Work Study Session Meeting of July 21, 2015
CALL TO ORDER AND ROLL CALL
Mayor Tim Matthes called the meeting to order at 7:00 p.m.

Mayor Matthes led the audience and Council in the Pledge of Allegiance.
1. Transportation
MOTION: By Councilmember Cartwright, seconded by Councilmember Childs, to open up the discussion and
invite the stakeholders to the table to discuss traffic impact fees.
The motion carried.
Citizens Bill Palmer, Gerry Harmon, Dick Brown, Nick Whittleton, Elissa Whittleton, Matt Murphy, Doug
Skrobut, and Mike Eliason came to the table. Discussion highlights included:
• Traffic impact fee calculations and trip numbers
• New and existing development values
• Growth in Port Orchard
• Budget concerns
• Stormwater vesting
• Lack of definitions in the proposed ordinance
• Methodology
• Bypass trips
• Who should pay impact fees
• County discussions and agreements

Councilmember Ashby read the following into the record:

• What on the Tier 1 transportation improvement project list is to correct deficiencies, if any?
• Is there a more current assessment of capacity or LOS rating than Table 7 in the December 2011
Transportation Plan Update?
• Do we have current counts? Do we know available capacity?
• How can Tremont be on the growth impact fee project list?
• McCormick Land Company has an existing agreement signed in 2005. The agreement has been
executed according to the terms stipulated. It is her position that this agreement should remain in
tack. We should not disrupt a well thought out and working arrangement. In her opinion,
McCormick Land Company should be subject to a fractional portion of citywide transportation
needs.
• Centers were defined in last year's comprehensive plan update. Sub area plans are yet to be
defined.
o How the centers develop will influence traffic counts.
o How can we assess an accurate number for trips without knowing if each center will be
multi family, retail stores, or employment centers; the impact fee list should include areas
of the city which will be or are experiencing in fill growth, such as Fireweed, Flower, and
Sidney. Although deficiency already exists and needs to be corrected, additional growth will
add to the capacity needs.
• Real numbers -Listed were the annual number of building permits issued each year from 2008 to
2015 to show what revenue would be generated based on historic information. The growth
numbers we are working with from KRCC via PSRC include population and employment. It seems to
me that the employment numbers would be expected more on the back end of the 20-year time
frame. We are front-loading all the growth. Do we have an economic development plan to
encourage and solicit employment centers, which would accelerate employment growth?
Council Direction: Council directed staff to research and respond to Councilmember Ashby's questions at
the next meeting.
2. 2015 Comprehensive Plan Amendment Roster
Development Director Bond reported he has been waiting since June for the Comprehensive Plan
amendments that have been filed. This includes a proposal to amend the Transportation Improvement
Program (TIP) in the Comprehensive Plan, and the Planning Commission has finalized the recommendation
on the Tremont Regulations, which includes a recommendation to amend the Comprehensive Plan. It
sounds like we are not close to having a final Transportation Impact Fee List.
In addition, the Planning Commission studied the interim Tremont regulations, and considered amending
the regulations, but ultimately decided to remove the Tremont Overlay District from the Comprehensive
Plan. The Tremont interim regulations are set to expire in the next month and a half, and we will need to
extend the existing interim regulations, or we can go forward without the traffic improvement program list.

In response to Councilmember Childs, Mr. Bond stated the Planning Commission's concerns regarding the
Tremont Overlay District.
Council and staff briefly discussed timelines, amendments, and the Comprehensive Plan.
Council Direction: Council directed staff to put the six-year TIP, adopted by resolution, into this year's
Comprehensive Plan, which will be brought forward at the next council meeting for Council consideration.
3. Best Available Science
Development Director Bond reminded the Council that the City signed a contract with ESA, Inc. to do a Best
Available Science (BAS) review and gap analysis as part of the 2016 Comprehensive Plan analysis . The City is
required to review its development regulations to make sure they are consistent with state law . Mr. Bond
explained a couple of exemptions recommended for removal. ESA, Inc. provided a BAS draft matrix for
review .
Mayor Matthes and Councilmember Childs voiced their concerns regarding BAS.
In response to Councilmember Chang, Mr. Bond said he will email him a critical areas map, and discussed
the different types of wetlands.
City Attorney Morris asked the Council to send her any of their concerns once they review the draft
ordinance, so she can start researching court cases .
Mr. Bond would like to have the letter addressing comments to the consultant by August 6.
Council Direction: None .
4. EXECUTIVE SESSION
At 9:01 p.m., Mayor Matthes recessed the meeting for a 25 -minute executive session regarding potential
litigation in accordance with RCW 42.30.llO(l)(i). City Attorney Morris and Development Director Bond
were invited to attend .
At 9 :26 p.m ., Mayor Matthes reconvened Council back into regular session .
ADJOURNMENT
