GENERAL CONDITIONS (SWAT TEAM REVIEW)
You should be aware that The RediCheck Firm (TRF) will not perform RediCheck services unless
there is a written agreement that TRF and CLIENT shall each indemnify and hold each other
harmless from any and all claims, causes of action, damages, losses, and expenses, including
attorney's fees, alleged to arise, arising or resulting from client's and/or TRF's acts, omissions,
negligence or breach of this proposal. This indemnification is intended to be complete and to cover
all acts or omissions of TRF. If, the above indemnification notwithstanding, TRF is adjudged to be
negligent and is held responsible for proportionate costs and damages resulting therefrom, such
judgement against TRF shall be limited to the RediCheck Review Fee.
By signing this agreement you acknowledge and agree to the following:
1. A RediCheck SWAT Team Review is a limited effort partial review not intended to be a complete
review.
2. The purpose of this RediCheck Review is to reduce change orders and requests for information
during construction. Coordination between disciplines is the main focus of a RediCheck Review.
3. A RediCheck Review is not intended to reduce the responsibility of the Design Team to produce
their documents in accordance with general industry standards.
4. TRF is not part of the Design Team and is not responsible for any technical or design issues
including, but not limited to the following: code/ADA compliance; calculations for size of mechanical,
plumbing, electrical, audiovisual, and communications equipment; adequacy of structural members;
any and all water intrusion.
5. The statute of limitations for any legal action against TRF shall be 3 years from the date of
completion of this RediCheck Review.
6. This agreement shall be governed by the laws of the State of Georgia. Every dispute not settled by
the parties shall be resolved by a legal action brought by a court of competent jurisdiction in Fayette
County, Georgia.
7. TRF is a business entity that has contracted to perform services, and any services provided by
TRF employees, agents, or members are not performed in their individual capacity.
8. Payment is due within 30 days from the date of the final invoice.
UNCONDITIONAL SATISFACTION GUARANTEE - If you are not satisfied with the results of the
RediCheck Review, you do not have to pay us.
Based on your signed acceptance of this agreement and our electronic receipt of the documents, the
review will be completed as indicated. The red marked RediCheck Review documents containing all
comments will be made available online for client download and distribution.
