ABEL, MAYOR COUNCILMEMBERS: John Clauson Fred Chang Robert Geiger Rita Dilenno Carolyn Powers, Mayor Protem Rick Wyatt City of Port Orchard City Council Public:: Hearing Regarding the Downtown Overlay District October 30, 2006 ALSO PRESENT: Planning Director Long-Woods, Interim City Clerk Merlino and Assistant City Attorney Jacoby. Mayor Abel opened meeting at 7:00p.m. advising the City Council of the current council position vacancy and discussed the criteria for filling this vacancy. At 7:15p.m. Mayor Abel resumed discussion on the Downtown Overlay District. Council Member Wyatt requested the Council to insert specific language in the proposed Downtown Overlay District regulations to allow property owners the ability to remove the marquee and remodel the frontage of their building. Council Member Wyatt also requested the property owners be required to provide the City with a Performance Bond. Council Member Wyatt also asked for discussion regarding street lights that are tied to the marquee. Assistant City Attorney Jacoby advised these requests are not part of the regulations, and he recommends that they be included into Section 120-Central DOD-Design and Building Standards, subsection (7). The council concurred that coverage is required for the pedestrians and standards be developed for the street lighting. Council Member Clauson asked how far should the marquee extend over the sidewalk. City staff will measure the current sidewalk and marquee widths, and provide that information for the next meeting. October 30, 2006 Page 2 of 3 Assistant City Attorney Jacoby advised he will provide draft language regarding the marquee and light standards. Council discussed height limitations within the downtown core area. Council Member Chang recommended height limitations be based on the topography of the city. Council discussed height limitations within the core area. Mayor Abel advised the Housing Authority could not attend this meeting, however they will attend the next meeting to illustrate via computer what the views of the City could potentially look like. The Council discussed the boundaries of the Downtown core area and concurred on the following boundaries: Starting on the east boundary line -Seattle Avenue to Prospect Alley across Sidney, behind the lots on the south side of Prospect to Bank Street. Council will continue discussion of the west end boundary. Assistant City Attorney Jacoby requested the Council change subsection (2) from section .10 relating to the Downtown Overlay District (DOD)-Created. Subparagraphs b) and c) refer to the east and west wing of the Overlay District, which will not be finalized in these regulations. Council made no corrections to Section .020 "Purpose". Council will review Section .030 "Compliance" after discussion on the downtown view corridors. Council added the following permitted uses to Section .040 "Permitted Uses", Museums, trails, office and patient clinics. City Attorney cautioned the Council to be very specific in their permitted uses, such as barbershops and beauty salons. Other permitted uses included water transportation and services, banks and financial services. Council Member Clauson requested discussion of height limitations and parking be the first two items of discussion at the next meeting. At this time, Council closed all public written input. Entered into the record at this meeting were color pictures taken by Council Member Clauson illustrating views within the downtown area.
