08/23/1999 - Regular - MinutesPort Orchard, Washington August 23, 1999 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at 7:30 P.M. at City Hall Council Chambers, 216 Prospect Street. Council members present: Clauson, Wyatt, Morrison, Geiger, Powers, Van Zee, and Stansbery. Staff present: Police Sergeant McCarthy, City Clerk Parks, Deputy Clerk Merlino, City Planner Gross, City Engineer Curies, City Attorney Montgomery, and Fire District No. 7 Contract Representative Assistant Chief Snow. Councilman Stansbery led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this agenda. No comments were received at this time. Councilman Clauson asked Linda Wyatt, representing the New City Hall Grand Opening Committee to introduce the recipients and winners of the Essay Contest on "Why I Like Living in Port Orchard". Councilman Clauson advised, each winner received a $50.00 U.S. Savings Bond and each of their Essays will be included in the City Hall time capsule. Linda Wyatt introduced the following recipients and Mayor Weatherill thanked and congratulated each one for their participation in the contest: ❑ Grade 1 through 3 Annie Henderson ❑ Grade 4 through 6 Ashleigh Blake ❑ Grade 7 through 12 Mica Hanson ❑ Adult Benton Williams On motion by Councilman Clauson, seconded by Councilman Morrison, Council approved Ordinance No. 1766 amending Ordinance No. 1181 §4 as amended by the City of Port Orchard, Ordinance No. 1227 §4, an Ordinance providing for a formation of a Joint Housing Authority. After some discussion, Councilman Van Zee moved to adopt Resolution No. 1870 concerning Initiative 695, seconded by Councilman Clauson. Motion tied with 3 ayes and 3 nays. Mayor Weatherill broke tie vote by voting aye. Motion passed with 3 nays and 4 ayes. Council members Wyatt, Morrison and Geiger voting nay. Councilman Stansbery refrained from voting due to his absence at the 8/09/99 council meeting where Initiative 695 was discussed in detail. (The intent of Resolution No. 1870 is to urge voters to educate themselves on the wording and impact of Initiative 695 on the local community and go to the polls as an informed voter.) On motion by Councilman Clauson, seconded by Councilman Geiger, Council approved the consent agenda as follows removing Item 5c "Confirmation of Mayor Weatherill's appointment to the City of Port Orchard Hotel/Motel Advisory Board to serve from September 1, 1999 to August 31, 2000": a. Minutes of the August 9, 1999 regular council meeting with the following correction: Consent Agenda (a) Minutes of the July 26, 1999 regular council meeting with the following amendment: Council authorized Mayor Weatherill to sign the New City Hall Change Order No. 8 including line item #3 (share half the cost of scaffolding due to extreme weather, $8,568) for a total of $50,203.72. b. Claim Warrants number 31336-31409 in the amount of $252,583.08. On motion by Councilwoman Powers, seconded by Councilman Morrison, Council approved Consent Agenda Item 5c. as follows: August 23, 1999 Page 2 of 3 Confirmation of Mayor Weatherill's appointments to the City of Port Orchard Hotel/Motel Advisory Board to serve from September 1, 1999 August 31, 2000: *Councilmember Rick Wyatt (to serve as chair) *Representative from Holiday Inn Express *Representative from Vista Motel *Representative from the Guest House Inn *Representative from the Port Orchard Chamber of Commerce *Representative from the Sidney Museum and Arts Association *Representative from the Givens Center Motion passed with 6 ayes and 1 nay. Councilman Clauson voting nay. On motion by Councilman Clauson, seconded by Councilman Morrison, Council authorized the closure of the following streets on September 10 and 11, 1999 for the New City Hall Grand Opening Ceremonies: ❑ Prospect Street from Kitsap Street to Frederick Street ❑ Bank Street from Bay Street to Prospect Street. On motion by Councilman Morrison, seconded by Councilman Clauson, Council declared 16 file cabinets, drafting tool (Inventory 2-27) and gas monitor, as surplus and authorized the City Engineer to dispose of these items, in the best interest of the City. On motion by Councilman Morrison, seconded by Councilman Wyatt, Council authorized the City Engineer to proceed with the purchase of Lot #15 at the Port Orchard Industrial Park for the new Public Works Shop with the following terms: ❑ Purchase Lot #15 for the list price of $235,000; ❑ provide a slope easement on the abutting city property; ❑ provide a ground lease for a stormwater pond on city property, which is valued at $75,000; ❑ the city will pay $160,000 in cash for the acquisition. On motion by Councilman Morrison, seconded by Councilwoman Powers, Council authorized the City Engineer to expand the contract with Maranbuch Construction Services for the sidewalk repair project in the amount of $11.62 per foot. On motion by Councilman Morrison, seconded by Councilwoman' Powers, Council authorized Mayor Weatherill to sign the following contracts regarding the traffic signal at Tremont Street and Port Orchard Boulevard: ❑ Supplement #1 of the Local Agency Agreement which allocates grant money to the construction project. The city's share of construction is $27,139. ❑ Supplement #3 of the contract with SCA. This allocates a maximum of $8,025.96 for SCA during construction. Kitsap County will administer the construction contract. ❑ Contract with Kitsap County for the administration of the project. On motion by Councilwoman Powers, seconded by Councilman Clauson, Council authorized the City Engineer to advertise for a consultant to synchronize the lights on Tremont Street.
