The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular
Council meeting held March 14, 2005.
ORDINANCE NO. 004-05
AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON,
AMENDING THE PORT ORCHARD MUNICIPAL CODE BY ADDING A
NEW CHAPTR 9.44 ENTITLED "URINATING IN PUBLIC".
Copies of Ordinance No. 004-05 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 004-05 will be
provided at a nominal charge.

AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, AMENDING THE PORT ORCHARD MUNICIPAL
CODE BY ADDING A NEW CHAPTER 9.55 ENTITLED
"URINATING IN PUBLIC."
WHEREAS, under the current provisions of the Port Orchard Municipal Code,
urinating in public must be prosecuted as a lewd act; and
WHEREAS, the Port Orchard Police Department and the City Council believe it
to be in the public interest to categorize urinating in public as a separate offense; now,
therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DO ORDAIN AS FOLLOWS:
SECTION 1. Title 9 "Public Peace, Morals and Safety" of the Port Orchard
Municipal Code is hereby amended by adding a new chapter 9.55 entitled "Urinating in
Public" to read as follows:
Chapter 9.55
URINATING IN PUBLIC
Sections:
9.55.010 Urinating in public.
9.55.020 Violation — penalty.
9.55.010 Urinating in public.
A person is guilty of urinating in public if he intentionally
urinates or defecates in a public place, other than a washroom
or toilet room, under circumstances where such act could be
observed by any member of the public. "Public place," as used
in this section, is defined in Section 9.20.010(6) of this title.
9.55.020 Violation — penalty.
Any person violating any of the provisions of this chapter shall
be guilty of a misdemeanor.
SECTION 2. This ordinance shall be in full force and effect five (5) days
after posting and publication as required by law. A summary of this Ordinance may be
published in lieu of the entire ordinance, as authorized by State Law.

PASSED by the City Council of the City of Port Orchard, APPROVED by the
