Provide direction to GTH-GA on changes necessary to finalize the 2019 legislative agenda. Issue: In order to lay a foundation for success, it is crucial that the City adopt a legislative agenda with ample time for the Mayor, Councilmembers, and GTH-GA lobbyists to communicate with the City legislative delegation prior to the start of session. Background: The 2019 legislative session starts on January 14th, and in preparation GTH-GA staff have been working with the Mayor and City staff to develop a draft legislative agenda. The Council’s input and approval are critical to ensure that the City is speaking with “one voice” in communicating legislative priorities. After today’s work session, GTH-GA will prepare a proposed final agenda for the Council’s adoption on October 23rd. Alternatives: Hold a second work session to review alternative legislative priorities. Recommendation: Provide input to GTH-GA so a final agenda can be adopted by the Council on the 23rd. Follow-up Notes & Outcomes: Page 3 of 24 Page 4 of 24 2019-21 Legislative Priorities McCormick Sewage Lift Station #2 The City of Port Orchard inherited responsibility for the McCormick Woods sewer lift station from Kitsap County in 1994. The old sewer lift station is functionally obsolete. The City and private developer are jointly completing two new sewage lift stations. Lift Station #1 is under construction at the developer’s expense, and the City is responsible for building Lift Station #2 in 2019. The total project cost to the City will be $2.8 million and is seeking $1 million in capital budget funding to complete the project. State Investment in State Routes Like many cities, Port Orchard faces challenges in maintaining and improving the City’s transportation system. State routes – Sedgwick Road (State Route 160) and State Route 16 – traverse through the City and serve as both regional and local thoroughfares. Because these are state routes, the state is responsible for maintaining and improving them to accommodate the region’s growing population. The City is seeking $8 million in transportation funding for two compact roundabouts at the SR-16 and SR-160 interchanges in order to help mitigate congestion along these state routes. Economic Development Tools The City of Port Orchard supports economic development tools that benefit the development of the City’s downtown area. The City also supports the Association of Washington Cities economic development and redevelopment legislative priority as it benefits the City of Port Orchard. Condominium Liability The City of Port Orchard supports legislation that limits liability on condominium developers. In 2005, WA State passed a “model” condominium liability law that resulted in an unfriendly environment and strict liability laws for condominium developers, and the issue has not been revisited since. The City supports modernizing the statute to ease some of this burden on developers. Some examples the City is interested in are: defining what “damage” is, allowing the developer an opportunity to cure or fix a defect, a warranty insurance program, and smaller condo buildings. Foster Pilot Program The City of Port Orchard was chosen by the State for a water resource mitigation pilot project, which will inform a legislative task force on options for how to respond to the Foster decision. The outcomes of this pilot project, and ultimately the recommendations of the legislative task force are of critical importance for the City and the state. The City seeks ongoing legislative support for these issues as the pilot program and task force continue. The City of Port Orchard supports the Association of Washington Cities’ legislative agenda. Page 5 of 24 Page 6 of 24 City of Port Orchard Work Study Session Executive Summary Issue Title: Rockwell Pocket Park Final Design & Presentation of VE Options Meeting Date: October 16, 2018 Time Required: 20 Minutes Attendees: Mark R. Dorsey, P.E, Public Works Director/City Engineer Action Requested At This Meeting: Presentation of the Rockwell Pocket Park Final Design and Value Engineering (VE) Options, followed by discussion and direction to the Mayor for completion of 100% Ad Ready PS&E for advertisement in early 2019. Background/Issue: In 2017, the City completed the 30% Conceptual Design for the Rockwell Pocket Park. In 2018, a grant award from the Department of Commerce in the amount of $299,730 was accepted by the City. With the conceptual poject cost estimate at $452,000, a funding shortfall of $152,270 was anticipated (see 30% Funding Memo dated 5/12/18 attached.) The 90% final design cost estimate, with a 10% contingency ($39k), increased the funding shortfall to $260,865 (see 90% Funding Memo dated 9/18/2018 attached.) Given the significant increase to the total project cost, staff directed the consultant team to Value Engineer (VE) the project. Now that the the Final post-VE Ad Ready Design is complete, the current cost estimate with a $28k Minor Change for the project contingency has decreased the funding shortfall to $222,865 (see 100% Funding Memo dated 10/8/18 attached.) Alternatives: The consultant team and staff met in September of 2018 to VE the project, whereby reductions and/or changes in specifications of primarily landscape features were reviewed. Recommendation: Staff recommends discussing the issue, and then provide direction to the Mayor.
