Michelle Merlino Deputy Clerk Publish: Port Orchard Independent April 16, 2005 Kitsaplegals@soundpublishing cony ORDINANCE NO. 007-05 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AUTHORIZING IMPOUNDMENT OF VEHICLES WITH UNPAID PARKING TICKETS AND ADOPTING A NEW SECTION 10.12.475 OF THE PORT ORCHARD MUNICIPAL CODE WHEREAS, the City Council deems it in the public interest and welfare to authorize the impoundment of vehicles with four or more unpaid parking tickets, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Chapter 10.12 of the Port Orchard Municipal Code is hereby amended by the addition of a new Section 10.12.475 to read as follows: 10.12.475 Impoundment of vehicles with unpaid tickets. When a vehicle is parked in a public right-of-way or on other publicly owned or controlled property in violation of any law, ordinance, or regulation and there are four or more parking infractions issued against the vehicle for each of which (1) a person has failed to respond, failed to appear at a requested hearing, or failed to pay an adjudicated parking infraction, and (2) at least forty-five days has elapsed from the filing of the notice of infraction, then the vehicle may be impounded pursuant to Chapter 10.72 of this code without prior notice. The registered owner of the vehicle shall be responsible for payment of all towing and storage fees. The vehicle shall not be released to any person until all towing and storage fees and all penalties, fines or forfeitures owed by the registered owner have been satisfied. Any person seeking to redeem a vehicle impounded under this section shall have a right to a municipal court hearing pursuant to POMC 10.72.040(4). SECTION 2. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this ordinance. Ordinance No. 007-05 Page 2 of 2 SECTION 3. Effective Date. This ordinance shall take effect May 1, 2005. This ordinance shall be published as provided by law at least five (5) days prior to the Effective Date. A summary of this ordinance may be published in lieu of the entire ordinance, in its entirety.
