ORDINANCE NO. 032-09
AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, PROVIDING FOR THE TRANSFER OF CAPITAL
ASSETS AND EQUIPMENT FROM THE STREET FUND TO THE
STORM DRAINAGE UTILITY FUND
WHEREAS, the City of Port Orchard formed a Storm Drainage Utility in order to
operate a storm water management program, and the City acting previously through the
Street Fund provided similar acts and services, and the General Operating Fund has
provided contributions and other support to the Street Fund for this purpose; and
WHEREAS, the Storm Drainage Utility became responsible for the protection of
public health, safety and welfare previously provided by services of the Street Fund; and
General Operating Funds were used to purchase equipment and facilities to mitigate storm
water runoff, sedimentation impact to creeks, streams, and sound; and the City Council
acting upon its authority provided General Operating Funds to the Street Fund for these
purposes; and
WHEREAS, General Operating Fund revenues of the City may be used at the
discretion of the City Council to provide for the general welfare of the City; and equipment
and capital facilities purchased by such funds may be transferred at the discretion of the
City Council when deemed appropriate for the general welfare of the City; and the amount
of Street Fund contributions have exceeded the value of the equipment and facilities being
transferred; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DO ORDAIN AS FOLLOWS:
SECTION i. The following equipment and capital assets are transferred from the
Street Fund to the Storm Drainage Utility Fund: i) equipment consisting of 200o Broom
Bear Sweeper Model FL24H, VIN #iFVABTAK51HG76857; and 2) facilities consisting of
water quality/quantity systems including but not limited to storm water culverts, closed
conveyance, drains, catch basins & ditches.
SECTION 2. This ordinance shall be in full force and effect five (5) days after
posting and publication as required by law. A summary of this Ordinance maybe published
in lieu of the entire ordinance, as authorized by State Law.
