03/12/1997 - Special - MinutesPort Orchard, Washington March 12, 1997 Council of the City of Port Orchard, Washington, was called to order in Special Session at 7:35 P.M. by Acting Mayor Pro-tem Robert Geiger. Meeting location - City Hall, 216 Prospect Street. Council members present: Clauson, Wyatt, Morrison, Geiger, Powers, Van Zee and Grable Staff present: City Engineer Curles, City Planner Gross and City Clerk Parks. Acting Mayor Pro-tem Geiger reopened the Public Hearing explaining that this meeting is a continuation of the Public Hearing from February 19, 1997. The purpose of holding a series of Public Hearing meetings is to review and discuss the draft Zoning Ordinance. Public input is invited and encouraged. He then requested City Planner Gross facilitate this session. City Planner Gross reviewed status of the Draft Zoning Ordinance review. Noting the next planned date for continuation of this Public Hearing is March 26, 1997. Council agreed that review of the proposed ordinance will not be completed by the projected March 26 date. They designated April 9, April 16, and April 30 as additional dates for continuation of the Public Hearing. Each Public Hearing meeting will start at 7:30 P.M. City Planner Gross addressed "Marina" uses as reflected in the "Recreational/cultural land uses" table (page 146-B), which had been delayed until Councilman Morrison's return. Councilman Morrison stated the City currently has two boat repair enterprises with three more potential boat repair businesses in the proposed Ross Point Annexation area. The draft zoning ordinance does not reflect current uses. If the ordinance is adopted as written, existing marina -boat repair businesses would become non -conforming uses. The new code should reflect existing uses. Discussion on "Marina" use designation resulted in the following revisions to the draft Zoning Ordinance: Part Cl: Zones, maps, and designations 1. Section 9: Aircraft, ship, and boat building (Page 123) is revised to read: Section 9: Aircraft, ship, and boat building'{epT: The fabrication and/or assembling of aircra ft ships or boats and including uses located in SIC industry group numbers: 1) 372-Aircraft and parts, and 2) 373-Ship and boat building and repair. This includes av^ hauls, engine pulling, and bettelff painting. 2. Section 72: Marina (Page 133) is revised to read: March 12, 1997 Page 2 of 3 a''t±:.:::........................................: 3. Recreational/cultural land uses table (Page 146-B) a. Marina Use permitted in Commercial (retail and office), Employment (industrial/office), and Public facilities zones. b. * delete condition/limitation Number 5: Only in an enclosed building. Note: This condition was related to Shooting range and archery range uses. 5. General Services land uses table (Page 146-D) Add: Marina -Boat repair use Marina -Boat repair Permitted use in Commercial (retail and office), Employment (industrial/office), and public facility zones. Upon consensus that the review of the "Recreational/cultural land uses" table with applicable definitions, conditions and uses was complete, those present focused attention on the "Residential land uses" table on page 146-C. "Single family detached" and "Single family attached" uses were examined with no changes. It was clarified that single family attached structures cannot be stacked (e.g., a two-story duplex structure, with one unit above the other unit). After considerable discussion and debate on zones where a "Multifamily" use could be an appropriate conditional or permitted use, Council members agreed to add it as a permitted use in a Residential-12 zone. Discussion relating to "Mobile home park" use resulted in many questions being raised on where mobile home park uses would be allowed, how many mobile homes in a single location constituted a mobile home park, where would individual mobile homes be permitted, and would the City limit location of single wide mobile homes. Council members expressed need to provide for mobile homes within the new zoning ordinance. The City Planner will check with Kitsap County to review their mobile home regulations and restrictions on single or double wide units. She will also review definition of single family dwelling relating to mobile homes as written in the City's draft zoning ordinance.. March 12, 1997 Page 3 of 3 Review of "Houseboat" use resulted in the following changes: 1) A3: Definitions -technical terms, Section 122: Houseboat (Page 42) Revise definition to read as follows: A watercraft structure designed primarily to be occupied as a dwelling unit that does not have a motor but is provided with sewer and water hookups. 2) Residential land uses table (Page 146-C) be revised to include "Houseboat" use be allowed as a conditional use in a Public facility zone. Doug Eide requested Council delay evaluation of Sections C4 and D1 until the April 9, 1997 session of this Public Hearing. At 9:32 P.M.
