FACILITIES
WHEREAS, on December 28, 1998, the city council in Ordinance No. 1748,
adopted the City of Port Orchard Zoning Ordinance; and
WHEREAS, the City Council highly values the economic development of the
City and wishes to support citizen's efforts toward opening new businesses within the City;
and
WHEREAS, on April 16, 2007, the Planning Commission held a public
meeting to consider possible changes to the zoning code, Section C3, and to the Port
Orchard Municipal Code Chapter 10.14; and
WHEREAS, the Planning Commission has recommended to the City Council
that it adopt changes to the Zoning Code and POMC Chapter 10.14 to revise the parking
standards for Bed and Breakfast facilities;
WHEREAS, a programmatic SEPA determination of non -significance was
issued on November 1, 2006; and
WHEREAS, following a public hearing on April 23, 2007, the City Council has
determined that the parking requirements for Bed and Breakfast facilities as contained
within the City's Zoning Ordinance need to be more flexible to accommodate the specific
circumstances of each site; and
WHEREAS, the City Council has determined it to be in the public interest to
revise the City's parking standards for Bed and Breakfast facilities to reduce the minimum
parking stall requirement to 1 parking stall per approved bedroom and to allow for on-

street parking through use of the City's parking permit system; and
WHEREAS, while the City Council agrees generally with the Planning
Commission's specific recommendations, it finds that on -street parking should be limited to
three (3) parking permits per facility and that on -street parking should only be allowed
when on -site parking is not feasible; and
WHEREAS, the proposed amendment will promote, rather than detract,
from the public health, safety morals and general welfare; and
WHEREAS, the proposed amendment is consistent with goals and policies of
the Port Orchard Comprehensive Plan, as amended; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION 1.Ordinance No. 1748, Part C3 Parking and vehicular circulation:
"Section 2: Authority and application." is hereby amended to read as follows:
Authority and application
a: Before an occupancy permit may be granted for any new or enlarged
building or to a change to a different use in any existing building that
involves additional parking, the use shall be required to meet the
provisions of this chapter.
b: If this chapter does not specify a parking requirement for a land use, the
City Engineer shall establish the minimum requirement based on a study
of anticipated parking demand. In the study, the applicant shall provide
sufficient information to demonstrate that the parking demand for a
specific land use will be satisfied. Parking studies by individuals with
expertise in traffic and parking analysis may be required, by the City
Engineer.
c: If the required amount of off street parking has been proposed to be
provided off site, the applicant shall provide written contracts with affected
landowners showing that required off street parking shall be provided in a
manner consistent with the provisions of this chapter. The contracts shall
be reviewed by the City Engineer for compliance with this chapter, and if
approved, the contracts shall be recorded with the Kitsap County Auditor
as a deed restriction on the title to all applicable properties. These deed
restrictions may not be revoked or modified without authorization by the
Ordinance No 011-07

City Engineer or Planning Commission.
d: Development along both sides of Bay Street from the crosswalk at
Harrison Avenue to Orchard Avenue is exempt from the parking
requirements of this chapter.
e: In lieu of on -site parking, Bed and Breakfast Facilities may obtain an on -
street -parking permit to satisfy the facility's minimum parking
requirements as follows:
1) Applicant for any on -street parking permit complies with the
provisions of POMC Chapter 10.14.
2) No more than three (3) on -street parking permits are issued per
facility.
3) For each on -street parking permit requested, applicant establishes
to the satisfaction of the City Planning Director that on -site
parking is not feasible.
4) Applicant satisfies all other requirements for Bed and Breakfast
facilities as required by City Code or Ordinance.
SECTION 2. Ordinance No. 1748, Part C3 Parking and vehicular circulation:
minimum parking standards table, is hereby amended as set forth in Exhibit A attached
hereto and by reference incorporated herein.
SECTION 3. Port Orchard Municipal Code Section 10.14.020 is hereby
amended to read as follows:
10.14.020 Definitions.
(1) "Community event permit" means a one -day permit validated and
issued by the city for participants of a public community event held
in a residential neighborhood, such as a civic, church or school
meeting or conference.
(2) "Commuter vehicle" means a licensed vehicle parked in a
residential area which is not owned or leased by a resident of that
residential area. Vehicles that weigh 10,000 pounds or more are
not considered commuter vehicles for the purpose of this chapter.
(3) "Guest permit" means a 14-day permit validated and issued by the
city for the vehicle of a person visiting a resident who is eligible for

a residential parking permit.
(4) "Residential area" means an area contiguous to public right-of-way
which is zoned residential R-4.5, R-8, R-12, or R-20.
(5) 'Residential parking permit" means the parking permit validated
and issued by the city allowing a resident to park within one block
of their residence with privileges as specified in this chapter.
(6) `Residential vehicle" means a licensed vehicle parked in a residential
area which is owned or leased by a resident of that residential area.
The term shall not include commercial vehicles, boats, trailers, or
recreational vehicles.
(7) `Bed and Breakfast parking permit" means a parking permit issued by
the city to accommodate on -street parking for registered guests of
permitted Bed and Breakfast facilities, as defined by the City Zoning
Code.
SECTION 4. Port Orchard Municipal Code Section 10.14.040 is hereby
amended to read as follows:
10.14.040 Other parking permits.
The city clerk or designee is authorized to issue the following permits:
(1) Guest parking permits shall be available for vehicles of guests of
persons residing in a residential permit parking area. The vehicle must
be owned or leased by the guest and licensed and operable. Guest
parking permits shall not be issued for commercial vehicles, boats or
trailers. This permit shall be valid for a 14-day period. There shall be
no fee for a guest parking permit.
(2) Temporary parking per shall be available for cars, pick up trucks,
or similar vehicles. Boats, boat trailers, and recreational vehicles that
are being loaded or unloaded maybe issued a temporary parking
pass. A temporary parking pass is restricted to a specific site; is valid
only for a 24-hour period; and will allow the vehicle to park in excess
of the time limits posted on the street. No vehicle can be issued more
than two temporary parking passes in a seven -consecutive -day
period, and not more than four in a 30-day period.

(3) Subject to the provisions of the City's parking requirements as
contained in the City's Zoning Code, up to three Bed and Breakfast
parking permits shall be available for vehicles of registered guests of
Bed and Breakfast Facility during their stay. The permit shall only be
valid for on -street parking within 2 blocks of the Bed and Breakfast
facility. The vehicle must be owned or leased by the guest and
licensed and operable. Bed and Breakfast parking permits shall not be
issued for commercial vehicles, boats, trailers or recreational vehicles.
Bed and Breakfast parking permits must be displayed prominently in
a window of the vehicle.
SECTION 4. This ordinance shall be in full force and effect five (5) days
after posting and publication as required by law. A summary of this Ordinance may be
published in lieu of the entire ordinance, as authorized by State Law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the
Mayor and attested by the Clerk in authentication of such passage this 14th day of May
