A RESOLUTION OF THE CI1Y OF PORT ORCHARD,
WASHINGTON REPEALING RESOLUTION NO. 022-06 AND
ESTABLISHING FEE SCHEDULES FOR THE DEPARTMENTS
OF COMMUNI1Y DEVELOPMENT AND PUBLIC WORKS
WHEREAS, the City of Port Orchard is responsible for implementing land use
regulations, planning and public works requirements, administering the building code, and
other administrative duties; and
WHEREAS, there are costs associated with the implementation of city
regulations and policies; and
WHEREAS, in 1999, the City of Port Orchard adopted Ordinance No. 1781
providing that fees for the Departments of Planning (aka Community Development) and Public
Works would be established by Council resolution; and
WHEREAS, the City's current Planning and Public Works Department
administrative fees were adopted in July 2006 as set forth in Resolution No. 022-06 ; and
WHEREAS, the city's permitting system is in need of upgrade and is expected to
cost the city approximately $6s,ooo over the next four years; and
WHEREAS, the city is proposing a $10 technology fee surcharge to be added to
all permits as part of this proposed fee increase to fund a portion of the costs associated with
upgrading the city's permitting system; and
WHEREAS, a technology fee surcharge is allowable under RCW 82.02.020(3);
and
WHEREAS, the City Council will review the Departments of Community
Development and Public Works' technology costs and technology fee revenue periodically to
ensure that the fee is still necessary to fund the upgrade to the city's permitting system; and
WHEREAS, the City Council deems it in the best interest of the City of Port
Orchard to periodically review and update the City's administrative fees; now, therefore,
THE CITY COUNCIL OF THE CI1Y OF PORT ORCHARD,
WASHINGTON HEREBY RESOLVES AS FOLLOWS:
1. Resolution No. 022-06 is hereby repealed in its entirety.
2. The fees that will be charged by the Community Development and Public
Works Departments for the specified services are listed in Exhibit ".A:'.

3. Fees not listed in Exhibit "A:' will be determined by the City Council.
4· The fees listed in Exhibit "A" shall take effect on May 1, 2014.

A. General
1. No permit shall be issued, application accepted, service provided, or appeal filed without
payment of the applicable fee set forth below.
2. References to the director refer to the director of the Department of Community Development
or his/her designee.
3. In the event that a project permit application with a stated fee requires processing that the
director considers to be extraordinary, the applicant shall be responsible for those additional
costs. The applicant shall be notified in writing ofthe necessity for extraordinary review and will
be provided the estimated cost of the review prior to further action being taken on the permit
application.
4. The fees set forth below are additive as multiple permits and reviews may be required for a
particular project.
5. Each building, plumbing, mechanical, planning and land use, and public works
permit/department review fee shall be assessed a technology fee surcharge of $10.00 to help
support the city's cost of providing permitting systems and technology to support the permitting
process.
6. An approved or issued permit or other type of approval may be revoked for non-payment of
fees.
7. No additional inspections, including final inspections, will be scheduled or performed until all
outstanding fees are paid.
8. Any outstanding fees or portions of fees shall be added to the required fees(s) of any future plan
review or permit prior to application acceptance or permit issuance.
9. In the event the applicable fee is not paid, the city reserves all its legal and equitable rights to
seek payment of the unpaid fee, together with interest at the rate of one percent per month
and its attorney fees and costs.
B. Building, Plumbing, and Mechanical Fee Policies
1. Failure to pay established fees may result in one or more of the following:
• Per Section 109.4 of the IBC, any person who commences any work on a building,
structure, electrical, gas, mechanical or plumbing system before obtaining the necessary
permits shall be subject to an additional fee equal to the required permit cost in
addition to the underlying permit costs.
• No temporary or final certificate of occupancy will be approved or issued for a project
with any outstanding fees on any permit associated with the project. Exceptions may be
authorized by the building official or director only.
2. Issued permits shall expire 180 days from the date of issuance or most recently passed
inspection if the project has commenced, unless an extension is granted per IBC 105.5.
3. Refunds may be authorized by the building official or director. Refunds shall be issued at an
amount equal to the permit fee less actual time and materials spent on the project; provided no
refund shall exceed 80% ofthe initial permit fee. The hourly rate to be used to calculate a
refund value shall be $75 per hour. Plan check fees are non refundable once plan review has
been completed.
4. Some signs require a building permit in addition to a land use (sign) permit. In these instances,
the permit fees are additive meaning that an applicant may be required to obtain a sign permit
and a building permit.
5. Residential reroofing projects under 2100 square feet shall not require a permit.
6. Additional building plan review shall be billed at $75 per hour with a minimum of 1 hour billed
when changes to approved plans are requested.
7. Valuation for Table 1 shall be determined using the February 2010 IBC Building Valuation Table
attached hereto except when otherwise noted in Tables 2 and 3.

Important Points
• The BVD is not intended to apply to alterations or repairs to existing buildings. Because the scope of alterations or
repairs to an existing building varies so greatly, the Square Foot Construction Costs table does not reflect accurate values
for that purpose. However, the Square Foot Construction Costs table can be used to determine the cost of an addition
that is basically a stand-alone building which happens to be attached to an existing building. In the case of such additions,
the only alterations to the existing building would involve the attachment of the addition to the existing building and the
openings between the addition and the existing building.
• The Square Foot Construction Cost does not include the price of the land on which the building is built. The Square Foot
Construction Cost takes into account everything from foundation work to the roof structure and coverings but does not
include the price of the land. The cost of the land does not affect the cost of related code enforcement activities and is not
included in the Square Foot Construction Cost.
