reported the Land Use Committee is scheduled to meet July 20. Councilmember Chang reported we are close to forming a Lodging Tax committee. Councilmember Lucarelli reported Festival of Chimes and Lights is scheduled to meet next Monday at 3:30pm; and the Development Regulations Ad Hoc Committee is scheduled to meet July 19 at 3:00pm. 9. MAYOR'S REPORT Mayor Putaansuu reported on the following: • Attended a Westsound Local Integration meeting • The propeller that used to be inside the Public Market has been moved by the boat launch • Has been talking with City Foreman Thomas Hunter regarding street trees • Contractor and engineer are trying to come up with a compromise on Mhyre's. • Kitsap Transit flyer on free parking locations and parking rates • Possibility on creating a policy regarding executive sessions. 9. REPORT OF DEPARTMENT DIRECTORS Minutes of July 12, 2016 Page 7 of 8 Public Works Director Dorsey reported the Dekalb Pier Phase 2 work is under way; potentially shutting down Bay Street at Arnold in the near future for a brief period; and working on a TIB application forTremont Street. Treasurer Martin apologized for an error done on an ordinance previously adopted by Council. Community Development Director Bond reported they received bids for the wayfinding signs. Councilmember Ashby said they will discuss the bids for the wayfinding signs at the next Economic Development Tourism Committee. City Clerk Rinearson reported the public records request portal is now live on the City's website; she would like to schedule a time for the Council and Mayor to meet to take a current photo for the website; the additional foot ferry flyers and brochures have been sent out; and noted the WSDOT road closures are listed on the City's website. 11. CITIZENS COMMENTS In response to Scott Fitzsimmons, Public Works Director Dorsey stated the multi-family transportation impact fee is calculated at 0.62 of the fee. Scott Fitzsimmons said this would be good for Port Orchard to adopt. Elissa Whittleton stated in regards to her earlier comments during the public hearing, she would not support the development of raw property. Mara Schmerfeld would like to know more about the City's View Protection Overlay District, specifically about the enforcement of the code prohibition for any resident within the district to grow foliage that would obstruct a neighbor's view. Does the City have any administrative guidelines? Mayor Putaansuu stated that Development Director Bond will research this and get back to her. Gerry Harmon voiced her concerns with the $20 vehicle license fee including people who rarely use the roads. It is the Council's responsibility to make sure that people pay their fair share. She would like to see Council receive public input first, before moving forward. She also addressed her concerns regarding advisory votes. Bobbie Stewart is thankful for the small park. It is really beginning to look nice. Minutes of July 12, 2016 Page 8 of 8 12. EXECUTIVE SESSION At 8:35 p.m., Mayor Putaansuu recessed the meeting for a 20-minute executive session in accordance with RCW 40.30.110(l)(b) regarding real estate acquisition. Community Development Director Bond, City Treasurer Martin, and City Attorney Cates were invited to attend and the Mayor announced that no action would be taken because of the executive session. At 8:55 p.m., Mayor Putaansuu continued the executive session for an additional 20 minutes. At 9:15 p.m., Mayor Putaansuu reconvened Council back into regular session. 13.
