ADOPTING THE 2006 EDITION OF THE UNIFORM PLUMBING CODE
AND UNIFORM PLUMBING CODE STANDARDS AS ADOPTED BY THE
STATE BUILDING CODE COUNCIL AND AMENDING PORT ORCHARD
MUNICIPAL CODE SECTION 15.08.010.
WHEREAS, the Washington State Building Code Council (Code Council)
periodically adopts and amends uniform codes of statewide applicability, collectively
referred to as the state building code; and
WHEREAS, on November 17, 2006, the Code Council voted to adopt the 2006
Edition of the Uniform Plumbing Code and Uniform Plumbing Code Standards and the
effective date of the 2006 Edition of the code is July 1, 2007; and
WHEREAS, RCW 35.21.180 grants authority to cities to adopt statutes and codes
by reference; and
WHEREAS, RCW 19.27.031 provides that the state building code shall be in effect
in all counties and cities; and
WHEREAS, the City Council finds that the public health, safety, and welfare will
be served by keeping current with the most current edition of the state building code.
Now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS
FOLLOWS:
SECTION 1. Port Orchard Municipal Code Section 15.08.010, Adoption of the
Uniform Plumbing Code, is AMENDED to read as follows:
15.08.010 Adoption of the Uniform Plumbing Code.
(1) The 2006 Edition of the Uniform Plumbing Code and Uniform Plumbing Code
Standards as adopted by the Washington State Building Code Council, together with
appendices A, B, and D, are adopted as the official codes and standards of the city.
One copy of said code and standards is on file in the offices of the City Clerk. The
building official shall be the administrative authority as referenced in the Uniform
Plumbing Code.
(2) Any enforcement action commenced under a prior code shall remain in full

force and effect unless the misconduct charged under the prior code is lawful under
the newer code. (Ord. 1945 § 3, 2004; Ord. 1864 § 1, 2002; Ord. 1727 § 2, 1998).
15.08.20 Penalty for violation
Any person, firm or corporation violating any provisions of this code shall be
deemed guilty of a misdemeanor and, upon conviction thereof, shall be punishable
by a fine not to exceed $300.00 or by imprisonment for a term not to exceed 90
days, or by both fine and imprisonment. Each separate day or any portion thereof
during which any violation of this code occurs or continues shall be deemed to
constitute a separate offense and, upon conviction thereof, shall be punishable as
provided in this section. (Ord. 1727 § 3, 1998).
SECTION 2. This ordinance shall be in full force and effect five (5) days after
posting and publication as required by law. A summary of this Ordinance may be published
in lieu of the entire ordinance, as authorized by State Law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor
and attested by the Clerk in authentication of such passage this 11th day of June 2007.
