02/08/1999 - Regular - MinutesPort Orchard, Washington February 8, 1999 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at 7:30 P.M. at City Hall, 216 Prospect Street. Councilmembers present: Clauson, Wyatt, Geiger, Powers, Van Zee, and Stansbery. Councilman Morrison excused. Staff present: City Clerk Parks, Deputy Clerk Merlino, Acting Police Chief Loflin, City Engineer Curies, City Planner Gross, City Attorney Hanson, and Fire District No. 7 Contract Representative Assistant Chief Snow. Councilman Geiger led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this agenda. Orton Kreuger, representing the Port Orchard Masonic Lodge #98, presented a letter offering to host a time honored Cornerstone (time capsule) Ceremony for the new City Hall. On motion by Councilwoman Powers, seconded by Councilman Clauson, Council accepted the offer from the Port Orchard Masonic Lodge #98 to host a time honored Cornerstone (time capsule) ceremony for the new City Hall, contingent upon coordination with the City Hall Grand Opening Committee. City Engineer Curies reported on bid opening held January 28, 1999 regarding the sale of 435 - SRII water meter registers. One bid was received from the City of Bonney Lake in the amount of $4,676,25. On motion by Councilman Clauson, seconded by Councilman Van Zee, Council declared 435 - SRII water meter registers as surplus to the needs of the City; accepted the bidding process and awarded the surplus water meters to the City of Bonney Lake at the bid price of $4,676.25. On motion by Councilwoman Powers, seconded by Councilman Stansbery, Council approved Ordinance No. 1755 amending Ordinance No. 1717 to correct a scrivener's error to adjust the completion date for the Preliminary Plat of Golden Pond Subdivision to May 13, 2000. The property is located on the west side of Pottery Avenue, 400 feet south of Melcher Street and addresses consisting of properties at 1280, 1290 and 1330 Pottery Avenue. On motion by Councilwoman Powers, seconded by Councilman Geiger, Council approved Ordinance No. 1756 amending Ordinance No. 1718 to correct a scrivener's error to adjust the completion date for the Preliminary Plat of Aidan Place Subdivision to April 8, 1999. Property located in the vicinity of 1030 Olney Avenue. Motion passed with 5 ayes. Councilman Wyatt refrained from voting, due to a conflict of interest. On motion by Councilman Stansbery, seconded by Councilman Van Zee, Council approved Ordinance No. 1757 amending Ordinance No. 1719 to correct a scrivener's error to adjust the completion date for the Preliminary Plat of Rockport Subdivision to June 26, 1999. Property located approximately in the 900-1000 block of Olney Avenue (west side). Motion passed with 5 ayes. Councilman Wyatt refrained from voting, due to a conflict of interest. Acting Police Chief Loflin reviewed the Electronic Monitoring Agreement between the City and the Washington Association of Sheriffs and Police Chiefs. On motion by Councilman Van Zee, seconded by Councilman Wyatt, Council authorized Mayor Weatherill to sign the Electronic Monitoring Agreement between the City of Port Orchard and the Washington Association of Sheriffs and Police Chiefs. Mayor Weatherill referred to Unfinished Business item No. 4b request received from Jay Freeland seeking permission to use Harrison Avenue right of way as access to a proposed parking lot at the SW corner of Harrison Avenue and Bay Street. On motion by Councilman Geiger, seconded by Councilman Van Zee, Council approved the concept of using Harrison Avenue right of way as access to a proposed parking lot he is considering constructing at the SW corner of Harrison Avenue and Bay Street. Motion passed with 5 ayes and 1 nay. Councilwoman Powers voting nay. Minutes of the January 25, 1999 Council meeting as revised. b. Approval of Claim Warrants Number 30206-30277 in the amount of $104,119.68 and January 1999 Payroll Warrants 130820-130989 in the amount of $245,715.21. Disposal of miscellaneous computer equipment and calculators as surplus and authorized disposal, in the best interest of the City. Attachment "A" On motion by Councilman Van Zee, seconded by Councilman Wyatt, Council authorized Mayor Weatherill to sign the consulting agreement for the View Protection Ordinance with Local Government Institute in the amount of $7,500.00. On motion by Councilwoman Powers, seconded by Councilman Geiger, Council adopted Resolution No. 1847 authorizing the sale and clean up of 514 Bay Street (Public Works Shop) property. On motion by Councilman Clauson, seconded by Councilwoman Powers, Council authorized a Microsep System Pilot Study at the Sewer Treatment Plant in an amount not to exceed $33,000. On motion by Councilman Stansbery, seconded by Councilman Wyatt, Council declared miscellaneous items from the Police Department inventory as surplus and authorized the Police Department to dispose of these items in the best interest of the City. Attachment "B" On motion by Councilwoman Powers, seconded by Councilman Stansbery, Council authorized the City Engineer to accept the proposal from GeoScience Management to assist in the environmental clean up of the Public Works shop at 514 Bay Street in the approximate amount of $8,185.00, contingent upon review by the City Attorney. At 8:35 PM Mayor Weatherill called for a 20 minute Executive Session to discuss a pending litigation. At 8:56 PM Mayor Weatherill reconvened Council into regular session. On motion by Councilman Clauson, seconded by Councilmembers Powers and Stansbery, Council approved the following: (1) Authorized Mayor Weatherill to retain the law office of attorney Timothy Leyh as special counsel to represent the City in the legal action commonly known as Manheimer, et al v. Port of Bremerton, et al., Pierce County Superior Court Case No 95-2-13512-4; and (2) Authorized the law offices of attorney Timothy Leyh to negotiate with plaintiff's counsel for the purpose of entering into a settlement agreement to resolve any and all city liability to plaintiffs and third -party plaintiff arising out of this action; and (3) Authorized acceptance of plaintiff's settlement offer of $35,000.00 on condition that any such settlement agreement shall be tendered to the City's insurance carriers for acceptance and approval, which shall not, in the City's determination, be unreasonably withheld.
