042-11 - Resolution - Amendments to the Countywide Planning PoliciesIntroduced by: Requested by: Drafted by: Reviewed by: Introduced: Adopted: RESOLUTION NO. 042-11 Planning Director Planning Director Planning Director City Attorney December 13, 2011 December 13, 2011 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, RATIFYING THE PROPOSED 2011 AMENDMENTS TO THE COUNTYWIDE PLANNING POLICIES SUBMITTED BY THE BOARD OF THE KITSAP REGIONAL COORDINATING COUNCIL WHEREAS, The Growth Management Act (GMA), RCW 36.70A, requires that each county planning under GMA must adopt county-vvide planning policies to be used as a framework from which county and city comprehensive plans are developed and adopted; and WHEREAS, in May, 1992, the Kitsap Regional Planning Council, made up of elected officials of the county, cities, and tribes of Kitsap County, adopted the first county- wide planning policies pursuant to GMA; and WHEREAS, the Kitsap regional Coordinating Council initiated revisions to the county-wide planning policies through multijurisdictional collaboration including planning staff, planning commissioners and council and board members; and WHEREAS, beginning in 2010, the Kitsap Regional Coordinating Council (KRCC) began an update process for the Countywide Planning Policies to make them consistent with the adopted Puget Sound Regional Council's multicounty planning policies; and WHEREAS, in January 2010, the Kitsap Regional Coordinating Council held a public hearing on the proposed Countywide Planning Policies; and WHEREAS, in May 2011, the Kitsap Regional Coordinating Council forwarded the proposed Countywide Planning Policies to Kitsap County to begin the County's legislative process; and WHEREAS, in July 2011, a State Environmental Protection Act (SEPA) programmatic checklist was completed and submitted to the Kitsap County SEPA official; and WHEREAS, on July 22, 2011, the Kitsap County SEPA Official issued a Determination of Non-significance. A fomteen day appeal period was opened. No appeals were submitted by the requisite date of August 5, 20 n; and Resolution No. 042-11 Page 2 of7 WHEREAS, on September 12, 2011, the Kitsap County Board of Commissione rs held a hearing to consider the proposed revisions to the countywide planning polici es; a nd WHEREAS, at the Kitsap County Board of Commissioners adopted Ordinance No. KC-476-11, relating to growth management amending the County-wide Planning Policies, and were then forwarded onto the City jurisdictions for ratification on November 14, 2011; now, therefore; THE CI1Y COUNCIL OF THE CI1Y OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: The City Council of the City of Pmt Orchard, Washington, hereby ra tifies the Kitsap County-wide Planning Policies, as adopted via Kit s ap County Ordinance No. KC-476-11, dated November 14,2011, (Exhibit A) PASS ED by the City Council of the City of Pmt Orchard, SIGNED b y the Ma yor and attested by the City Clerk in authentication of such passage this 13th day of J?ece 1ber 2011. ORDINANCE NO. L/7 0 -2011 Resolution No. 042-11 Exhibit A RELATING TO GROWTH MANAGEMENT, AMENDING THE COUNTYWIDE PLANNING POLICIES BE IT ORDAINED: Section 1: The Kitsap County Board of County Commissioners makes the following Findings: A. The Kitsap County County-wide Planning Policies (CPPs) are intended to establish a county-wide framework from which county and city comprehensive plans are developed and adopted pursuant to RCW 36.70A.210 of the Washington State Growth Management Act (GMA). B. Kitsap County has adopted County-wide Planning Policies (most recently, Kitsap County Ord No. 403-2007) that promote contiguous and orderly development and establish provisions for urban services to such development, as well as policies for siting public capital facilities of county- wide or statewide nature, affordable housing, joint county and city Urban Growth Area (UGA) planning, economic development and employment, and participation with local tribes. C. Planning is an iterative process; therefore, it is appropriate that the County-wide Planning Policies should be reviewed and assessed through the KRCC at least every five years, with revisions, if necessary consistent with the State Growth Management Act, Ch. 36.70A RCW. Section 2: General Procedural Findings. The Kitsap County Board of Commissioners makes the following findings regarding the process and public participation aspects of amending the County- wide Planning Policies: A. The Kitsap County Regional Coordinating Council (KRCC) is an organization consisting of elected officials from Kitsap County, the four Kitsap County cities, Bainbridge Island, Bremerton, Poulsbo and Port Orchard, as well as the Suquamish and Port Gamble S'Kiallam Tribes. One of the functions of the KRCC is to coordinate land use planning throughout Kitsap County. B. Beginning in 2010, the Kitsap Regional Coordinating Council began an update process for the Countywide Planning Policies to make them consistent with the adopted Puget Sound Regional Council's multicounty planning policies. C. In January, 2011, the Kitsap Regional Coordinating Council held a public hearing on the proposed Countywide Planning Policies. In May, 2011, the Kitsap Regional Coordinating Council forwarded the proposed Countywide Planning Policies to Kitsap County to begin the County's legislative process. E. In July, 2011, a State Environmental Protection Act (SEPA) programmatic checklist was completed and submitted to the County's SEPA official. F. On July 22, 2011, the SEPA official issued a Determination of Nonsignificance. A fourteen day appeal period was opened. No appeals were submitted by the requisite date of August 5, 2011. G. On September 12, 2011, the Board of Commissioners held a hearing to consider the proposed revision to the countywide planning policies. H. Pursuant to Appendix A of the CPPs, Ratification Process, the Cities of Bremerton, Bainbridge Island, Port Orchard and Poulsbo, and the Suquamish and S'Kiallam Tribal Councils must meet within 90 days of the date of adoption of this ordinance to adopt or suggest amendments to the amended CPPs. Section 3: The Kitsap County Board of County Commissioners finds that the following proposed revision to the CPPs are appropriate and should be adopted. These changes are summarized as follows and set forth in Attachment A, which is incorporated by reference herein: A. Changes 1. Introduction: Inserts the goals of the Growth Management Act, identifies Vision 2040 as the long term strategy document for the Puget Sound region. 