ORDINANCE NO. 015-05 AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON, AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1748 BY AMENDING THE CITY OF ORT ORCHARD ZONING MAP TO CHANGE THE ZONING CLASSIFICATION OF CERTAIN PROPERTY FROM R4.5 TO R.8 SUBJECT TO THE CONDITIONS OF PRELIMINARY PLAT APPROVAL FOR THE GAZEBO PLAT APPLICATION NO. SUBDIV 04-021R-1153. Copies of Ordinance No. 015-05 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. Thirty days after publication, copies of Ordinance No. 015-05 will be provided at a nominal charge. SUBDIV 04-02/R-1153 Kitsap County Assessor's Parcel Numbers: 022301-2-021- 2007, 022301-2-033-2003 AND 022301-2-036-2000. Legal Description. The NW COR of the SE'/a, of the NW 1/4 of Section 2, Township 23N, Range 01 East. Full legal attached as Exhibit A WHEREAS, the owner of the real property legally described in Exhibit A attached hereto and by reference incorporated herein (the "Subject Property") has requested, by filing rezone application number R1153, that the zoning designation for the Subject Property be changed from the low density residential zoning classification of R4.5 to the medium density residential zoning classification R8; and WHEREAS, the Comprehensive Plan designation for the Subject Property is Medium Density Residential; and WHEREAS, State Law mandates that the zoning designation be made consistent with the Comprehensive Plan designation; now, therefore THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. The Subject Property is hereby rezoned to R8, and time City Zoning Map is hereby amended accordingly. SECTION 2, This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
