1959 - Ordinance - Amending Chapter 10.12 Parking, Standing and Stopping0 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING CHAPTER 10.12 OF THE PORT ORCHARD MUNICIPAL CODE REGARDING ENFORCEMENT OF PARKING, STANDING AND STOPPING REGULATIONS AND REPEALING SECTIONS 4, 5, 15, 23, AND 44 OF ORDINANCE NO. 1650 WHEREAS, the City Council previously adopted Ordinance No. 1650 regulating the parking, standing, and stopping of vehicles in the City as codified in chapter 10.12 of the Port Orchard Municipal Code; and WHEREAS, chapter 10.12 of the PortOrchard Municipal Code currently provides that traffic parking regulations are to be enforced by a traffic enforcement person under the supervision of the city engineer; and WHEREAS, the City Council has determined that the management and supervision of a traffic division and traffic enforcement persons are best suited to be under the supervision of the chief of police; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Repealer. Sections 4, 5, 15, 23, and 44 of Ordinance No. 1650 enacted December 9, 1996 are herby repealed. SECTION 2. Section 10.12.030 of the PortOrchard Municipal Code is amended to read as follows: 10.12.030 Police administration. There is established in the police department of the city of Port Orchard a traffic division employing parking enforcement officers under the control of the chief of police. SECTION 3. Section 10.12.040 of the Port Orchard Municipal Code is amended to read as follows: 10.12.040 Duty of traffic division. It shall be the duty of the traffic division, with such aid as may be rendered by other members of the police department, to enforce the parking, standing, and stopping regulations of the city of Port Orchard as set forth in this Title 10. SECTION 4. Section 10.12.140 of the Port Orchard Municipal Code is amended to read as follows: 10.12.140 Special passes. (1) Motorists who are serving as jurors or witnesses for municipal court, district court or superior court may be issued a Ordinance No.1959 Page 2 of 2 juror's or witness's pass from the court. This pass will be placed inside the car and will allow the car to park in excess of the posted time limitation on the city street. The juror and/or witness pass shall be dated in order to be valid and is limited to jurors and witnesses. (2) The traffic division may issue special passes to other motorists when the chief of police determines that there is a need for issuance. The special pass will be placed inside the car and will allow the car to park in excess of the posted time limitation on the city street. The special pass shall be dated in order to be valid and limited to only those people who are granted approval by the chief of police. Each pass shall be valid for only that amount of time necessary to accomplish the motorist's need. SECTIONS. Section 10.12.220 of the Port Orchard Municipal Code is amended to read as follows: 10.12.220 Violating permits for loading or unloading at an angle to the curb. (1) It shall be unlawful for any permittee or other person to violate any of the special terms or conditions of any permit issued by the traffic division for the backing of a vehicle to the curb for the purpose of loading or unloading property. (WAC 308-330-448) (2) It shall be unlawful for any permittee or other person to violate any of the special terms or conditions of any parking pass issued by the traffic division. (3) Violations of this section is a Class A parking infraction. SECTION 6. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