2. Element A. Countywide Growth Pattern: Revises Kitsap County's vision statement to enhance and acknowledge various components such as bike/pedestrian friendly; preservation of historic areas, references Kitsap 20/20 as the strategy for a viable economic future; expands areas for natural systems protections; and includes local food production and distribution as part of the rural character. Revised policies direct growth to urban areas, define the vision of high quality communities, and add additional roles for member jurisdictions. Element B: Urban Growth Areas: Resolution No. 042-11 Exhibit A Inserts Vision 2040 to be used in the population forecasting, recognizes that the County's ability to provide urban levels of service must be consistent with its ability and appropriateness, and establishes more stringent requirements for the creation of fully contained communities in Kitsap County. 4. Element C: Centers of Growth: Removes specificity of centers locations, establishes policy that allows for the future designation of Center status, and provides information regarding living wage and its calculation. 5. Element D: Rural Land Uses and Development Patterns: Strengthens language regarding support to local agricultural; adds eco-and heritage-tourism as a rural use; states rural services should be consistent with the character, nature and long term use of the land; and, adds in ecological functions and cultural resources for consideration when development of future Comprehensive Plans. 6. Element E: Countywide Strategies for Open Space Preservation, Resource Preservation, Critical Areas, Air Quality, and Water Quality/Quantity: Inserts air quality and water quality/quantity into the Element title; and, establishes policies for jurisdictions to follow when developing future Comprehensive plans to include these elements in such plans. 7. Element F: Contiguous, Compatible, and Orderly Development: Inserts Compatible into Element Title; expands inter-regional coordination efforts to include environmental and infrastructure planning: and establishes policies and strategies jurisdictions should use for community design and development. 8. Element G: Siting Public Capital Facilities: Establishes a policy that those capital facilities providing primary service to urban residents should be located within urban areas where feasible. 9. Element H. Transportation: Establishes policy that jurisdictions shall develop standards for Countywide Planning Policies Ordinance-Ame8dment Revised 11/8/2011 Resolution No. 042-11 Exhibit A "Complete Streets" consistent with state law; adds low impact development to be used for storm water and surface run-off; adds the need to reduce greenhouse gases; and, adds multi-modal solutions to be considered in developing level of service standards. 10. Element I. Housing: Expands the introductory section to include jobs-housing balance, best practices in housing, and enhances the definition of affordable housing; clarifies affordable housing policies for jurisdictional use; and, eliminates the use of the term "below market rate." 11. Element J. Countywide Economic Development: Establishes policies that defines a healthy economy as one provides a full spectrum of jobs; seeks diversification while recognizing the role of the Department of Defense in the local economy; partner in economic strategies with the Puget Sound Regional Council economic initiatives and Kitsap Economic Development Alliance; and, look for strategies to buy local. 12. Element M. Coordination with Federal Government including Navy: Recognizes the importance of military installations to the region and state and inserts Revised Code of Washington citation regarding notification on projects and other matters of interest to the military. 13. Element N. Roles and Responsibilities: Adds requirement for jurisdictions to coordinate with County Department of Emergency Management to ensure system integrity and to insure the integrity of National Incident Management system for coordinated response. 14.Appendix D: lnterlocal Agreement Between Kitsap County and the City of Bainbridge Island, City of Bremerton, City of Port Orchard and City of Poulsbo Concerning Revenue Sharing Upon Annexation and In Conjunction With Major Land Use Decisions Within a City's Urban Growth Area: Notes that City of Port Orchard and City of Bremerton have withdrawn from this agreement. All other provisions in the CPPs, as adopted by Kitsap County Ordinance 403-2007 remain unchanged. D. House Bill 1478 extended the deadline for County and City Comprehensive Plan Updates to 2016. Given that a new set of population numbers will be published by the Office of Financial Management in April 2013 and the 2010 Census data is current, the Board recommends that the Kitsap Regional Coordinating Council begin population allocation discussions in 2013 with a projected completion date no later than December, 2014 so that jurisdictions may utilize the allocations in their 2016 updates. Section 4. Effective Date. This ordinance shall tal(e effect upon the earliest date that it is ratified by at least three cities within the County. Severability.
