06/29/2007 - Special - MinutesPRESENT: Kim E. Abel, Mayor City of Port Orchard City Council Deliberation Regarding the Downtown Overlay District June 29, 2007 Council Members: Chang, Clauson, Diienno, Powers, Putaansuu and Wyatt. Council Member Geiger absent. ALSO PRESENT: City Clerk Merlino, and Assistant City Attorney Greg Jacoby. At 7:00 pm Mayor Abel adjourned Council into Executive Session for 30 minutes to discuss real estate transactions and extended the executive session for an additional 15 minutes and reconvened the meeting at 7:45 p.m. Mayor Abel suggested the Council continue their deliberation and discussion with Section 110-Amenities for Maximum Structure Height. Council Member Clauson referred to subsection #5 and suggested pedestrian access be allowed from the buildings on the north side of Bay Street through to the waterfront. Assistant City Attorney Jacoby commented, this is what subsection #5 is intended to allow, as opposed to Subsection #3 which provides mid-block access between existing buildings. Council concurred with Subsection #6 -Waterview opportunity by means of a public viewing platform. Council concurred that Subsections #7, #8 and #9 relate to waterfront lots, such as Kitsap Bank, Yacht Sales, etc. Council Member Powers asked who would maintain the pier access. Assistant City Attorney Jacoby advised language could be inserted as follows: "All amenities must be maintained by owner for the life of the building." Council concurred to delete Subsection # 10 relating to vegetated roofs. June 29, 2007 Page 2 of 2 Council concurred to delete the second sentence in Subsection #11 as follows: Wflefl avo or more property owners combine their special amenity obligations, then the requirements for the combined single amenity shall be 75% of vv~hat would otherwise have been required if done separately. The Council discussed how to determine the valuation of a new structure and remodeled structures as it relates to special amenities. Assistant City Attorney Jacoby advised he will contact other cities to see what formulas they use to make this determination. Council Member Putaansuu addressed the draft ordinances regarding undergrounding utilities within the Downtown core. The Council concurred to draft language within the ordinance to allow transformers, switching stations, etc to be located either underground or placed in the buildings.
