1855 - Ordinance - Amending and Adding Sections of POMC Regarding Regulations for Mobile Home ParksNOTICE OF CITY OF PORT ORCHARD ORDINANCE The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular Council meeting held April 22, 2002. ORDINANCE NO. 1855 AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON, AMENDING PORT ORCHARD MUNICIPAL CODE SECTIONS 17.04.030, 17.04.040, 17.04.050, 17.04.060, AND 17.04.070 AND ADDING A NEW SECTION 17.04.105, REGARDING REGULATIONS FOR MOBILE HOME PARKS WITHIN THE CITY LIMITS. (Amending Ordinance No. 1700) WHEREAS, The Bremerton-Kitsap County Heath District no longer routinely inspects mobile home parks for compliance to standards, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES ORDAIN AS FOLLOWS: Section 1. Port Orchard Municipal Code Section 17.04.030 is amended to read as follows: 17.04.030 Requirements for Parking Mobile Homes Outside of Mobile Home Parks. (1) No mobile home shall be parked and occupied outside an approved mobile home park unless adequate sanitary facilities are provided and approved by the health officer and unless permitted by applicable city building and zoning requirements. Section 2. read as follows: Port Orchard Municipal Code Section 17.04.040 is amended to 17.04.040 Permits for Mobile Home Parks. No person shall operate a mobile home park within the city who does not possess an unrevoked permit as issued by the City of Port Orchard in the name of such person for the specific mobile home park. Section 3. Port Orchard Municipal Code Section 17.04.050 is amended to read as follows: 17.04.050 Inspection of Mobile Home Parks. (1) The health officer and his or her agent are authorized and directed to make inspections of mobile home parks and mobile homes as are necessary to determine satisfactory compliance with health regulations and shall have access to such premises at reasonable times for the purpose of inspection. (2) The City Building Official and his or her agent are authorized and directed to make inspections of mobile home parks and mobile homes as are necessary to determine satisfactory compliance with City regulations and shall have access to such premises at reasonable times for the purpose of inspection. (3) In accordance with RCW 43.22.440 the city shall administer, inspect and enforce the installation of all mobile homes locating or relocating within the jurisdictional boundaries of the city. Ordinance No. 1855 Page 2 of 3 Port Orchard Municipal Code Section 17.04.060 is amended to Section 4. read as follows: 17.04.60 Fire Protection. (1) The mobile home park area shall be subject to the ordinances, rules and regulations of the city in regard to fire prevention and fire flow. The Port Orchard Fire Authority or his agent shall review plans for compliance with this system. The Fire Authority shall advise the health officer in writing of either compliance or the specific discrepancies. (2) system standards. Section 5. All mobile home park water systems shall conform to the City water Port Orchard Municipal Code Section 17.04.070 is amended to read as follows: 17.04.070 Land Use. (1) The mobile home park is subject to the ordinances, rules, and regulations of the city in regard to land use administration. (2) The minimum lot size for mobile homes within an approved mobile home park is 3,500 square feet when the lot is served by a public sanitary sewer system and 5,000 square feet when the lot is served by an approved community on-site sewer system. Otherwise, the individual lots shall conform to the Health District on-site sewer system land requirements. (3) structure on the mobile home lot, or property line. (4) Each mobile home lot in a mobile home park shall provide parking for at least one automobile and the space shall be at least nine feet wide and 20 feet long. (5) The spaces shall be at least nine feet wide and 20 feet long. (6) No mobile home shall be within ten feet (IO) of another mobile home, There shall be one guest parking space for every three mobile home lots. All roads within the mobile home park shall meet fire code requirements and City standards. (7) The mobile home park shall have perimeter landscaping consistent with the landscaping requirements of Urban Buffers -filtered screening, as described in the City Zoning Ordinance. Section 6. A new Port Orchard Municipal Code Section 17.04.105 is added to read as follows: 17.04.105 Mobile Home Park Expansions. (1) An expansion of a mobile home park is defined as the addition of any mobile home lot within the park or an expansion of the mobile home park property limits. Ordinance No. 1855 Page 3 of 3 (2) All expansions shall require the mobile home park to meet all existing City and Health District standards. These would include, but are not limited to roads, land use, water, sanitary sewer, and storm water management. Section 7. If any section, subsection, paragraph. sentence, clause or phrase of this ordinance is declared unconstitutional or invalid for any reason, such invalidity shall not affect the validity or effectiveness of the remaining portions of this ordinance. Section 8. This Ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire Ordinance, as authorized by State law.
