— Concerns regarding policy
language modifying
impact fees
in response to variable growth
rates:
• City Response: Policies LU-7, LU-42, and LU-43 have been revised to remove language referencing modifying
impact fees as a response to growth rates that are either below or exceeding expected growth rates. There are
legal implications to establishing and/or modifying impact fees that limit the feasibility of including as a policy
approach.
PSRC Comment:
(Regional Coordination) Strengthen language addressing tribal treaty rights and ongoing
coordination of policy decisions:
• City Response: New Land Use Goal #14 and new Policy LU-44 have been provided to reflect PSRC policy language
related to this coordination.

Chapter 3 — Housing
Public Comments — Regarding affordable housing and multi -family development:
— Explore more incentives to promote multi -family development (like the Multi -Family Tax
Exemption (MFTE) program):
• City Response: New Policy HS -17 recommends the City explores the re-establishment of the MFTE program as a
means of increasing affordable housing supply. The Policy incorporates recommendations of the City's Housing
Action Plan (HAP).
— Provide more details about 'streamlining' the permit process for multi -family housing:
• City Response: Policy HS -14 has been revised to incorporate more specific recommendations from the City's HAP,
including refinements to the City's building form/intensity development standards, adjustments to locally
adopted building codes, assessing permitting/review staffing needs, and examining funding strategies.
PSRC Comment:
PSRC Comments on housing have been addressed by adding appendices H (Housing Action
Plan), I (Land Capacity Analysis (modified to address PSRC Comment)), and J (Racially
Desperate Impacts Analysis) to the Comprehensive Plan

Chapter 4 — Parks
• PSRC Comment:
Revise Parks Element to provide LOS standards and
policy language supporting providing parks within a 10 -
minute walk of all residents:
• City Response: Parks Level of Service and policy language for
establishing parks within a 10 -minute walk of residents already
exist in the City's Parks, Recreation, and Open Space (PROS) Plan.
This information has been translated into new Parks Goal #13
and new Policy PK-45.

Chapter 6 — Economic Development
• PSRC Comment:
— Added a new goal #12 in response to the PSRC Comments
• Goal 12. Economic development strategies should address with environmental concerns, promote equity
and access to opportunity, minimize displacement impacts to existing businesses, recognize the importance
of existing and emerging technologies, and protect the quality of life.
— Policy ED -51 Coordinate with regional jurisdictions and agencies to develop coordinated strategies and interjurisdictional processes to
mitigate the impacts of displacement.
— Policy ED -52 Utilize PSRC's Displacement Risk Mapping Tool to identify areas within the City that have higher risk of displacement based
on neighborhood conditions, and establish mitigation programs for these areas to promote equitable outcomes.
• Planning Commissioner Morrison Amendments:
Planning Commissioner Joe Morrison made a motion to make some minor text revisions
throughout the Economic Development Chapter. These revisions are shown in redline in
the packet draft.

Chapter 8 — Transportation
Public Comments Regarding biking / non -motorized infrastructure:
— The Transportation Element (Chapter 8) needs more specific direction related to an interconnected and protected biking
network throughout the City, particularly near the waterfront, schools, and businesses. Bike facilities should be physically
separated from traffic. The Waterfront Park is a good example of this. The rise of e -bikes makes these facilities more likely to
be used by members of the community.
• City Response: Policy T-17 has been strengthened to add language about providing 'connected and protected bike and pedestrian pathways where
contextually appropriate.' This approach ensures that this policy is applied to private development proposals in locations where the establishment
and/or continuation of bike/pedestrian pathways should be required in relation to the impact of development proposals.
— Within the Bethel subarea plans, protected multi -use pathways within the subareas should be identified.
• City Response: Policy T-6 of both subareas plans identifies the development of protected bike lanes within the subareas, as feasible in relation to
development proposals that occur over time throughout the development and/or redevelopment of the subareas. The subarea plans also identify 'safe
routes to schools,' which will also enhance the feasibility of providing these facilities in association with development activities to promote bike and
pedestrian scale infrastructure improvements.
PSRC Comments:
— Revise Transportation Element to more closely comply with PSRC certification requirements, including funding reassessment
strategies and mobility options for all abilities:
• City Response: Section 8.9.5 has been revised to address potential revenue shortfalls and alternate funding strategies, including reassessing Level of Service
standards and/or exploring a development moratorium. Descriptions of ADA barriers and mitigation strategies/efforts have been added to Section 8.3.5.1.
— Revise Transportation Element to more closely comply with PSRC certification requirements to address racial and social equity.
• City Response: Section 8.11 has been added to the transportation element.

• Suggested changes from PSRC Review:
— Clarify capacity related to ADUs meeting housing needs for various income levels:
• City Response: This comment was in response to information found in the City's Land Capacity Report. This
report has been updated (see page 4 of the report discussing 55 ADUs in McCormick Village) to reflect PSRC
concerns around the affordability of ADUs in Port Orchard and is now Appendix Ito the Comprehensive Plan.
— Document the City's existing housing tools and incentives, and discuss regulatory and financial
barriers to affordable housing production:
• City Response: The Racially Disparate Impacts (RDI) Analysis prepared in association with this Comprehensive
Plan Update provides a Policy Evaluation addressing potential barriers to affordable housing production. The
findings from the RDI Analysis and the Land Capacity Analysis, were the basis for updates to the Land Use and
Housing Element's goals and policies for consistency with this Update's regulatory guidance. This report is now
Appendix J to the Comprehensive Plan.
— Summarize the recommendations of City's Housing Action Plan (HAP) within the Comp Plan:
• City Response: The HAP is now Appendix H to the Comprehensive Plan.
