HomeMy WebLinkAbout015-25 - Port Orchard Police Guild - Contract Amendment MOU, Determination of SeniorityDocusign Envelope ID: 04D55CDE-FB72-8E90-8263-35FE0986297D MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PORT ORCHARD AND THE PORT ORCHARD POLICE GUILD The City of Port Orchard ("City") and the Port Orchard Police Guild representing Police Officers and Sergeants ("Guild") enter into this Memorandum of Understanding ("MOU") regarding the determination of seniority in the 2025-2027 Collective Bargaining Agreement ("CBA") negotiated between the parties. WHEREAS, the CBA provides seniority rules but does not specify a tiebreaking method for employees who share the same start date; and WHEREAS, a tiebreaking method is not provided for in the Port Orchard Police Civil Service Rules or the City's personnel policies; and WHEREAS, two or more bargaining unit employees may begin employment on the same date, thus creating the need for a mutually agreed -upon method for determining relative seniority; and WHEREAS, the parties desire to establish a clear, consistent, and fair method for determining seniority in such situations; NOW, THEREFORE, the City and the Guild agree as follows: 1. Article 16.1 of the CBA is hereby amended as follows: Layoffs shall be made in the following order: (1) temporary or provisional employees and then (2) regular employees by inverse order of seniority by rank. Seniority is defined as the employee's most recent date of hire into their current rank: provided that if two or more employees have the same date of hire, seniority will be determined by the employee's rank on the Civil Service eligibility for hire list. If the employees are hired from two different lists, (e.g. lateral versus entry level) ,seniority will determined in the following order: lateral, certified, entry. In the event of the layoff of a Sergeant, the Sergeant will revert to the Officer rank and the least senior Officer will be laid off. 2. This LOA is effective when signed by both parties and shall be retroactive to January 1, 2026. No modification to this Memorandum of Understanding is valid unless in writing and signed by both parties.
