010-10 - Ordinance - Imposing Moratorium for Process Applications for Billboard and Outdoor Advertising Structure PermitsIntroduced by: Development Director Requested by: Development Director Drafted by: Development Director Introduced: May 25, 2010 Adopted: May 25, 2010 ORDINANCE NO. wo-io AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON IMPOSING A MORATORIUM ON ACCEPTING OR PROCESSING APPLICATIONS FOR BILLBOARD AND/OR OUTDOOR ADVERTISING STRUCTURE PERMITS WHEREAS, the City Council finds that the control of billboards and outdoor advertising structures in areas adjacent to state highways promotes public health, safety, welfare, convenience and enjoyment of public travel; and WHEREAS, the City Council finds that the control of billboards and outdoor advertising structures in areas adjacent to highways promotes tourism by conserving the natural beauty of areas adjacent to the interstate system; and WHEREAS, the City Council finds that its current regulations which govern billboards and outdoor advertising structures may be inconsistent with the above findings; and WHEREAS, a moratorium is necessary to enable the City to review its ordinances which control billboards and outdoor advertising structures, and to determine if said ordinances should be amended; and WHEREAS, the immediate enactment of a moratorium on the processing and submittal of applications for "billboards" or "outdoor advertising structures" under Chapter 16.65 POMC is necessary to protect imminent threats to public health, safety or welfare and is a legitimate exercise of the City's police power; and WHEREAS, the City Council adopts the foregoing as its findings of fact justifying adoption of this ordinance; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. A moratorium is hereby imposed upon accepting or processing any applications for permits for "billboards" or `outdoor advertising structures" under Ordinance No. olo-ro Page 2 of 2 Chapter 16.65 POMC, unless the application was fully vested under Washington's vested rights doctrine, prior to the adoption of this ordinance. SECTION 2. As used in this ordinance, "billboard" and/or "outdoor advertising structure" shall have the same meaning as that term is defined in POMC 16.o8.528. SECTION 3. This moratorium shall remain in effect until November 21, 2010, unless earlier terminated. SECTION d. Pursuant to RCW 35.63.2oo a public hearing shall be held on the moratorium at 7: oo P.M. on June 22, 2oio at the Port Orchard City Hall, 216 Prospect Street, Port Orchard, Washington. SECTION 5. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of constitutionality of any other section, sentence, clause or phrase of this ordinance. SECTION 6. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
