01/27/1997 - Regular - MinutesPort Orchard, Washington January 27, 1997 The Port Orchard City Council was called to order in regular session by Mayor Protem Carolyn Powers at 7:30 PM at City Hall, 216 Prospect Street. Councilmembers present: Clauson, Wyatt, Morrison, Geiger, Van Zee and Grable. Staff present: Deputy Clerk Hager, City Treasurer Tompkins, Police Chief Mathews, City Planner Gross, City Engineer Curles, Fire Chief Snow, City Clerk Parks and City Attorneys Ann Hanson and Jim Ryan. Councilman Van Zee led the audience and Council in the Pledge of Allegiance. Mayor Protem Powers asked for audience comments for items not listed on this agenda. Gene Baker, Harbormaster Port of Bremerton, thanked the City Council and city staff for their dedication and cooperation during the 1996-1997 winter storm. Mr. Baker also briefed Council on the Port of Bremerton's plans to rebuild the Port Orchard Marina. Mayor Protem Powers presented the 1996 Holiday Good Neighbor Awards for outstanding holiday decorations. The recipients were Ralph and Karen Whitney, 2082 Sidney Avenue for the residential category and Sara Lambert, Harbor Antique Mall, 802 Bay Street for the commercial category. Mayor Protem Powers also presented Norm Olson with a plaque in recognition of volunteering his time and expertise during the 1996-1997 winter storm. Phyllis Mann, Director, Department of Emergency Management, introduced her Administrative Assistant Sharon Aker and informed city officials that FEMA personnel will be in Kitsap County to meet with local jurisdictions on February 10, 1997. Ms. Mann also discussed some of the preliminary financial loss statistics which are the result of the 1996-1997 winter storm. On motion by Councilman Grable, seconded by Councilman Clauson, Council approved the Consent Agenda with the noted correction as follows: a. Minutes of the January 13, 1997 as distributed and corrected. b. Claim Warrants No. 26057-26147 in the amount of $168,294.89. C. Addendum to contract for Incarceration of City Prisoners between the City and Kitsap County setting term of contract for one year from January 1, 1997 to December 31, 1997 also reflecting an increase in the daily housing rate from $50.00 to $57.00 per day. d. Ordinance No. 1674 approving the Preliminary Plat of Port Orchard Industrial Park, as submitted by R.V. Sand and Gravel and their representative, N.L. Olson. Property located on the north side of block 3300 of Lloyd Parkway. e. Resolution No. 1760 authorizing an interfund loan for the Street Fund. On motion by Councilman Morrison, seconded by Councilman Clauson and Grable, Council excused Councilman Van Zee from the February 24, 1997 City Council meeting. On motion by Councilman Morrison, seconded by Councilman Clauson, Council concurred with Mayor Weatherill expanding the duties of the City Engineer by designating him the Special Assistant to the Mayor. The Special Assistant to the Mayor will be responsible for the communication and coordination between the different city departments and to complete special projects as the Mayor assigns, however this expansion of duties does not require or include any budget modifications. January 27, 1997 Page 2 of 3 Council scheduled March 3, 1997 at 7:30 PM as a special Study Session to discuss the Bethel Wye design concept. On motion by Councilman Clauson, seconded by Councilman Wyatt, Council excused Councilman Morrison from the following study session and city council meetings, February 3, 10 and 24, 1997. City Engineer reported on the emergency call for bids for the repairs to the Maple Street Watermain. The following bids were received: R.V and Associate Sound Excavation Olsen Land Development ENGINEER'S ESTIMATE $40,141. 46,860. 51,588. 50,000. On motion by Councilman Van Zee, seconded by Councilman Clauson, Council accepted the bidding and awarded the Maple Street Watermain Repair Project to R.V. and Associates in the amount of $40,141. City Engineer Curles reported on the settlement agreement for the Narry/Scott/City of Port Orchard law suit. City Engineer requested the Council accept the settlement agreement as presented. On motion by Councilman Morrison, seconded by Councilman Wyatt, Council authorized the City Engineer to proceed with requirements of the settlement agreement as follows: 1) The city have the right of way at 1805 Lawrence Street surveyed. 2) A guardrail be constructed at the corner of Perry and Lawrence Street. 3) The appropriate documents be prepared to quit claim any interest in the disputed property. City Engineer Curles discussed a potential grant application in conjunction with Kitsap Transit to develop a Park and Ride at the former Old Clifton Road landfill. On motion by Councilman Morrison, seconded by Councilman Grable, Council authorized the City Engineer to proceed with the grant application in conjunction with Kitsap Transit to develop a Park and Ride at the former land fill on Old Clifton Road. City Engineer Curles reviewed Phase I of the Sedgwick watermain project and recommended clearing brush to provide an access for project bidders and to prepare for the pipe route. On motion by Councilman Geiger, seconded by Councilmen Morrison and Grable, Council authorized the City Engineer to proceed with the clearing of brush to provide access to the Sedgwick Watermain Project pipe route (Phase I). City Engineer updated Council on the Prospect Alley Repair Project and discussed the three proposed retaining wall designs and potential coordination with adjacent property owner. On motion by Councilman Morrison, seconded by Councilman Van Zee, Council authorized the City Engineer to proceed with the Spaced Pile Wall design to repair Prospect Alley. The design will be delayed two weeks to determine if Mr. Hooser will participate in the project. January 27, 1997 Page 3 of 3 On motion by Councilman Clauson, seconded by Councilman Morrison, Council formally accepted the completion of the Port Orchard Boulevard paving project. On motion by Councilman Morrison, seconded by Councilman Wyatt, Council approved application for Public Event as submitted by Kitsap Mustang Club for their "Mustangs on the Waterfront" event July 27, 1997. Councilman Geiger moved to designated, effective in 1998, an additional holiday for the city employees in honor of Martin Luther King by designating the third Monday in January, seconded by Councilman Wyatt. Councilman Clauson moved to table motion designating the third Monday in January, effective 1998, as an additional holiday for city employees, to honor Martin Luther King, seconded by Councilman Grable.
