AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON AMENDING ORDINANCE NO. 1566 AND PORT
ORCHARD MUNICIPAL CODE 2.20.010 "PLANNING
COMMISSION CREATED" BY ESTABLISHING FOUR-YEARTERM
LIMITS FOR PLANNING COMMISSION MEMBERS
WHEREAS, in 2010, the City hired the lobbying firm of Gordon Thomas Honeywell to
assist the City with its legislative priorities; and
WHEREAS, on December 14, 2010, the Council approved the contract with Gordon
Thomas Honeywell and determined its priorities for the 2011-12 legislative session; and
WHEREAS, the Mayor and lobbyist worked together with State Representative Jan
Angel on the legislative priorities, in which the request to amend RCW 35.63 changing planning
commissioner member term limits from six years to four years was a City priority; and
WHEREAS, the Mayor, lobbyist, and State Representative Angel were successful during
the 2011 legislative session in amending the term limits for planning commissioners in second
class cities; and Governor Gregoire signed the bill into law on April 14, 2011; and
WHEREAS, the Council desires to amend Port Orchard Municipal Code to set the term
limits for planning commissioners to four (4) years as set forth in RCW 35.63; and
WHEREAS, the Council further desires that the amendment to planning commissioner
terms of office be effective as each current planning commission position reaches the end of its
current six year term limits, at which time the seat will become a four year term thereafter; now,
therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION 1. Port Orchard Municipal Code, Section 2.20.010 Planning commission
created, is hereby amended to read as follows:
(1) Pursuant to Chapter 35.63 RCW, there is created a city planning commission,
which shall consist of eight members appointed by the mayor and confirmed by the city
council; seven shall be residents of the city and one may be a nonresident of the city

except the mayor and city council may, by council resolution, temporarily extend the
term of commissioner who, during his or her term, moves out of the city to provide for
continuity of specific projects or planning processes.
(2) Planning commissioner terms shall be four years in length.
SECTION 2. The above amendment, as set -forth in Section i, shall not be effective as to
the current terms of the City's Planning Commission, but shall be applied as each term expires.
Accordingly, for the seats occupied by the following Commission Members the effect of this
Amendment will occur as follows:
