AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING THE CITY OF PORT ORCHARD ZONING ORDINANCE,
REGARDING CHAPTER B3: PERMITTED, CONDITIONAL, AND
SPECIAL USE TABLES, ADDING A USE CLASSIFICATION AND
MAKING OTHER CLARIFYING AND/OR TECHNICAL AMENDMENTS
TO THE USE TABLES.
WHEREAS, on December 28, 1998, the city council in Ordinance No. 1748, adopted the
City of Port Orchard Zoning Ordinance; and
WHEREAS, certain technical amendments are needed to correct inadvertent errors; to
clarify specific provisions; or to ensure consistency between the Comprehensive Plan and adopted
Development Regulations; and
WHEREAS, the purposes of the Use Classification Tables is to identify uses that, either
individually or as a type, possess similar characteristics or performance standards or are permitted as
compatible uses in a zone. A classification includes provisions, conditions and requirements related to the
permissible location of the uses; and
WHEREAS, Churches are authorized as "Conditional Uses" in a residential zone and
private schools, such as those affiliated with a church, are not addressed; and public schools are
authorized within the Community Facilities zone only; and
WHEREAS, the City has studied issues concerning defining and authorizing public and
private schools as a "Conditional Use" within residential zones and concluded that the proposed revisions
to use classification tables will result in developments consistent with the vision of the Comprehensive
Plan; and
WHEREAS, the City Council has received the recommendation of its Growth
Management Committee regarding the regulation of schools within the residential zones only to the limit
and extent necessary to mitigate negative impacts upon the community created by such facilities; and
WHEREAS, following a public hearing, the City Council determined it to be in the public
interest to enact new provisions relating to schools; now, therefore;
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES
ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 1748, Part 82: Definitions — land use, is hereby amended
by the addition of a new Section 96a to read as follows:
Section 96a: Schools private Private institutions of learning
having a curriculum below the college level as required by the
common school provisions of the State of Washington.
Section 2. Ordinance No. 1748, Part B3: Permitted, conditional, and special use
tables, General services land uses table, is hereby amended as set forth in Exhibit A attached hereto and
by reference incorporated herein.

Section 3. This Ordinance shall be in full force and effect five (5) days after posting
and publication as required by law. A summary of this Ordinance may be published in lieu of the entire
Ordinance, as authorized by State law.
PASSED by the City Council of the City of Port Orchard, signed by the Mayor and attested
by the Clerk in authentication of such passage this 121h day of May 2003.
