AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING PORT ORCHARD MUNICIPAL CODE CHAPTER 13.04
"WATER AND SEWERS" BY INCREASING WATER RATES EFFECTIVE
JANUARY 1, 2oi2
WHEREAS, the City of Port Orchard provides water service to approximately 3,156
accounts, of which 89% are single family residences; and
WHEREAS, the City last increased water rates in 2oo8; and
WHEREAS, the City retained a consultant to evaluate its current water rates and
determine whether the rates are sufficient to fund the City's water system, including ongoing
operations, maintenance, and the capital improvements set forth in the City's six year Capital
Improvement Plan that is part of the City's Comprehensive Water System Plan; and
WHEREAS, based on the consultant's evaluation and the analysis of City staff, it is
recommended that the current water rates be increased in order to meet the Washington State
Department of Health's financial viability test for the water system and to maintain an operating
budget that demonstrates sufficient revenues to meet future expenses; and
WHEREAS, the City Council desires that water rate increases should be kept to
reasonable levels and should be structured to promote conservation; and
WHEREAS, the City Council held public hearings on July 26 and August 9, 2011 to
receive public comment regarding the proposed water rate increases; and
WHEREAS, in consideration of the public comment, the City Council has decided to
phase the water rate increase over a four-year period; and
WHEREAS, the adoption of this ordinance increasing water rates is consistent with the
City's Comprehensive Water System Plan, the City's Comprehensive Plan, and the Growth
Management Act; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION i. Effective Date. Section 2 below shall be effective January r, 2012.

SECTION 2. Port Orchard Municipal Code Section 13.04.010 is hereby amended to
read as follows:
13.04.oio Bimonthly water rates.
Water rates are billed on a bimonthly schedule and are a function of size of
service plus consumption.
(1) Effective January 1, 2012, the water rates, as calculated bimonthly, are
shown below:
(a) Single Connections. Single Connections are where one customer is
being served through a master meter and the billing is based on the flow through
such master meter. Consumption charges for water usage in excess of 5,000
gallons are set forth below in subsection (c).

(d) Multiple Connections. Multiple connections are where more than one
customer is being served through a master meter and the billing is based on the
flow through such master meter. The minimum bimonthly base rate is
determined by the number of customers multiplied by a base rate of $30.50 plus
the difference in cost between 3/4" service and the actual meter size. The
consumption charge will be computed by subtracting the amount equal to the
number of customers multiplied by 5,000 gallons from the total gallons
consumed. The rate of the consumption above 5,000 gallons will be $2.10 per
1,00o gallons up to 30,000 gallons, $2.20 per 1,00o gallons from 30,001 to
50,000 gallons, $2.30 per 1,00o gallons from 50,001 to 100,00o gallons, $2.40
per 1,00o gallons from 1oo,00r to 150,000 gallons and $2.50 per 1,00o gallons
in excess of 150,000 gallons.
(e) Properties Outside City Limits. Properties served outside the city
limits shall have a 50 percent surcharge on the monthly rate.
(f) Fire Hydrant Service.
Schools $12.00 per hydrant
Private Service $22.00 per hydrant
(g) Temporary Construction.

$250 plus sales tax for each 3o day period; in excess of r8o days, $500 plus sales
tax for each 3o day period.

SECTION S. Savings Clause. The water rates currently set forth in Port Orchard
Municipal Code Section 13.040.010 shall remain in full force and effect through December 31,
2011.
SECTION a. If any section, sentence, clause or phrase of this ordinance should be held
to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or

unconstitutionality shall not affect the validity of constitutionality of any other section, sentence,
clause or phrase of this ordinance.
SECTION 5. This ordinance shall be in full force and effect five (5) days after posting
and publication as required by law. A summary of this Ordinance may be published in lieu of
the entire ordinance, as authorized by State Law
