5. PRESENTATION
A. Fathoms O’ Fun Civil War Re-Enactors Group
Sharron King, Chair of Fathoms O’ Fun Festival, introduced Roy Talbot, Chair of the 4th US Company
C, and Deb Quinn, a member of US Company C. They had approached Ms. King, to ask if their Civil
War group could be in next year’s parade. Ms. King said yes and asked if they could also do
demonstrations during the summer festival. Ms. King is seeking Council’s permission through the
formal event application process.
Mr. Talbot and Ms. Quinn provided a brief presentation on Civil War Re-Enactors and explained how
they would hold their demonstrations downtown and set up their event.
After a brief discussion, Council voiced some concerns about the closure of Bay Street and asked
about other location options. They look forward to reviewing the event application when it comes
through.
6. PUBLIC HEARING
A. Public Hearing on the Proposed 2019-2020 Biennial Budget
Mayor Pro-Tem Diener opened the public hearing, and there being no testimony, closed the public
hearing at 7:01 p.m.

A. Adoption of a Resolution Approving a Contract with Tierra Right of Way Services, Ltd. for the
Continuation of Bay Street Pedestrian Pathway Project Real Estate Professional Acquisition
Services
MOTION: By Councilmember Lucarelli, seconded by Councilmember Clauson, to adopt a Resolution,
thereby approving a Contract with Tierra Right of Way Services, Ltd. for the continuation of the Bay
Street Pedestrian Pathway Project – Real Estate Professional Acquisition Services in the amount not
to exceed $174,877.87 and documenting the Professional Services procurement procedures.
The motion carried.

B. Approval of the October 16, 2018, Council Work Study Session Minutes
MOTION: By Councilmember Chang, seconded by Councilmember Rosapepe, for approval of the
October 16th, work study minutes.
The motion carried. Councilmember Ashby abstained.
C. Discussion: Lodging Tax Advisory Committee’s Recommendation for 2019 Funding Allocation
City Clerk Rinearson provided a brief background on this year’s lodging tax discussions, and the
Lodging Tax Advisory Committee’s recommendations to Council. She asked if Council wants to bring
this item forward at the next Council meeting for adoption or bring it back to the next work study for
further discussion.
Councilmember Rosapepe, Chair of the Lodging Tax Advisory Committee, recommends moving
forward with the current recommendations of $100,000.
Council Direction: Bring this forward for adoption at the next Council meeting.
D. Discussion: Updating the “Destination Port Orchard” Video
City Clerk Rinearson explained the Economic Development/Tourism Committee reviewed and
discussed the “Destination Port Orchard” video, stating it is outdated and should be updated. The
committee asked the Mayor to bring a contract to Council in October for a consultant to prepare
these revisions.

The Mayor reached out to a video creator for a quote. That quote was provided to the Council at the
October 9th Council meeting. Council directed the Mayor to reach out and seek information about
creating a video which would include tourism, visitors, and economic opportunities; and seek other
quotes.
Three quotes were presented along with video samples of each of the consultants’ work, and in
reviewing the quotes and videos, the Economic Development and Tourism committee felt that each
of the consultants’ work were equally good. They didn’t feel that they could justify moving forward
with the higher quotes, therefore, the committee recommend proceeding with the lowest bid.
MOTION: By Councilmember Cucciardi, seconded by Councilmember Lucarelli, to authorize the mayor
to enter into contract with EVi Productions to produce videos promoting Port Orchard.
The motion carried.

E. Orchard Community Center Potential Presentation by the City on December 3rd at Kitsap Public
Facilities District Board Meeting.
Mayor Pro-Tem Diener explained he read a Kitsap Sun article that mentioned there is a presentation
from the City of Port Orchard on December 3rd for the Port Orchard Community Center.
Council briefly discussed this, and noted this was an old discussion, and said there are no plans to
move forward with this presentation.
Council Direction: Ask Mayor Putaansuu to reach out to the Kitsap Facilities District and inform them
we have no plans to be at that meeting.
8. REPORTS OF COUNCIL COMMITTEES
Councilmember Clauson discussed emails the Council received regarding potential parking issues on
Orlando Street and parking near Etta Turner Park. He also mentioned the ribbon cutting event for
the Kingston fast ferry is scheduled for November 19th.
Councilmember Ashby reported on the November 7th Economic Development and Tourism
Committee meeting. The next meeting is scheduled for Dec 10th. The Kitsap Regional Coordinating
Council Legislative Reception is scheduled for November 29th.
Councilmember Lucarelli reported the next Utilities meeting is scheduled for December 17th. The
Sewer Advisory Committee is scheduled to meet November 14th. The Chimes and Lights Committee
is scheduled to meet November 19th.

