The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular
Council meeting held January 13, 2003.

AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON,
AMENDING CITY OF PORT ORCHARD COMPREHENSIVE PLAN
ORDINANCE NO. 1634; BY AMENDING THE COMPREHENSIVE PLAN
MAP FOR PROPERTIES LOCATED ALONG THE SOUTH SIDE OF
DWIGHT STREET, BEMlEEN CLINE AVENUE AND AUSTIN AVENUE.

AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING CITY
OF PORT ORCHARD COMPREHENSIVE PLAN ORDINANCE NO. 1634;
BY AMENDING THE COMPREHENSIVE PLAN MAP FOR PROPERTIES
LOCATED ALONG THE SOUTH SIDE OF DWIGHT STREET, BETWEEN
CLINE AVENUE AND AUSTIN AVENUE. (CA-12-02)

Legal Description: N % of Lot 1, S % of Lot 1, Lots 4, 5, & 8, Block
5, S.M. Stevens’ Town Plat of Sidney, as per plat recorded in
Volume 1 of Plats, page 1. records of Kitsap County, Washington.
Located in NW %, SE %, Section 25, Township 24N, Range lE,
W.M.
WHEREAS, the City Council adopted the Comprehensive Plan for the City of Port Orchard
by Ordinance No. 1648, pursuant to the Washington State Growth Management Act (RCW 36.70A); and
WHEREAS, State Law RCW 36.70A.130 dictates that cities shall at least every five years
take action to review and, if needed, revise its Comprehensive Plan; and
WHEREAS, the subject properties are currently designated as on the Comprehensive Plan
Map as “High Density Residential” and on the Zoning Map as “RE; and
WHEREAS, the applicant has initiated a Comprehensive Plan Map Amendment, CA-12-02,
requesting that the subject properties be designated as “Public and Community Spaces”; and
WHEREAS, the applicant has expressed that the future intended use of the site is to
construct a public administration building to meet the needs of the county government; and
WHEREAS, adequate public notice has been given utilizing several public informational
mediums, including the “Citizen Update”, advertisements, and legal notices. The public has been provided
the opportunity to give comment at two open house sessions held on August 7 and 15. 2002; as well as
opportunity before the Port Orchard Planning Commission on August 19, 2002, September 16, 2002.
October 4 and 30, 2002, and November 4,2002. The Planning Commission held a Special Study Session to
tour the City in consideration of CA-12-02, and the other proposed Comprehensive Plan Amendments for
2002; and,

WHEREAS, the subject properties are found within the prescribed boundary of Resolution
No. 1918, and located adjacent to the other county services found at the County Courthouse Campus; and
WHEREAS, Kitsap County is in the process of developing a Master Plan to meet the long-
term needs of the County, and the applicant has stated that they intend to work closely with city staff, and
surrounding residents to develop a mutually supported Master Plan for future development; and
WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of
the City of Port Orchard their findings and conclusions as stated in Planning Commission Resolution No. 328-
02, recommending the Comprehensive Plan Map be amended for the subject properties to designate them
as Public and Community Spaces, for the reasons stated therein; and
WHEREAS, city staff provided the City Council an overview of the proposed Comprehensive
Plan Amendments on November 12, 2002 and a public hearing was held before the City Council on
December 9, 2002 and the Decision Hearing regarding all the annual 2002 proposed Comprehensive Plan
Amendments was held before the City Council on December 23,2002; and,
WHEREAS, the City Council has concurred with the Planning Staff Report Findings as

zoned R8.
2. Three residences are situated on the site.
3. Access to the subject properties is currently by way of an alley way from Austin
Avenue. Public parking is provided along Austin and Dwight Streets, as well as
public parking lots located nearby.
4. The City Council approved Resolution 1918 with the intent of providing direction
to Kitsap County for future facility expansions to be within the area of Dwight
and Sroufe Streets, and, Cline and Austin Avenues.
5. The Applicant is are requesting a Comprehensive Plan Amendment to Public
and Community Spaces, to support an intended Rezone application from RE to
Public Facilities, together with a development proposal for construction of a
public administration office building.
6. An attorney’s office is located across Dwight Street to the north, approved with
SUP 1018 authorized in 1982.
7. A Comprehensive Plan Map Amendment request (CA-10-02) has been
submitted for the properties located directly across Dwight Street to the north,
requesting approval for a designation for Commercial, and Rezone, to Mixed
Use (“professional office”)
8. Kitsap County is in the process of developing a master plan to meet the long-
term needs of the county. The applicant intends to work closely with City staff,
and surrounding residents to develop a mutually supported master plan for

WHEREAS, the proposed Comprehensive Plan Map Amendment CA-12-02 has been found
to be consistent with the goals of the community, adopted Comprehensive Plan, and general requirements of
the Growth Management Act (RCW 36.70A); now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
SECTION 1. That the City Council does hereby approve Comprehensive Plan
Amendment CA-12-02, to designate the subject properties (as depicted in Attachment ‘1’) “Public
and Community Spaces”.
SECTION 2. Severability. If any section, subsection, paragraph, sentence, clause, or
phrase of this Ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect
the validity of the remaining portions of this ordinance.
SECTION 3. This Ordinance shall be in full force and effect five (5) days after posting
and publication as required by law. A summary of this Ordinance may be published in lieu of the entire
Ordinance, as authorized by State law.
