A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
FIXING THE DATE OF PUBLIC HEARING ON A PETITION TO VACATE
A PORTION OF CITY RIGHT-OF-WAY COMMONLY KNOWN AS AUSTIN
STREET.
LEGAL DESCRIPTION: Exhibit "A".
WHEREAS, the Petitioners have submitted a petition to vacate a portion of City
right-of-way commonly known as Austin Avenue; and
WHEREAS, the Petitioners constitute one hundred percent of the owners of the
property abutting the area proposed for vacation; and
WHEREAS, the property sought to be vacated is approximately 7,920 square feet;
and
WHEREFORE, Petitioners pray that proceedings be had hereon for the Vacation of
said area of said right-of-way in the manner prescribed by RCW 35. 79; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
THAT: A Public Hearing on a Petition to Vacate a portion of City right-of-way
commonly known as Austin Avenue, as submitted by William M. Crawford, Marilyn
M. Crawford, John M. McGilliard, Carol C. McGilliard, Richard L. Peterson, Linda L.
Peterson, Mark L. Yelish and Diane L. Yelish and Mr. And Mrs. Robert A. Fralick,
further described as follows, is hereby fixed for Monday, November 27, 2006, in the
City Council Chambers, City Hall, 216 Prospect Street, Port Orchard, Washington.
BE IT FURTHER RESOLVED THAT: The city clerk shall give twenty days' notice
of the pendency of the petition by a written notice posted in three of the most
public places in the city and a like notice in a conspicuous place on the street sought
to be vacated. The said notice shall contain a statement that a petition has been
filed to vacate the street described above, together with a statement of the time and
place fixed herein for the hearing of the petition.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and
attested by the Clerk in authentication of such passage this 23rd day of October 2006.