Councilmember Diener reported on the November 5th Land Use Committee meeting. The next
meeting is scheduled for December 3rd.
Community Development Director Bond briefly discussed the multifamily tax abatement and noted
he has been in contact with other jurisdictions about their processes. He noted we have a request
for expansion of the multifamily property tax exemption location near Fred Meyer and said market
rate apartments in Port Orchard qualify for tax abatement. The City has adopted an Ordinance which
shows the areas designated for the tax exemption program.
Council Direction: Council directed a draft ordinance amending the tax exemption map be brought
forward at the November work study meeting.
9. REPORT OF MAYOR
There was no report of the Mayor.
10. REPORT OF DEPARTMENT HEADS
Public Works Director Dorsey said he will be reporting on parking issues and will have a presentation
on the Annapolis Culvert Project at the next work study meeting.
After a brief discussion with Council, Finance Director Crocker reported the next Finance meeting is
scheduled for November 20th at 5p.m.
City Clerk Rinearson showed a video on the Port Orchard marina.
11. CITIZENS COMMENTS
Sharron King mentioned she posted an ad in the Port Orchard Independent that thanked the City and
Councilmembers for making Port Orchard a fun and friendly place to hold events. She thanked
Council for all their support for Fathoms O’ Fun.
Helene Jensen, Fathoms O’ Fun Pageant Director, invited Council to bring their family and friends to
the Santa breakfast on November 24th. She also said she is a little short on contestants for the
Fathoms O’ Fun scholarship program and asked if they know of anyone who would be interested in
running, please send them her way.

At 7:57 p.m., Mayor Pro-Tem Diener recessed the meeting for a 10-minute executive session to
discuss a potential litigation matter pursuant to RCW 42.30.110(1)(i). City Attorney Cates and Public
Works Director Dorsey were invited to attend.
At 8:07 p.m., Mayor Pro-Tem Diener reconvened Council back into regular session.

Summary: As a housekeeping measure, working in conjunction with Parking Enforcement staff and the
directions given at the November 5, 2018 Land Use Committee and the November 20, 2018 Work Study
Session, the City’s Public Works Department continues to inventory existing signage to compile corrections,
make revisions and/or modifications to the current Port Orchard Municipal Code (POMC), Chapter 10.12.
Relationship to Comprehensive Plan: None
Recommendation: Staff recommends adoption of an Ordinance, thereby updating POMC Chapter
10.12.500, 10.12.560, 10.12.580 and 10.12.640, regarding Parking, Stopping or Standing in Certain Areas of
the City.
Motion for Consideration: I move to adopt an Ordinance, thereby updating POMC Chapter 10.12.500,

ORDINANCE NO. ____
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, RELATING TO
PARKING ON PUBLIC STREETS; AMENDING SECTIONS 10.12.500, 10.12.560,
10.12.580 AND 10.12.640 OF THE PORT ORCHARD MUNICIPAL CODE, AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, WAC 308.330.270 authorizes the City to adopt regulations to prohibit,
regulate or limit stopping, standing or parking of vehicles in the City; and
WHEREAS, Port Orchard Municipal Code Section 10.12.080(1) authorizes the City
Council to from time to time, establish parking prohibitions and restrictions on portions of
certain specified streets; and
WHEREAS, the City Council deems it in the best interest of the City of Port Orchard to
periodically review and update such regulations; and
WHEREAS, the City Council chose to codify the parking regulations in order to aid the
public in its ability to access and review said regulations; and
WHEREAS, in response to three issues brought before the Land Use Committee on
November 5, 2018 and as discussed at the November 20, 2018 Work Study Session, being
potential changes along Bay Street, Etta Turner Park and Tracy Avenue, specific revisions to
Sections 10.12.500, 10.12.560 and 10.12.580 are hereby proposed by staff; and
WHEREAS, in response to missing infraction language, specific revisions to Section
10.12.640 is hereby proposed by staff; and
WHEREAS, staff has inspected and verified the parking conditions, including signage, at
the location described and seeks to modify the regulations so that the regulations correctly
reflect the true conditions; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS
FOLLOWS:
SECTION 1. Section 10.12.500 of the Port Orchard Municipal Code is hereby amended
to read as follows:
10.12.500 Parking prohibited at all times.
When signs are erected by the city engineer giving notice thereof, no person shall park a
vehicle at any time upon any of the streets or parts of streets described as follows:
1. Ada Street: on the north side of Ada Street, in

SECTION 3. Section 10.12.580 of the Port Orchard Municipal Code is hereby amended
to read as follows:
10.12.580 Parking time limited on certain city parking lots.
(1) The city parking lots are identified as follows:
(a) Lot 1, which lies between Orchard and Frederick Streets, on the north of Bay Street.
Parking in Lot 1 is a combination of monthly and merchant pass parking and Port Orchard
Marina parking. Port Orchard Marina parking is the three northernmost rows and shall be
managed by the Port of Bremerton. Designated monthly and merchant pass parking, the most
southern row shall require the purchase of a parking pass as established in POMC 10.12.620.
(b) Lot 2, which lies between Frederick Street and Sidney Avenue, north of Bay Street.
Parking in Lot 2 shall be allowed for a maximum period of four hours, including two car charging
stalls limited to four hours maximum.
(c) Lot 3, which is the five rows of parking area under city jurisdiction west of Harrison
Avenue and east of and parallel to the library’s easternmost exterior wall. Parking in the three
westerly rows of Lot 3 shall be allowed for a maximum period of two hours at no monetary
charge. Parking in the easterly two rows is paid parking and shall require a paid daily parking
pass as established in POMC 10.12.620.
(d) Lot 4, which is all parking area under city jurisdiction which lies east of Parking Lot 3
and Harrison Avenue and west of the Marina Park. Parking in Lot 4 is a combination of free two-
hour parking for the park at the most northerly and easterly corner and paid parking and shall
require a paid daily parking pass as established in POMC 10.12.620.
(e) Lot 5, which is all parking spaces on City Hall property (first floor entry). Parking in
Lot 5 shall be for City Hall patrons and official vehicles only. The police chief or his/her
designate may authorize deviations to this policy for Lot 5, if necessary. No monetary charge.
(f) Lot 6, which is all parking spaces abutting the landscaped area at the southwest
corner of the intersection of Bay Street and DeKalb Street (Bayside Plaza). Parking in Lot 6 shall
be allowed for a maximum period of two hours. No monetary charge.

(g) Lot 7, which is all parking spaces located on the library property. Parking in Lot 7 shall
be limited to library staff only. Access to Lot 7 and parallel parking stalls via the adjacent parcel
to the south pursuant to easement AF# (8903310122). No monetary charge.
(h) Lot 8, which lies east of City Hall, north of and adjacent to Prospect Alley (between
Kitsap Street and Prospect Street). Lot 8 is for designated city vehicles and city employees via
pass Monday through Friday. No monetary charge.
(i) Paul Powers Park, which lies north and east of the public works department “south
shed” located at 2051 Sidney Avenue. Paul Powers Park parking is limited to dawn-to-dusk
parking only.
(j) Van Zee Park, which lies south of Tremont Street and west of Sidney Avenue, located
at 300 Tremont Street. Van Zee Park parking is limited to dawn-to-dusk parking only.
(k) Etta Turner Park, other than the marked parking stalls along the east side of the
sidewalk (within the Water Street Waterway) and limited to two-hour parking from dawn to
dusk, there shall be no additional parking allowed.
(i) Rockwell Pocket Park will be limited to two-hour parking from dawn to dusk.
(2) Parking restrictions in Lots 1, 2, 3, 4, 5, 6, 7 and 8 shall be enforced on a 24-hour
basis, except Saturday, Sunday, and federal holidays within the city.
(3) Parking restrictions in Lot 4 shall also be enforced on a 24-hour basis on each
Saturday in the period of April 1st to October 31st.
SECTION 4. Section 10.12.640 of the Port Orchard Municipal Code is hereby amended
to read as follows:
10.12.640 Parking of certain trailers and semitrailers.
No trailer or semitrailer shall be parked upon any city street unless the trailer or
semitrailer is attached to a vehicle by which it may be propelled or drawn. In case of accident,
such trailer or semitrailer may be moved to the side of the street, and if a good and sufficient
red signal is displayed at both ends of the trailer or semitrailer during the hours of darkness,
such trailer or semitrailer may be permitted or allowed to remain for a period not exceeding 24
hours pending removal, except that such trailer or semitrailer shall not remain upon any
portion of a city street where standing or parking is limited or prohibited for a period longer
than is necessary to effect its removal. Violation of this section is a Class A parking infraction.

