017-13 - Resolution - Delcaring Real Property as SurplusRESOLUTION NO. 017-13 Introduced. by: City Attorney Requested by: City Council Drafted by: City Attorney Introduced: July 9, 2013 Public Hearing: July 9, 2013 Adopted: July 9, 2013 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, DECLARING A PORTION OF THE CITY- OWNED REAL PROPERTY ADJACENT TO 1011 BETHEL AVENUE AS SURPLUS AND AUTHORIZING A PROCEDURE FORITSSALE WHEREAS, the City owns approximately 17,000 square feet of real property (the "City Property") located between the Hi Joy Bowl building at 1011 Bethel Avenue and the roundabout at Bethel Avenue and Mile Hill Drive; and WHEREAS, the City Property is now leased to Hi Joy Bowl for use as a parking lot for Hi Joy's customers; and WHEREAS, although the northernmost strip of the City Property consisting of approximately 3,000 square feet, as shown in the aerial photograph attached as Exhibit A, may be required for future right-of-way needs, the City Council finds that the balance of the City Property, referred to as parcels B, D, E, and Fin the diagram attached as Exhibit B (the "Surplus Property"), is surplus to the City's needs and should be sold; and WHEREAS, given the relatively small size, unusual shape, and the location of the Surplus Property, the City Council finds the City will receive the highest return by offering the Surplus Property for sale to the adjacent property owner TTMJ LLC, a Washington limited liability company, which is the owner of the real property occupied by the Hi Joy Bowl; now, therefore; THE CITY COUNCIL OF THE CI'IY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: The City-owned property referred to as parcels B, D, E, and F in the diagram attached as Exhibit B, is hereby declared to be surplus to the City's needs. FURTHER THAT: The City shall negotiate the sale of the Surplus Property to TTMJ LLC, a Washington limited liability company, which is the owner of the real property occupied by the Hi Joy Bowl at a price that is equal to or greater than the appraised value of the Surplus Property.
