WHEREAS, the City Council adopted the Comprehensive Plan for the City of Port Orchard,
by Ordinance No. 1648, pursuant to the Washington State Growth Management Act (RCW 36.70A); and
WHEREAS, State Law RCW 36.70A.130 dictates that cities shall at least every five years
take action to review and, if needed, revise its Comprehensive Plan; and
WHEREAS, the applicant has initiated a Comprehensive Plan Map Amendment, CA-14-02,
requesting that the subject properties be designated as Medium Density Residential to support a future
development of a planned residential community; and
WHEREAS, the subject property was presented to the City as CA-04-02 in 2000, proposing
a mixed use development of residential and professional offices and was approved for a split designation of
Medium Density Residential and Industrial. The property is now under two separate ownerships that include
Pacific Evergreen Foundation, and Chrismarian Partnership; and,
WHEREAS, the Chrismarian Partnership has expressed that they support the proposal as
submitted by the applicant, to be consistent with the citywide mapping proposals of CA-11-02 "Medium
Density Residential" and CA-13-02 "Greenbelt"; and

WHEREAS, adequate public notice has been given utilizing several public informational
mediums, including the "Citizen Update", advertisements, and legal notices. The public has been provided
the opportunity to give comment at two open house sessions held on August 7 and 15, 2002; as well as
opportunity before the Port Orchard Planning Commission on August 19. 2002, September 16, 2002,
October 4 and 30, 2002, and November 4, 2002. The Planning Commission held a Special Study Session to
tour the City in consideration of CA-14-02, and the other proposed Comprehensive Plan Amendments for
2002; and,
WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of
the City of Port Orchard their findings and conclusions as stated in Planning Commission Resolution No. 329-
02, (Attachment "2) recommending Comprehensive Plan Map Amendment Application CA-14-02 be
approved for the reasons stated therein; and
WHEREAS, city staff provided the City Council an ovewiew of the proposed Comprehensive
Plan Amendments on November 12,2002, a Public Hearing was held before the City Council on December
9, 2002, and the Decision Hearing regarding all the annual 2002 proposed Comprehensive Plan
Amendments was held before the City Council on December 23,2002; and,
WHEREAS, the City Council has found that the proposed Comprehensive Plan Map
Amendment CA-14-02 is consistent with the goals of the community, adopted Comprehensive Plan, and
general requirements of the Growth Management Act (RCW 36.70A); now, therefore,
DOES ORDAIN AS FOLLOWS:
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
SECTION 1. That the City Council does hereby adopt Planning Commission Resolution
No. 329-02 with conditions, as their own, as shown in Attachment '2.
SECTION 2. That the City Council does hereby approve Comprehensive Plan Map
Amendment Application CA-14-02 to redesignate land from Medium Density Residentialllndustrial to
Medium Density Residential for both the Pacific Evergreen Foundation and Chrismarian Partnership
properties, consistent with the citywide mapping as proposed in CA-11-02 and CA-13-02, as depicted in
Attachment '3'.
SECTION 3. Severability. If any section, subsection, paragraph, sentence, clause, or
phrase of this Ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect
the validity of the remaining portions of this ordinance.
SECTION 4. This Ordinance shall be in full force and effect five (5) days afler posting
and publication as required by law. A summaryof this Ordinance may be published in lieu of the entire
Ordinance, as authorized by State law.

