AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
ACCEPTTNG THE DR|NK|NG WATER STATE REVOTV|NG FUND (DWSRF)
WELL NO. 11 PRECONSTRUCTION LOAN (CONTRACT:2021-9949, pRE-
CoNSTRUCT|ON LOAN NO. pCL263491, AS MANAGED By THE
WASHINGTON STATE DEPARTMENT OF HEAITH (DOH), AND
APPROVING CONTRACT NO. CO54-2L WITH THE DOH FOR THE
CONTINUATION OF THE WELL NO. 11 DEVELOPMENT, TREATMENT AND
BOOSTER PUMP STATION PROJECT; PROVIDING FOR SEVERABII|TY AND
PUBLICATION; AND SETTING AN EFFECTIVE DATE.
WHEREAS, on November L9, 2020, the City's Public Works Department applied for a
55,000,000 Drinking Water State Revolving Fund (DWSRF) Construction Loan through the
Washington State Department of Health (DOH) for the multi-phased Well No. 11 Development,
Treatment and Booster Pump Station Project; and
WHEREAS, on January 28, 2O2L, the City was informed that it would not be receiving
Construction Loan funding, but that DOH suggested the City apply for a 5S00,000 Pre-
construction Loan; and
WHEREAS, on April 22, 202I, the DOH notified the City that they were awarded the
SS1O,OOO Pre-construction Loan (including a S10,O0O Loan Origination Fee)for the continuation
of the Well No. 11 Development, Treatment and Booster Pump Station Project; and
WHEREAS, the City Council has determined it to be in the best interests of the City to
accept the loan and enter into Contract No. CO54-2I with the DOH for the continuation of the
Well No. 11 Development, Treatment and Booster Pump Station Project; now, therefore,
THE CITY COUNCIT OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS
FOLIOWS:
SECTION 1. Acceptance and Authorization. The City Council hereby accepts the Pre-
construction Loan from the Department of Health and authorizes the Mayor to execute
Contract No. C054-2L with the Washington State Department of Health (DOH) for the
continuation of the Well No. 11 Development, Treatment and Booster Pump Station Project,
and the City agrees to be bound by the terms and conditions thereof.
SECTION 2. Severabilitv. lf any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.

SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and
effect five days after publication, as provided by law
