ORDINANCE NO. 1926
AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING CITY
OF PORT ORCHARD COMPREHENSIVE PLAN ORDINANCE NO.
1634; BY AMENDING THE COMPREHENSIVE PLAN MAP FOR
PROPERTIES LOCATED GENERALLY AT THE NORTHWEST CORNER
OF THE INTERSECTION OF SEDGWICK ROAD SE AND GEIGER
ROAD SE, AND WEST OF BLACKJACK CREEK. (CA-17-03)
Tax Account Nos.022301-3-034-2000; 022301-4-004-2004;
Legal Description: Located in SW 1/4, Section 2, & SE 1/4 Section 11,
Township 23N, Range 1E, W.M.
WHEREAS, the City Council adopted the Comprehensive Plan for the City of Port
Orchard by Ordinance No. 1648, pursuant to the Washington State Growth Management Act (RCW
36.70A); and
WHEREAS, State Law RCW 36.70A.130 dictates that cities shall at least every five
years take action to review and, if needed, revise its Comprehensive Plan; and
WHEREAS, the applicant(s) have initiated a Comprehensive Plan Map
Amendment, CA-17-03, requesting that the subject'properties be designated as "Commercial", to
support future submittals of Rezone applications from the current residential zoning to a
Commercial zone. The range of expected uses has not been specified by the applicant at this
time; and
WHEREAS, the remaining portions of the property currently designated
"Greenbelt" as well as those portions lying west of Blackjack Creek, are not included with this
request; and
WHEREAS, adequate public notice has been given utilizing several public
informational mediums, including the "Citizen Update", advertisements, and legal notices. The
public has been provided the opportunity to give comment before the Port Orchard Planning
Commission on November 3rd, and November 17', 2003; and
WHEREAS, the City of Port Orchard Planning Commission has transmitted to the
Council of the City of Port Orchard their findings and conclusions as stated in Planning Commission
Ordinance No. 1926

Resolution No. 340-03, recommending Comprehensive Plan Map Amendment Application CA-17-03
be approved for the reasons stated therein; and
WHEREAS, City staff provided the City Council an overview of the proposed
Comprehensive Plan Amendments at a Public Hearing on December 8, 2003; and
WHEREAS, the City Council finds that the proposed amendment for the subject
properties is suitable for the requested land use designation based upon, provision of utilities and
consistency with existing and planned uses; and
WHEREAS, the City Council finds that the proposed Comprehensive Plan Map
Amendment CA-17-03 is consistent with the goals of the community, adopted Comprehensive
Plan, and general requirements of the Growth Management Act (RCW 36.70A); now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
SECTION 1. That the City Council does hereby approve
Comprehensive Plan Amendment CA-17-03, to designate portions of the subject
properties on the Comprehensive Plan Map as Commercial", lying east of Blackjack
Creek, and outside of the area currently designated as "Greenbelt", as illustrated on
Attachment'1', subject to the following conditions:
That future development of the subject properties be considered through a review
of a site Specific Plan and Rezone Application that will include at a minimum the
following special reports:
(a) An environmental checklist, addressing project
specific impacts upon the environment.
(b) A Traffic Impact Analysis and Roadway Improvement
Plan to address appropriate levels of roadway
improvements to offset direct impacts to the
surrounding area, adjacent roads, and nearby
intersections.
(c) A Wetland/Stream Delineation and Report &
Mitigation Plan, to be incorporated into the Storm
Drainage Plan as appropriate.
(d) Any development within 200 ft. of Blackjack Creek
shall provide a Habitat Management Plan, to consider
measures to retain and protect the wildlife habitat of
blackjack Creek, to consider effects of land use

intensity, buffers, setbacks, impervious surfaces,
erosion control and retention of natural vegetation.
(e) Future development of the property provide a special
report to include building elevation details with
associated building pad, parking lot, and road
layouts, to include at a minimum: design standards,
landscape areas, natural vegetation areas an
anticipated building materials.
SECTION 2. Severability. If any section, subsection, paragraph, sentence,
clause, or phrase of this Ordinance is declared unconstitutional or invalid for any reason, such
decision shall not affect the validity of the remaining portions of this ordinance.
SECTION 3. This Ordinance shall be in full force and effect five (5) days after
posting and publication as required by law. A summary of this Ordinance may be published in lieu
of the entire Ordinance, as authorized by State law.
PASSED by the City Council of the City of Port Orchard, signed by the Mayor and
attested by the City Clerk in authentication of such passage this 22nd day of December 2003.
