Recommended Action: Move that the Board execute contract KC -065-21-A - Traffic Safety Task
Force
Summary:
Interlocal Agreement for mutual aid and traffic safety task force between the
Kitsap County Sheriff's Office and the police departments of Bainbridge Island,
Bremerton, Port Orchard, Poulsbo, and Suquamish.
This Amendment shall be effective retroactively as of January 1, 2026 ("Effective
Date"). To the extent that any mutual aid services were provided, law enforcement
powers were exercised, or payments were made between January 1, 2026, and
the date of full execution of this Amendment, the Parties hereby ratify and approve
such actions, intending them to be governed by the terms and conditions of the
Agreement as amended herein.
This Agreement shall remain in full force and effect unless terminated as provided
in Section 6.

AMENDMENT TO
INTERLOCAL AGREEMENT FOR MUTUAL AID AND TRAFFIC SAFETY TASK FORCE
This AMENDMENT ("Amendment") to the Interlocal Agreement for Mutual Aid and Traffic Safety
Task Force is made by and between Kitsap County, a Washington political subdivision ("County"),
on behalf of the Kitsap County Sheriff's Office, and the City of Bainbridge Island on behalf of the
Bainbridge Police Department, the City of Bremerton on behalf of the Bremerton Police
Department, the City of Port Orchard on behalf of the Port Orchard Police Department, and the
City of Poulsbo on behalf of the Poulsbo Police Department, all Washington state municipal
corporations, and the Suquamish Tribe on behalf of the Suquamish Police Department, a federally
recognized tribe, all are collectively referred to as a "Participating Agency" and collectively
referred to as the "Parties".
WHEREAS the parties executed Interlocal Agreement for Mutual Aid and Traffic Safety Task
Force KC -065-21, effective January 1, 2021 ("Agreement") for the purpose of providing mutual
law enforcement assistance to target and apprehend individuals committing traffic offenses.
WHEREAS, the Agreement expired December 31, 2025, during which time the Parties continued
to operate and provide mutual aid services, and desire to ratify those actions and make this
Amendment retroactive to that date to ensure continuous coverage and authority.
WHEREAS, the Parties desire to extend the duration of the Agreement subject to the terms and
conditions of this Amendment.
NOW, THEREFORE, in consideration of the foregoing recitals, which are incorporated by
reference, the parties agree as follows:
1. Section 5. Section 5 (Effective Date, Duration, Filing) of the Agreement is amended and
replaced in with the following:
This Amendment shall be effective retroactively as of January 1, 2026 ("Effective Date").
To the extent that any mutual aid services were provided, law enforcement powers were
exercised, or payments were made between January 1, 2026, and the date of full
execution of this Amendment, the Parties hereby ratify and approve such actions,
intending them to be governed by the terms and conditions of the Agreement as amended
herein.
This Agreement shall remain in full force and effect unless terminated as provided in
Section 6.
2. Section 6. Section 6 (Termination) of the Agreement is amended and replaced with the
following:
Any Participating Agency may terminate its participation under this Agreement by
providing thirty (30) days' prior written notice to the other parties. The termination of a
Participating Agency will not automatically result in the dissolution of the Task Force. A
terminated participating agency assumes no responsibility for the acts or omissions
occurring after the effective termination date but shall remain liable for acts or omissions
occurring prior to the effective date of termination. The Task Force may be dissolved in its
entirety by unanimous agreement of all parties.
3. Precedence. In the event of any conflict or inconsistency between the provisions of this
Amendment and the Agreement, including any prior amendments, the provisions of this
Traffic Safety Task Force ILA KC -065-21-A
Amendment shall prevail.
4. Terms Unchanged. Except as expressly provided in this Amendment, all other terms and
conditions of the Agreement, including any prior amendments, remain unchanged and in full
force and effect.
5. Counterparts/Electronic Signature. This Amendment may be executed in several
counterparts, each of which shall be deemed an original, but all of which together shall
constitute one and the same agreement. Facsimile, email, or other electronically delivered
signatures of the parties shall be deemed to constitute original signatures and duplicate
originals.
6. Authorizations. The signatories to this Amendment represent that they have been
appropriately authorized to enter into this Amendment on behalf of the party for whom they
sign, and that no further action or approvals are necessary before execution of this
Amendment.
