ORDINANCE NO. 1900
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
ANNEXING CERTAIN REAL PROPERTY KNOWN AS THE TALMO-
TAEEMAN-ANN" EXATK)N-PURSLrANT-TO-THE-ELECTION-METHOD--
ESTABLISHING ZONING CLASSIFICATIONS AND FIXING THE
EFFECTIVE DATE OF THE ANNEXATION.
WHEREAS, on December 9, 2002, at a regular meeting of the City Council of the City of
Port Orchard, Washington, pursuant to RCW 35.13.015 the City Council passed Resolution No. 2001
commencing an election method annexation initiated by City Council resolution for the annexation of the
unincorporated property described in Section 1 of this ordinance, commonly referred to as the Talmo -
Tallman Annexation, and
WHEREAS, said resolution also called for an election on whether the property in the
Talmo -Tallman Annexation should be subject to existing bonded indebtedness, and
WHEREAS, on or about January 13, 2003 the City filed a Notice of Intention to Annex
with the Kitsap County Boundary Review Board concerning the proposed annexation, and
WHEREAS, February 20, 2003, pursuant to the provisions of RCW 36.93.110, the
Boundary Review Board waived Board jurisdiction on the proposed annexation, and
WHEREAS, on February 24, 2003 at a regular meeting of the City Council of the City of
Port Orchard, Washington pursuant to RCW 35.13.060 and 35.13,070 the City Council adopted
Resolution 2009 requesting that the Kitsap County Auditor call a special election to be held on the 22nd
day of April 2003, and
WHEREAS, an election was held pursuant to state statute on April 22, 2003, and
WHEREAS, in the April 22, 2003 special election the Talmo -Tallman Annexation was
approved by the voters, and the assumption of indebtedness was also approved, and
WHEREAS, the election results certifying a sufficient majority to permit annexation of the
area have been received by the City, and
WHEREAS, the City Council finds that the proposed annexation will have no significant
adverse environmental impacts, NOW, THEREFORE.
THE CITY COUNCIL OF THE CITY PORT ORCHARD, WASHINGTON, DOES ORDAIN
AS FOLLOWS:

SECTION 1. There has been filed with the City Council of the City of Port Orchard,
Washington, certified election results indicating a sufficient majority was received approving the Talmo -
Tallman Annexation to the City of Port Orchard and pursuant to RCW 36.93.110 the Kitsap County
Boundary Review Board waived jurisdiction on the Talmo -Tallman Annexation. The City Council finds it to
be in the best interest of the citizens of the City of Port Orchard to annex and does hereby annex the
territory submitted to the voters as the Talmo -Tallman Annexation situated in Kitsap County, Washington
as contiguous, proximate and adjacent to the present corporate limits of the City and as more particularly
described by its legal description as follows and graphically shown on Exhibit A, attached hereto and
incorporated in full by this reference.
LEGAL DESCRIPTION: That portion of the Northeast quarter of the Southeast quarter of
Section 10, Township 23 North, Range 1 East, W.M. in Kitsap County, Washington,
described as follows: Beginning at the Northeast corner of the Northeast quarter of the
Southeast quarter of said Section 10; thence South 2026'39" West along the East line
thereof a distance of 922.48 feet the North line of the South 400 feet of said Northeast
quarter of the Southeast quarter; thence north 87040'53" West along said North line a
distance of 30.00 feet to the West right-of-way margin of Sidney Road being the TRUE
POINT OF BEGINNING; thence continuing North 87040'53" West along said North line a
distance of 630.00 feet; thence North 2026'39" East 548.90 feet to the South line of the
North 375 feet of said Northeast quarter of the Southeast quarter; thence South 87°33'27"
East along said South line a distance of 630.00 feet to said right-of-way margin of Sidney
Road; thence South 2°26'39" West along said right-of-way margin a distance of 547.54
feet to the true point of beginning,
TOGETHER WITH Sidney Road abutting within Sections 10 and 11, Township 23 North,
Range 1 East, W.M., Kitsap County, Washington
SECTION 2. The territory set forth in this ordinance and for which said election results
were certified for annexation should be and is hereby made a part of the City of Port Orchard. Pursuant to
the election title, the area so amended shall be assessed and taxed at the same rate on the same basis
as property within the City of Port Orchard, and said annexed property shall be subject to, and shall pay
for, its proportionate share of indebtedness which has been approved by the voters, contracted for, or
incurred prior to and existing at the date of annexation. The current outstanding indebtedness of the City,
including assessments or taxes for payments of any bonds issued prior to or existing at the date of the
annexation shall be levied against the annexed territory.
SECTION 3. The Comprehensive Plan and Zoning designations of the annexation
area as described in Section 1 of this Ordinance shall be depicted on the City of Port Orchard
Comprehensive Plan and Zoning Maps as the city designation(s) comparable to Comprehensive Plan and
Zoning Designations that have been assigned under Kitsap County Title 17. The City Planning
Department is directed to insert the appropriate Comprehensive Plan and Zoning designations for the
annexation area (Tax parcel(s ) 102301-4-018-2008; 102301-4-019-2007; and 102301-4-024-2000) on
the official Comprehensive Plan and Zoning maps of the City when this Annexation becomes effective.
SECTION 4. Effective Date of Annexation: The effective date of the Talmo -Tallman
Annexation shall be June 1, 2003.
SECTION 5. Severability. If any section, subsection, sentence, clause, or phrase of this
ordinance or amendment thereto, or its application to any person or circumstances is held invalid, the
remainder or application to other persons or circumstances shall not be affected.

SECTION 6. This ordinance, being an exercise of a power specifically delegated to
the City legislative body, is not subject to referendum, and shall be in full force and effect five (5) days after
posting and publication as required by law. A summary of this Ordinance may be published in lieu of the
entire Ordinance, as authorized by State law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
attested by the Clerk in authentication of such passage this 12th day of May 2003.
