A RESOLUTION OF THE CITY OF PORT ORCHARD,
WASHINGTON, REGARDING THE INTERLOCAL
TELECOMMUNICATIONS AGREEMENT BETWEEN THE CITY
OF PORT ORCHARD AND THE PUBLIC UTILITY DISTRICT
NO. 1 OF KITSAP COUNTY
WHEREAS, on September 23, 2003, the City of Port Orchard and the Public Utility
District No. 1 of Kitsap County (the PUD) entered into an Interlocal Telecommunications
Agreement (the Agreement) regarding the use and occupancy of public rights of way for
telecommunication services; and
WHEREAS, one of the primary purposes of the Agreement was to promote the
distribution and provision of telecommunication services to areas of the City that were lacking
access to such services and to promote competition; and
WHEREAS, the initial 5-year term of the Agreement expires September 22, 2008; and
WHEREAS, during the initial term of the Agreement, the PUD has not made a
substantive effort to implement the goals and purpose of the Agreement and the PUD does not
appear to have any near term plans to provide telecommunication services to the City; now,
therefore
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY
RESOLVES AS FOLLOWS:
THAT: As a matter of City policy, there is no reason to maintain
an Interlocal Agreement with PUD No. 1 regarding the use and
occupancy of public rights of way for a telecommunication
services and the Mayor is authorized to notify PUD No. 1 of the
City's intent to not renew the Agreement when the initial term
expires.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the Clerk in authentication of such passage this 12th day of August 2008.
