Abel, Mayor City of Port Orchard City Council Deliberation Regarding the Downtown Overlay District June 12, 2007 Council Members: Chang, Clauson, Geiger, Dilenno, Putaansuu and Wyatt. Council Member Powers absent. ALSO PRESENT: Planning Director Long-Woods, City Clerk Merlino, and Assistant City Attorney Greg Jacoby. At 7:12 p.m. Mayor Abel opened the meeting and started the Council deliberation on maximum structure heights as it relates to Sections 100, 110 and 120 of the DOD regulations. Council Member Geiger again voiced his concern with making amenities dependent upon height allowance. Council Member Geiger feels amenities should be required of all developers. Mayor Abel asked the Council if View Corridors should be required on any of the buildings above 27 feet. Council Member Putaansuu recommended View Corridors and step backs on the south side of Bay Street above 39 feet and further recommended that View Corridors are not necessary on the north side of Bay Street. Council Member Dilenno would like the View Corridors relating to maximum height be reviewed on a case-by-case basis. Council Member Dilenno further commented any structure below 27 feet would not require a Conditional Use Permit, however over 27 feet heights need to be reviewed. City Attorney Jacoby asked if the Council was more concerned about residential views or commercial views. The Council concurred they are concerned about commercial and residential views. At this time of the meeting, Mayor Abel asked for a consensus of the Council regarding View Corridors vs. View Protection Ordinance with a 30% view limitation. The Council concurred with the language of View Corridors. June 12, 2007 Page 2 of 2 Mayor Abel further asked the Council at what height should the building structures be required to implement the View Corridors. The Council concurred to retain the language that is currently proposed as follows: ~ North side of Bay Street, heights can go up to 39 feet, with no view corridors however will provide an amenity and also go through the Conditional Use Permit process. ~ South side of Bay Street, heights above 39 feet will provide two amenities, view corridors and go through the Conditional Use Permit process. After additional discussion on the amenities, Council concurred that the value of amenities shall be the same on both side of Bay Street. Percentage has not been determined at this time. At this time of the meeting the Council started discussion on Section 110 -Amenities for Maximum Height. Council concurred on the following changes: ~ Modified Section (1) (a) "The space is at least ten (10) percent of the lot area and has a dimension ratio of not more than 5:1". ~ Modified Section (1) (f) as follows: "Provides signage, access, and visibility from the nearest public sidewalk or walkway, or signage of the ~ Section 2 -water features should be on site ~ Section 3 -Council concurred with this section ~ Section 4 -Council concurred to delete this section The Council scheduled the next meeting as follows: ~ June 29, 2007 at 7:00 pm, City Hall ~ July 6, 2007 at 7:00 pm, City Hall Meeting adjourned at 9:15 pm Kim E.
