012-06 - Ordinance - Amending Ordinance No. 1748 RE ZoningORDINANCE NO. 012-06 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING THE PORT ORCHARD ZONING ORDINANCE BY ALLOWING DETACHED HOUSING IN THE R20 ZONE, ADDING A MINIMUM LOT SIZE AND LOT WIDTH IN THE R4.5 ZONE, ELIMINATING THE REQUIREMENT TO MAINTAIN A USEABLE MINIMUM DIAMETER OF 50 FEET BEHIND ALL SETBACKS IN PLANNED RESIDENTIAL DEVELOPMENTS AND ALL ZONES, AND ELIMINATING THE MINIMUM LOT SIZE IN PLANNED RESIDENTIAL DEVELOPMENTS WHEREAS, on December 28, 1998 the City Council in Ordinance No. 1748 adopted the Port Orchard Zoning Ordinance; and WHEREAS, the City Council has studied issues concerning the requirement to maintain a minimum diameter of 50 feet behind all setbacks, minimum lots sizes and widths in R4.5 zones and planned residential developments, and the use of detached housing in R20 zones; and WHEREAS, the City Council has received the recommendation of the Planning Commission concerning these issues, held public hearings on December 12, 2005 and March 27, 2006 to take public testimony, which hearing was continued to April 10, 2006, and finds that it is in the public interest to amend the Zoning Ordinance to allow detached housing in the R20 zone, to establish minimum lot sizes and widths in the R4.5 zone, to eliminate the requirement to maintain a useable 50 foot diameter behind all setbacks in planned residential developments and all zones, and to eliminate the minimum lot size in planned residential developments; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Ordinance No. 1748, the City of Port Orchard Zoning Ordinance, Part B3: Permitted, conditional, and special uses, residential land uses table, is hereby amended by permitting single family detached housing in the R20 zone within a Planned Residential Development (PRD), as set forth in Exhibit A attached hereto and by reference incorporated herein. SECTION 2. Ordinance No. 1748, the City of Port Orchard Zoning Ordinance, Part C1: Density, dimension, and design requirements, Densities and dimensions land uses table, is hereby amended to provide for a minimum lot size of 6000 square feet and minimum lot width of 40 feet at the building point in the R4.5 zone, as set forth in Exhibit B attached hereto and by reference incorporated herein. SECTION 3. Ordinance No. 1748, the City of Port Orchard Zoning Ordinance, Part B5: Property specific development standards, planned residential development standards, and special design district overlays, Section 6: Modification of development standards, is amended by deleting the requirement in Section 6(a)(7) for a usable minimum diameter of 50 feet behind all setbacks and a lot area of 1,963 square feet so that the amended Section 6 reads as follows: Ordinance No. 012-06 Page 2 of 3 Section 6: Modification of development standards a: The City, using planned residential development, may allow the following development standards to be modified: 1) Building setbacks, except that structures located on the perimeter of the planned residential development shall be set back in accordance with setbacks of the underlying zone; 2) Height of building or structure, provided that the project design protects the views and privacy of properties inside and outside of the project; 3) Required off-street parking spaces; 4) Landscaping requirements; 5) Sign requirements; 6) Design standards; 7) Lot size. b: Standards which may not be modified or altered are: 1) Shoreline regulations when the property is located in an area under the jurisdiction of the Shoreline Master Program; 2) Standards pertaining to development in environmentally sensitive areas; 3) Regulations pertaining to nonconforming uses, structures, or lots; 4) Standards within the Developer’s Handbook including, but not limited to, street and sidewalk standards, platting requirements, utility requirements, and stormwater regulations. SECTION 4. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