SECTION 5. Posting Signs. The City Engineer is hereby directed to post the signs as
required and as a result of the amendments of Section 10.12.500, 10.12.560, 10.12.580 and
10.12.640, after passage of this Ordinance, before the Effective Date.
SECTION 6. Severability. If any section, subsection, paragraph, sentence, clause, or
phrase of this ordinance is declared unconstitutional or invalid for any reason, such decision
shall not affect the validity of the remaining parts of this ordinance.
SECTION 7. Effective Date. This ordinance shall be in full force and effect five (5) days
after posting and publication as required by law. A summary of this Ordinance may be
published in lieu of the entire ordinance, as authorized by State Law.

AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, RELATING TO
PARKING ON PUBLIC STREETS; AMENDING SECTIONS 10.12.500, 10.12.560,
10.12.580 AND 10.12.640 OF THE PORT ORCHARD MUNICIPAL CODE, AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, WAC 308.330.270 authorizes the City to adopt regulations to prohibit,
regulate or limit stopping, standing or parking of vehicles in the City; and
WHEREAS, Port Orchard Municipal Code Section 10.12.080(1) authorizes the City
Council to from time to time, establish parking prohibitions and restrictions on portions of
certain specified streets; and
WHEREAS, the City Council deems it in the best interest of the City of Port Orchard to
periodically review and update such regulations; and
WHEREAS, the City Council chose to codify the parking regulations in order to aid the
public in its ability to access and review said regulations; and
WHEREAS, in response to three issues brought before the Land Use Committee on
November 5, 2018 and as discussed at the November 20, 2018 Work Study Session, being
potential changes along Bay Street, Etta Turner Park and Tracy Avenue, specific revisions to
Sections 10.12.500, 10.12.560 and 10.12.580 are hereby proposed by staff; and
WHEREAS, in response to missing infraction language, specific revisions to Section
10.12.640 is hereby proposed by staff; and
WHEREAS, staff has inspected and verified the parking conditions, including signage, at
the location described and seeks to modify the regulations so that the regulations correctly
reflect the true conditions; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS
FOLLOWS:

SECTION 3. Section 10.12.580 of the Port Orchard Municipal Code is hereby amended
to read as follows:
10.12.580 Parking time limited on certain city parking lots.
(1) The city parking lots are identified as follows:
(a) Lot 1, which lies between Orchard and Frederick Streets, on the north of Bay Street.
Parking in Lot 1 is a combination of monthly and merchant pass parking and Port Orchard
Marina parking. Port Orchard Marina parking is the three northernmost rows and shall be
managed by the Port of Bremerton. Designated monthly and merchant pass parking, the most
southern row shall require the purchase of a parking pass as established in POMC 10.12.620.
(b) Lot 2, which lies between Frederick Street and Sidney Avenue, north of Bay Street.
Parking in Lot 2 shall be allowed for a maximum period of four hours, including two car charging
stalls limited to four hours maximum.
(c) Lot 3, which is the five rows of parking area under city jurisdiction west of Harrison
Avenue and east of and parallel to the library’s easternmost exterior wall. Parking in the three
westerly rows of Lot 3 shall be allowed for a maximum period of two hours at no monetary
charge. Parking in the easterly two rows is paid parking and shall require a paid daily parking
pass as established in POMC 10.12.620.
(d) Lot 4, which is all parking area under city jurisdiction which lies east of Parking Lot 3
and Harrison Avenue and west of the Marina Park. Parking in Lot 4 is a combination of free two-
hour parking for the park at the most northerly and easterly corner and paid parking and shall
require a paid daily parking pass as established in POMC 10.12.620.
(e) Lot 5, which is all parking spaces on City Hall property (first floor entry). Parking in
Lot 5 shall be for City Hall patrons and official vehicles only. The police chief or his/her
designate may authorize deviations to this policy for Lot 5, if necessary. No monetary charge.
(f) Lot 6, which is all parking spaces abutting the landscaped area at the southwest
corner of the intersection of Bay Street and DeKalb Street (Bayside Plaza). Parking in Lot 6 shall
be allowed for a maximum period of two hours. No monetary charge.

