A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
FORMALLY DECLARING THE EXISTENCE OF AN EMERGENCY
RELATING TO THE REPAIR OF THE POTTERY SEWERAGE LIFT
STATION AND AUTHORIZING APPLICATION FOR EMERGENCY
FUNDING.
WHEREAS, in late May 2O21, the City's Public Works Department identified an issue
with the Pottery Sewerage Lift Station due to Hydrogen Sulfide exposure on the internal piping
of the facility; and
WHEREAS, the City issued a request for bids for repair of the piping with a response
date of late June 202L; and
WHEREAS on June 21, 202L, a follow-up inspection of the Pottery Sewerage Lift Station
revealed that the issue was emergent due to rapid Hydrogen Sulfide exposure to both the
internal piping and wet well vault interior walls and associated corrosion-based disintegration,
which poses a real and imminent threat of a pipe failure and overflow of the pump station that
will release into an adjacent school, housing complex, adult family home and critical areas; and
WHEREAS, the City Public Works Director and City Engineer notified the Mayor of the
emergency condition and recommended immediate emergency repairs; and
WHEREAS, the described failures involve unforeseen circumstances beyond the City's
control which presented a real and imminent threat to the proper performance of essential
functions and was likely to result in a material loss or damage to property if immediate action
was not taken, the City Council hereby formally declares an emergency necessitating repairs,
and waives the competitive bidding requirements pursuant to Port Orchard Municipal Code
Chapter 2.80 and RCW 39.04.280(lXe); now, therefore
THE CITY COUNCTL OF THE CITY OF PORT ORCHARD, WASHTNGTON, HEREBY RESOLVES
AS FOLLOWS:
THAT: lt is the intent of the Port Orchard City Councilthat the recitals set forth above
are hereby adopted and incorporated as findings in support of this Resolution.
THAT: The City Council declares that the repairs to the Pottery Sewerage Lift Station
constitute an emergency as defined in RCW 39.04.280 because existing damage
presents a real, immediate threat to public safety and property.
