AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING SECTION 1-0.12.110 OF THE PORT ORCHARD MUNICIPAL
CODE RELATING TO VIOLATION OF PARKING IN SPACE FOR
INDIVIDUALS WITH DISABILITIES TO REFLECT AMENDMENTS BY
THE LEGISLATURE.
WHEREAS, the Washington State Legislature recodified the disabled parking statutes,
Chapter 171, 2011 Laws (SB 5o61) effective Juy 1, 2011; and
WHEREAS, the Washington State Legislature enacted legislation to promote accessible
communities for persons with disabilities, Chapter 215, 2olo Laws (ESSB 5902) effective June lo,
2010;
WHEREAS, the City of Port Orchard desires to be able to enforce these regulations in Port
Orchard Municipal Court in accordance with the changes made by the Legislature;
now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION i. The Port Orchard Municipal Code Section 10.12.110 is amended to read as
follows:
10.12.11.0 Violation of parking in space for individuals with disabilities parking
permit.
It is a parking infraction, with a monetary penalty as provided for in RCW 46.19.050(4), as
amended, for any persons to park a vehicle in a parking place provided on private property
without charge or on public property reserved for persons with physical disabilities without a
special license plate or placard issued pursuant to RCW 46.19.050 or 46.19.070 or RCW
46.19. If a person is charged with a violation, the person shall not be determined to have
committed an infraction if the person produces in court or before the court appearance the
special license plate or placard required under this section. In addition to any penalty or fine
imposed under RCW 46.19, two hundred dollars shall be assessed.

SECTION 2. Severability. If any section, subsection, paragraph, sentence, clause, or phrase
of this ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect
the validity of the remaining parts of this ordinance.
SECTION 3. This ordinance shall be in full force and effect five (5) days after posting and
publication as required by law. A summary of this Ordinance may be published in lieu of the entire
ordinance, as authorized by State Law.