(g) Lot 7, which is all parking spaces located on the library property. Parking in Lot 7 shall
be limited to library staff only. Access to Lot 7 and parallel parking stalls via the adjacent parcel
to the south pursuant to easement AF# (8903310122). No monetary charge.
(h) Lot 8, which lies east of City Hall, north of and adjacent to Prospect Alley (between
Kitsap Street and Prospect Street). Lot 8 is for designated city vehicles and city employees via
pass Monday through Friday. No monetary charge.
(i) Paul Powers Park, which lies north and east of the public works department “south
shed” located at 2051 Sidney Avenue. Paul Powers Park parking is limited to dawn-to-dusk
parking only.
(j) Van Zee Park, which lies south of Tremont Street and west of Sidney Avenue, located
at 300 Tremont Street. Van Zee Park parking is limited to dawn-to-dusk parking only.
(k) Etta Turner Park, other than the marked parking stalls along the east side of the
sidewalk (within the Water Street Waterway) and limited to two-hour parking from dawn to
dusk, there shall be no additional parking allowed.
(i) Rockwell Pocket Park will be limited to two-hour parking from dawn to dusk.
(2) Parking restrictions in Lots 1, 2, 3, 4, 5, 6, 7 and 8 shall be enforced on a 24-hour
basis, except Saturday, Sunday, and federal holidays within the city.
(3) Parking restrictions in Lot 4 shall also be enforced on a 24-hour basis on each
Saturday in the period of April 1st to October 31st.
SECTION 4. Section 10.12.640 of the Port Orchard Municipal Code is hereby amended
to read as follows:
10.12.640 Parking of certain trailers and semitrailers.
No trailer or semitrailer shall be parked upon any city street unless the trailer or
semitrailer is attached to a vehicle by which it may be propelled or drawn. In case of accident,
such trailer or semitrailer may be moved to the side of the street, and if a good and sufficient
red signal is displayed at both ends of the trailer or semitrailer during the hours of darkness,
such trailer or semitrailer may be permitted or allowed to remain for a period not exceeding 24
hours pending removal, except that such trailer or semitrailer shall not remain upon any
portion of a city street where standing or parking is limited or prohibited for a period longer
than is necessary to effect its removal. Violation of this section is a Class A parking infraction.

SECTION 5. Posting Signs. The City Engineer is hereby directed to post the signs as
required and as a result of the amendments of Section 10.12.500, 10.12.560, 10.12.580 and
10.12.640, after passage of this Ordinance, before the Effective Date.
SECTION 6. Severability. If any section, subsection, paragraph, sentence, clause, or
phrase of this ordinance is declared unconstitutional or invalid for any reason, such decision
shall not affect the validity of the remaining parts of this ordinance.
SECTION 7. Effective Date. This ordinance shall be in full force and effect five (5) days
after posting and publication as required by law. A summary of this Ordinance may be
published in lieu of the entire ordinance, as authorized by State Law.

Summary: On September 27, 2018, the Lodging Tax Advisory Committee heard presentations from
applicants who requested funds for 2019; and on October 4, 2018, the Committee met to discuss the
applications and to provide the Council with a recommendation of the fund allocation.
On October 9, 2018, Council discussed the Committee’s recommendation of $125,000; which uses
$25,000 of the fund balance/reserve. Council expressed concerns of cash flow, spending money we
don’t have, allocating funds at this amount is not sustainable, and funds may not come in as anticipated.
Therefore, remanded back to the Committee for them to only allocate $100,000. Should the Committee
continue with the $125,000 allocation, it would be with the understanding that only $75,000 would be
allocated in 2020.
On October 22, 2018, the Committee met to discuss Council’s comments. The Committee didn’t want to
risk the non-profits having less funds for the following year; and directed staff to reach out to them and
get their input on their preference.
On November 5, 2018, the Committee reconvened to discuss responses received from the applicants. At
the recommendation of the non-profits, the committee reallocated the funds totally $100,000. They are
as follows:

A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
ADOPTING THE LODGING TAX ADVISORY COMMITTEE’S
RECOMMENDATION FOR 2019 FUNDING ALLOCATION.
WHEREAS, on July 27, 2018, notice was sent that the City was accepting proposals
for Hotel/Motel Lodging Tax funding applications for 2018; and
WHEREAS, proposals were due to the City Clerk no later than September 5, 2018;
which 10 applications were received; and
WHEREAS, on September 27, 2018, the Lodging Tax Advisory Committee met with
each of the applicants who presented their proposals; and
WHEREAS, on October 4, 2018, the Lodging Tax Advisory Committee met to review
the applications and provide their recommendations to City Council; and
WHEREAS, during the October 9, 2018 regular business meeting, City Council
reviewed the 2019 Lodging Tax Advisory Committee’s recommendations and asked the Lodging
Tax Advisory Committee to meet again and; reduce the allocations; and
WHEREAS, On October 22, 2018, the Lodging Tax Advisory Committee met and

Summary: The Mayor of Port Orchard completed and placed on file a proposed budget and estimate of the
amount of the monies required to meet the public expense, bond retirement and interest, reserve funds, and
expense of the government of the City for the biennial period ending December 31, 2020. As required, the
City Council held a public hearing on revenue sources for the coming year’s budget, including consideration of
possible increases in property tax revenue.
The Finance Committee and council members met independently to study the proposed budget and held
budget interviews that required the presence of department heads. Input was sought from the full Council. A
public hearing seeking public input on the proposed budget was held November 13, 2018.
The 2019 – 2020 Biennial Budget does not exceed the lawful limit of taxation allowed by law to be levied on
the property within the City of Port Orchard for the purposes described in the 2019 – 2020 Biennial Budget,
and the estimated expenditures in each fund are all necessary to carry on the government of the City for the
biennial period 2019 – 2020.
The 2019 – 2020 Biennial Budget reflects department head requests, Mayor’s priorities, citizen comment,
Finance Committee and City Council input and modifications.
Recommendation: The Council Finance Committee recommends approval of an Ordinance adopting the 2019
– 2020 Biennial Budget for the City of Port Orchard for the years 2019 and 2020. Copies are on file in the
Office of the City Treasurer.
Motion for consideration: “I move to approve an Ordinance adopting the 2019 – 2020 Biennial Budget.”
Fiscal Impact: Allows expenditures for the biennial period ending December 31, 2020.

AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
ADOPTING THE 2019-2020 BIENNIAL BUDGET; PROVIDING FOR
SEVERABILITY AND PUBLICATION; AND SETTING AN EFFECTIVE
DATE.
WHEREAS, the preliminary budget for the 2019-2020 biennium, available
October 16, 2018, was submitted to the City Council; and
WHEREAS, the City Council held a comprehensive work study session on the
2019-2020 preliminary budget on October 16, 2018; and
WHEREAS, the full Council was invited to meet on October 19, 2018 to conduct
department interviews and discuss the preliminary budget to make final
recommendations; and
WHEREAS, the Council Finance Committee and two additional council members
met on October 19, 2018 and conducted department interviews and discussed the
preliminary budget to make final recommendations to the full Council; and
WHEREAS, the two remaining council members met on October 24, 2018 and
discussed the preliminary budget as well as the City Council recommendations from the
October 19, 2018 meeting; and
WHEREAS, the City Council held a public hearing on revenue sources on October
23, 2018; and
WHEREAS, the City Council acted to adopt the 2019 Property Tax Levy on
October 23, 2018; and
WHEREAS, a Notice of Hearing was published on November 2, 2018, and
November 9, 2018, in the Port Orchard Independent newspaper stating the 2019-2020
preliminary budget was on file with the City Clerk and copies could be obtained at the
Finance Department, and inviting the public to attend and/or submit written comments
at the public hearing held November 13, 2018; and
WHEREAS, the City Council held a public hearing on November 13, 2018
regarding the preliminary budget for the 2019-2020 biennium, seeking public input on
city priorities, public safety enhancements, cultural and recreational opportunities, and
other public services; and
WHEREAS, the City Council held a work study session on November 20, 2019 to
provide final comments and direction to staff on the 2019-2020 budget; and

final budget, setting forth in summary form the totals of estimated revenues and
appropriations of each separate fund and the aggregate totals of all such funds
combined; and
WHEREAS, a complete copy of the final budget as adopted shall be transmitted
to the State Auditor and to the Association of Washington Cities per RCW 35.34.120;
now, therefore,

Summary: The City desires to pay its claims and obligations in a timely manner to meet the city’s business
needs. The current process for approving claims and releasing payments to obligated parties is structured
around the timing of City Council meetings. The timing of Council meetings does not necessarily meet the
business practices of the City or the vendors that work for the City.
City staff has worked to create a Policy for the Disbursement of Funds prior to council approval that includes
proper expenditure controls. The purpose of the policy is to delegate authority to the Finance Department
to release payments to obligated parties as a function of City business. This requires maintaining proper
internal controls in accordance with the State Auditor’s requirements, as well as controls to meet Council
approval.
The policy will allow the executive branch of the City to operate and pay claims on a business needs basis,
irrespective of the timing of Council meetings. It maintains the requirement for Council approval on all
claims approved for payment.
Recommendation: The Council Finance Committee recommends approving the Resolution adopting the
Disbursement of Funds Policy and Procedures.

A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, ADOPTING THE
POLICY AND PROCEDURES FOR ISSUANCE OF CHECKS OR DISBURSING OF CITY
FUNDS BEFORE THE CITY COUNCIL APPROVES CLAIMS IN ACCORDANCE WITH
RCW 42.24.180.
WHEREAS, the City Council desires to expedite the payment of claims and allow the payment
before a City Council meeting can take place at which they can be approved; and
WHEREAS, the City Council may authorize the issuance of payment of claims after certain
provisions are met, but before the legislative body has acted to approve the claims; and
WHEREAS, the auditing officer and the officer designated to sign the checks, warrants or initiate
an electronic payment must have an official bond, and the City Council has determined the amount of
the bond to be Fifty Thousand Dollars ($50,000) (RCW 42.24.180); and
WHEREAS, if the City Council disapproves a claim that has already been paid pursuant to the
adopted policy and procedures, the auditing officer and the officer designated to sign the checks,
warrants or initiate the electronic payment must recognize these claims as receivables of the taxing
district and pursue collection diligently until the amounts are either collected or the legislative body is
satisfied and approves the claims; and
WHEREAS, the Finance Director shall be designated to sign checks, warrants, or initiate
electronic payments, and has developed the appropriate policy and procedures to do so in accordance
with this Resolution, other applicable laws, and accounting standards; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS
FOLLOWS:
THAT: The attached Policy and Procedures developed by the Finance Director are hereby
adopted to allow for the payment of claims prior to City Council approval; and
THAT: The Mayor and the Finance Director may disburse the city’s funds prior to City Council
approval in accordance with this Resolution and the established Policy and Procedures.

1.0 PURPOSE:
The following policies and procedures document a process that will allow the
disbursement of funds for accounts payable and payroll to continue under
the direction of the Finance Director prior to submitting to City Council for
approval. The city desires to expedite the payment of claims and pay some
claims that are due before the City Council’s meeting.
2.0 POLICY:
It is the general policy of the City that all expenditures be rationally related to
some public purpose and are reasonable in the amount and nature. Primary
responsibility and authority for the expenditure of monies according to the
adopted budget will be vested by the Finance Director in the department
heads. In addition to the primary responsibilities of the department directors,
the Finance Director will exercise a secondary oversight responsibility for all
budget expenditures.
3.0 PROCEDURES:

A. All purchase orders and/or invoices will be signed by the responsible
department head or his/her designee and reviewed by the appropriate
personnel in Finance for budget authority and proper coding.
B. Invoices for the costs of public utilities, telephone, postage, copy
machine expenses, and others shared by more than one department
will be reviewed and approved by the responsible department or
Finance Director or his/her designee.
C. All expenditures/expenses shall be pre-audited and certified by the
Auditing Officer or his/her designee prior to the release of payments.
D. City Council approval will occur at the following Council meeting or
within one month of issuance. The execution of the payments in
advance of City Council approval will occur under the conditions set
forth in Resolution 050-18.
E. If the City Council at the subsequent Council meeting (after review),
disapproves any such claims, the disapproved claims will be
recognized as a receivable of the City and collections of said
receivable will be diligently pursued until the amounts disapproved are
collected or until the Council is satisfied and approves the claims.
