ORDINANCE
The following is a summary of an Ordinance approved by the Port Orchard City
Council at their regular council meeting held August 12, 2002.
ORDINANCE NO. 1866
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING CHAPTER 7.12 OF THE PORT ORCHARD MUNICIPAL CODE TO
AMEND VIOLATION AND PENALTY PROVISIONS FOR FAILURE TO
COMPLY WITH ANIMAL LICENSING REQUIREMENTS FROM $300 PER
FOR THE SECOND INFRACTION COMMITTED WITHIN ONE YEAR, AND
ONE HUNDRED DOLLARS FOR THE THIRD AND SUBSEQUENT
INFRACTIONS COMMITTED WITHIN ONE YEAR.
VIOLATION TO $40 FOR THE FIRST VIOLATION, SEVENTY-FIVE DOLLARS

Orchard City Clerk, 216 Prospect Street, Port Orchard, WA. Within thirty days of
publication, upon written request a statement of the full text of the ordinance will
be provided to any interested person without charge. After thirty days of
publication, copies of Ordinance No. 1866 will be provided at a nominal charge.

AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, AMENDING CHAPTER 7.12 OF THE PORT
ORCHARD MUNICIPAL CODE TO AMEND VIOLATION AND
PENALTY PROVISIONS FOR FAILURE TO COMPLY WITH
AhlMAL LICENSING REQUIRMENTS
WHEREAS, the City Council adopted Ordinance No. 1750 on March 8, 1999 thereby
establishing regulations for the care and control of animals within the City; and
WHEREAS, Section 6 of Ordinance No. 1750 established requirements for licensing of
dogs and cats within the city limits; and
WHEREAS, the City has identified the need to amend POMC 7.12 to include violation
and penalties for failure to comply with license requirements established by POMC 7.12, now therefore,
HEREBY ORDAIN AS FOLLOWS:
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
SECTION I. Section 7.12 of the Port Orchard Municipal Code is amended by adding
a new section to read as follows:
7.12.100 Date of Violation. The date of violation of the provisions of this section shall be
the date on which it became known to the Port Orchard Police Department or to the
impounding authority that such person, keeper, firm or corporation has an unlicensed dog or
cat.
7.12.110 Violation - Penalty -Civil Infraction. Any person violating any provisions of this
chapter, unless otherwise identified, is guilty of a civil infraction. The fine for any infraction
shall be forty dollars for the first violation, seventy-five dollars for the second infraction
committed within one year and one hundred dollars for the third and subsequent infractions
committed within one year. Each and every day or portion thereof in, which an infraction is
committed, shall constitute a separate and distinct infraction.
SECTION 2. Severability. If any section, subsection, paragraph, sentence, clause, or
phrase of this Ordinance is declared unconstitutional or invalid for any reason, such decision shall not
affect the validity of the remaining portions of this ordinance.
SECTION 3. Effective Date. This Ordinance shall be in full force and effect five (5) days
after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the
entire Ordinance, as authorized by State law.
