AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING THE
CITY OF PORT ORCHARD COMPREHENSIVE PLAN MAP BY
REDESIGNATING PROPERTY FROM COMMERCIAL TO HIGH
DENSITY RESIDENTIAL LOCATED BETWEEN HORSTMAN ROAD
AND ORLANDO STREET, SECTION 30, TOWNSHIP 24 NORTH,
RANGE 2 EAST, W.M., IN KITSAP COUNTY, WASHINGTON

WHEREAS, the City Council adopted the Comprehensive Plan for the City of Port
Orchard by Ordinance No. 1648, pursuant to the Washington State Growth Management Act (RCW
36.70A); and
WHEREAS, the applicant has initiated a Comprehensive Plan Map Amendment,
Application No. CA-19-04, requesting that the property legally described in Exhibit "A" be
designated as "High Density Residential," in order to a support future submittal of a site -specific
rezone application and development of single family residential homes; and
WHEREAS, the Planning Commission held a Public Meeting for the Comprehensive
Plan Map amendment on December 20, 2004; and
WHEREAS, the City of Port Orchard Planning Commission has transmitted to the
Council of the City of Port Orchard their findings and conclusions as stated in Planning Commission
Resolution No. 13-04, recommending Comprehensive Plan Map Amendment Application No. CA-
19-04 be approved for the reasons stated therein; and
WHEREAS, City Council held a public hearing on the Comprehensive Plan Map
amendment on December 27, 2004; and

WHEREAS, being fully advised, the Council finds and concludes as follows:
FINDINGS
JAMES CORPORATION has submitted an application for a Comprehensive Plan
Amendment, to change the current comp plan designation of an approximate 4.9
acre parcel from Commercial to High Density Residential. The parcel is within the
City limits (Tax No. 302402-3-025-2005) and is located between Horstman Road
and Orlando Street.
2. The site fronts Orlando Street to the south and SE Horstman Road to the north.
The property to the north is designated Urban Low Residential by the county. The
properties to the west, east, and south are within the City limits and are designated
High Density Residential in the Port Orchard Comprehensive Plan.
3. The site is in a residential area containing both single family residences and a
multi- family complex. The applicant intends to rezone the property to R-20 in the
near future with a site specific design for the development the property into
additional single family residential homes in this area.
4. RCW 36.70A.130 allows the City to amend comprehensive plan and zoning
designations.
5. The utilities for the property are currently available for extension by the City. The
property will be served by adequate public sewer, water supply, roads, and other
needed public facilities and services.
6. The site has access to SR 160 from Orlando Street, via Olney Avenue SE.
The site is adjacent to existing single family and multifamily developed areas and is
surrounded by other properties designated High Density Residential use.
CONCLUSIONS
1. High Density Residential is the most appropriate comprehensive plan designation
for the property. Changing the existing designation from Commercial to High
Density Residential is in conformance with the goals and policies of the
Comprehensive Plan and the Growth Management Act.
2. Designating the property High Density Residential is in furtherance of the health,
safety, and general welfare of the community.

WHEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
SECTION 1. The City of Port Orchard Comprehensive Plan, Ordinance No. 1634,
is hereby amended by changing the comprehensive plan map designation of the property
described in Exhibit "A" from Commercial to High Density Residential.
SECTION 2. Severability. If any section, subsection, paragraph, sentence,
clause, or phrase of this Ordinance is declared unconstitutional or invalid for any reason, such
decision shall not affect the validity of the remaining portions of this ordinance.
SECTION 3. This Ordinance shall be in full force and effect five (5) days after
posting and publication as required by law. A summary of this Ordinance may be published in lieu
of the entire Ordinance, as authorized by State law.