A RESOLUTION OF THE CITY OF PORT ORCHARD PLANNING
COMMJSSION RECOMMENDING THE APPROVAL OF A
DESIGNATE LAND FROM MEDlUM DENSITY
RESIDENTIAL’INDUSTRIAL TO MEDIUM DENSlTY
RESIDENTIAL, AND TO APPLY CORRESPONDING ZONING
ACRE. THE SUBJECT AREA IS LOCATED PRIMARILY ON THE
PLATEAU OF llIE ROSS POINT PENINSULA, ABUTIWG SR-166
TO THE NORTH AND WEST, SR-16 TO THE SOUTH AND THE
ROSS CREE CORRIDOR ALONG THE EASTERN BOUNDARY, IN
SECTION 27, TWP 25, R IE, ASSESSOR PN 2724014-053 & 029-2000
COMPREHENSIVE PLAN AMENDMENT, CA-14-02R-1142, TO RE-
DESIGNATION OF RESIDENTIAL - 8.0 UNITS/NET USEABLE
WHEREAS, the City of Port Orchard is following State Law RCW 36.70A.130 which dictates
that cities shall at least every five years take action to review and, ifneeded, revise its Comprehensive Plan; and
WHEREAS, the City of Port Orchard seeks to be in compliance with the goals, policies,
and procedures of the Growth Management Act; and,
WHEREAS, the Planning Commission held a Public Meeting for the Comprehensive Plan
Amendment on October September 16, 2002; October 12, 2002; October 21 2002 and November 4,2002;
and
WHEREAS, the intent of this Comprehensive Plan Map Amendment is to develop an urban
residential community wth a mix of single family detached and attached housing types and styles and to
eliminate the “Industrial” designation for that portion which is under the ownership Evergeen Pacific
Foundation, and designate the developable area (44+/- acres) as “Medium Density Residential”; and
WHEREAS, the subject property was presented as a portion of a property considered under
CA-04-00 in 2000. Total acreage of that application was approximately 104 acres, with approximately 49
acres of developable land (Chrismarian and EPF). The proposal was for a mixed use development of
residential and professional offices and was approved for a split designation of Medium Density Residential
and Industrial. The remainder of the site not consfmcted upon was to remain undeveloped, and
WHEREAS, Urban level services in the form of City water and sewer have been extended
to the Ross Point area. The applicant has expressed that at time of development the project will extend
municipal utilities to the project site; and

WHEREAS, The access is limited from Tremont, and difficult due to the terrain. The
applicant also anticipates bearing the cost of SR-166 access improvements as required by WSDOT.
Additional urban level road improvements and funding appropriations have been made to support the
residential development of the area; and
’
WHEREAS, The application illustrates portions of the property deemed appropriate for
development and those portions that would be not built upon, and has indicated that large areas could be
presented for a land trust group for further preservation, and
WHEREAS, The need to coordinate construction and location of access will necessitate
property owners to work cooperatively in the Ross Point area; and
WHEREAS, The Chrismarian Partnership has expressed that they support the concept of
combining all developable lands under a common designation of “Medium Density Residential” and
WHEREAS, the applicant has stated that Evergreen Pacific Foundation intends to work
directly with the owners of the remaining developable land to provide for a planned development, and
WE THEREFORE FIND that the Comprehensive Plan Amendment, CA-14-02, is not
detrimental to the health, safety, and welfare of the community and is proposed to be within the character of
the Growth Management Act, Comprehensive Plan, and the community.
CONCLUSION: Based upon the facts, testimony, and the materials presented at the
Meeting, we therefore conclude that the Comprehensive Plan Amendment, CA-14-02, is consistent with the
health, safety, and welfare of the City of Port Orchard.
BE IT RESOLVED that the Planning Commission of the City of Port Orchard does hereby
respectfully request that the City Council approve the Comprehensive Plan Amendment, CA-14-02iR-1142
to redesignate land from “Medium Density Residentiafidushial” to ‘Medium Density Residential”, and to
apply corresponding zoning designation of R8 subject to the following Recommended Conditions:
1. As proposed, future development of the subject properties shall be reviewed as a Master Planned
Unit Development. The applicant should work cooperatively with adjacent property owners to
demonstrate that additional surrounding development upon the upper plateau is well coordinated for
the connection of roads, and extension of services, sufficient to accommodate anticipated levels of
surrounding development.
2. That residential dwelling types be limited to single family attached and detached.
3. That the Plan designated boundaries be consistent with the cityunde amendment for mapping
Medium Density Residential and Greenbelt (CA-11-02, CA-13-02).
4. Special consideration should be applied to the area Comprehensive Plan designations to ensure that
the development is well-planned and sensitive to the environmental concerns of the area to include:
a. Preservation of the Ross Creek corridor as a significant fish and wildlife habitat area;
b. Conservation of open space for public enjoyment;
c. Application of Best Management Practices in stormwater control &design;
d. Stabilization of the steep slopes adjacent to Ross Creek and Bay Street;
e. Coordinated access between properties with safe access onto Bay Street;
f. Furtherance of City long-terms goals for quality site development that is attractively
designed.
