AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING THE CAPITAL FACILITIES ELEMENT OF THE 2008
COMPREHENSIVE PLAN CONCURRENT WITH THE ADOPTION OF
THE 2o11 BUDGET
WHEREAS, on June 12, 1995 the City Council by Ordinance No.1634 adopted the
City's initial 20 Year Comprehensive Plan; and
WHEREAS, on December 9, 2oo8 the City Council by Ordinance No. 042-o8,
adopted the City's 10-Year Update to the 20 Year Comprehensive Plan (the 20o8
Comprehensive Plan) and has adopted annual amendments each year thereafter; and
WHEREAS, RCW 36.7oA.120 provides that jurisdictions required to plan under.
the Growth Management Act, are also required to make sure that decisions on capital
budget expenditures comply with the Comprehensive Plan; and
WHEREAS, the City Council, in the process of finalizing and adopting the 2011
Budget for the City, has found additional capital facilities projects scheduled for 2oli that
were not identified in the existing six -year capital improvement program; and
WHEREAS, RCW 36.7oA.130(2)(a) permits jurisdictions to update the Capital
Facilities Element of the Comprehensive Plan when done in coordination with the annual
budget cycle; and
WHEREAS, on December 14th, 2010 the City Council by Ordinance No. 027-10
adopted the 2011 Budget and intends to amend the Capital Facilities Element of the 2008
Comprehensive Plan as part of that budget cycle in order to allow for the expenditure of City
funds for certain capital improvement projects; and
WHEREAS, after proper noticing, the City Council held a public hearing on March
8th, 2011 to take testimony from the public regarding the proposed update to the Capital
Facilities Element of the 2008 Comprehensive Plan; and
WHEREAS, all comments and documents received from the public, staff, and other
entities, have been incorporated into the public record and considered by the City Council in
determining what action, if any, should be taken; and
WHEREAS, the City Council finds the proposed amendments are consistent with
Ordinance No. 003-11

the 2011 Budget, the 2oo8 Comprehensive Plan, and the goals and policies of the Growth
Management Act; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
SECTION 1. The Capital Facilities Element of the 2oo8 Comprehensive
Plan, is hereby amended by adding a new Appendix F entitled Capital Improvement
Program 2011 — 2016, which identifies existing and future project needs for maintenance,
repair, and construction of Capital Facilities projects within the City for the 2011 — 2o16
period, a copy of which is attached hereto as Exhibit A and incorporated by this reference.
SECTION 2. Each and every provision of this Ordinance shall be deemed
severable. In the event that any portion of this Ordinance is determined by final order of a
court of competent jurisdiction to be void or unenforceable, such determination shall not
affect the validity of the remaining provisions thereof provided the intent of this Ordinance
can still be furthered without the invalid provision.
SECTIONS. This ordinance shall be in full force and effect five (5) days after
posting and publication as required by law. A summary of this Ordinance may be published
in lieu of the entire ordinance, as authorized by State Law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor
and attested by the Clerk in authentication of such passage this 8th day of March 2011.
