009-10 - Ordinance - Amending Chapter 13.04.200 Low Flow Toilet RebateIntroduced by: Public Works Director Requested by: Public Works Director Drafted by: Public Works Director Introduced: May 11, 2010 Adopted: May 11, 2010 ORDINANCE NO. oo9-io AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING PORT ORCHARD MUNICIPAL CODE CHAPTER 13.04.2oo BY ADDING MULTI -FAMILY RESIDENTIAL TO THE LOW FLOW TOILET REBATE PROGRAM WHEREAS, in 2003 the Washington State Legislature passed House Bill 1338, known as the Municipal Water Law (MWL), to address increasing demands on our State's water resources; and WHEREAS, the Department of Health (DOH) was directed to oversee and enforce the Water Use Efficiency Program (WUE) to help support the goal of ensuring a safe and reliable drinking water supply; and WHEREAS, the Water Use Efficiency Program became effective on January 22, 2007 and requires that the State's municipal water suppliers complete goal setting one year from the effective date with the WUE goals being in effect for a six -year period; and WHEREAS, a low flow toilet rebate program was adopted by the City of Port Orchard on July 14, 2009 under Ordinance No. o18-og and is consistent with the City's Water Use Efficiency Program and serves to promote the City's water conservation goals; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Port Orchard Municipal Code section 13.04.200 is hereby amended to read as follows: 13.04.2oo Low flow toilet rebate. A cash rebate shall be paid to the owners of single-family or multi -family residences for the installation of a 1.6 gallon low flow toilet replacing a standard toilet when the following conditions are present: (r) The homeowner has submitted an application for rebate on a form designated by the City; and Ordinance No.00g-ro Paze 2 of 2 (2) The installation address has an active water account in good standing with the City. (3) Multi -family rebates to be limited to the first 25o applications received in a calendar year. SECTION 2. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance maybe published in lieu of the entire ordinance, as authorized by State Law.
