Council of the City of Port Orchard, Washington, called to regular session by Mayor
Leslie J. Weatherill at 7:30 P.M. at City Hall, 216 Prospect Street. Councilmembers
present: Clauson, Wyatt, Morrison, Geiger, Powers, Van Zee and Grable. Staff present:
Police Chief Mathews, City Planner Gross, City Engineer Curles, Fire Chief Snow, City
Clerk Parks and City Attorneys Hanson and Ryan.
Councilman Van Zee led the audience and Council in the Pledge of Allegiance.
Mayor Weatherill asked for audience comments for items not listed on this agenda.
Todd Cramer, 409 Givens, complimented the Mayor, City Council and Public Works crew on
the development of the waterfront park.
City Engineer Curles gave staff report on March 22, 1997 meeting with Department of
Transportation (DOT) representatives, elected officials and himself. Purpose of the
meeting was to inspect the Ross Point slide area. Mr. Curles summarized the situation
as a community problem which needs a community effort, working together to find a
solution and funding source. The slide area is on State right of way, which is situated
within unincorporated Kitsap County on a road which serves as major access to Port
Orchard. The multi -jurisdictional impact highlights the necessity to put jurisdictional
concerns aside and work together to find a solution and help the state find money to
fund cleanup and fix the hillside and road.
Frank Treese (DOT Maintenance & Operations) and Jeff Carpenter (Project Manager)
outlined DOT's efforts to contend with the continued sloughing of the hillside and plan
for restoration. Mr. Treese noted that the problem extends beyond the State highway
right of way, thus clean up and mitigation of the situation will require the State to
acquire additional right of way property. It is estimated that the cost to fix some
of the current problems will be approximately $1,000,000. A long range solution to
prevent landslides in the future is estimated to be in the $8,000,000 range.
County Commissioners Charlotte Garrido, Chris Endressen and Phil Best were present to
listen to Dept of Transportation reports and participate in discussions. The
Commissioners assured the community that they will cooperate and give what ever support
they can.
Amy Morrison, Deputy District Director from Congressman Dicks' office addressed
potential federal funds for short term, long term solutions and emergency impact relief
funds.
Ron McAffee, Director of Cen-Com, spoke regarding how closure of this roadway effects
emergency routes and responses.
Councilmembers discussed the devastating impact the closure of this road has on local
businesses and requested Department of Transportation provide signs and advertising to
identify that local businesses are open and accessible. DOT officials agreed to install
"local businesses open" signs within the next week. Advertising will depend on
available funding.
City Engineer Curles stated that the State through Congressman Dicks' office has applied
for Congressional Demonstration Project funds. Congressional Demonstration Project
funding is highly competitive and there is no assurance that this project will be
funded.

Mayor Weatherill closed discussions on the Ross Point landslide and thanked Department
of Transportation officials, County Commissioners, and Congressman Dicks' representative
for meeting with the Council.
Councilwoman Powers moved to remove from the table, the motion [presented by Councilman
Geiger and seconded by Councilman Wyatt at the January 27, 1997 meeting] to designate
the third Monday in January, effective in 1998, as an additional holiday for city
employees, to honor Martin Luther King. Motion to remove this motion from the table
was seconded by Councilman Wyatt and carried.
Discussion on motion included, but was not limited to, all Councilmembers voicing strong
support for recognizing Dr. King and what he stood for. Several Councilmembers
reiterated their position is that the City historically has established recognized
holidays through labor negotiations and while the intent is to designate this date as
a holiday, it should be through the bargaining process.
Councilman Morrison moved to table the motion to designate the third Monday in January
as an additional holiday for city employees to honor Martin Luther King, motion to table
seconded by Councilman Clauson and carried with four ayes and three nos. Councilmembers
Wyatt, Powers and Geiger voting no. Council further instructed Clerk to place this
motion on the September agenda for consideration with the 1998 budget process.
Gary Chrey, attorney representing Tom and Pat Myers owners of the Hi -Joy Bowling Alley,
presented a letter and site map proposing a revision to the Bethel "Y" round -a -bout
design. Mr. Chrey stated the revised plan complies with Washington State Department
of Transportation standards. The revision would delete the bypass lane from Bethel to
east bound SR166 allowing a right in, right out ingress/egress from the east end of the
bowling alley parking lot and an ingress/egress at the west end of the bowling alley
parking lot. The revision also reconfigured the divider island to the north permitting
a left hand turn out of Sunset Lane Cemetery which was a concern of Bill and MAvis Rill,
owners of the cemetery.
Mayor Weatherill called for recess at 8:45 P.M. and subsequently reconvened meeting at
8:55 P.M.
On motion by Councilman Grable, seconded by Councilman Van Zee, Council approved the
consent Agenda items as follows:
Minutes of the following Council meeting:
(1) March 10, 1997 regular meeting
(2) March 12, 1997 Study Session re: Zoning Code Ordinance
b. Approval of Claim Warrant Nos. 26395-26475 in the amount of $69,073.70 and
March 1997 Payroll Warrant Nos. 126669-126860 in the amount of
$216,825.38.

c. Proposed Resolution No. 1766 approving the issuance of a Special Use
Permit to Real People Beauty Salon for property located at 2143 Bethel
Avenue.
d. Authorization for Chief Mathews to sign Adult Protective Services/Law
Enforcement Agreement between Port Orchard Police Department and
Department of Social and Health Services Home and Community Service.
On motion by Councilman Morrison, seconded by Councilman Wyatt, Council authorized the
City Engineer to remove trees from the right of way on the south side of Mile Hill Drive
east of Jackson Avenue, subject to review of rezone which allowed development of the
adjacent parcel of property to assure it did not prohibit removal of the trees. Trees
are directly under power lines and have been repeatedly topped and delimbed.
Councilman Clauson reported on Kitsap Regional Planning Group meeting, encouraging
fellow Councilmembers to familiarize themselves with this group and participate when
appropriate. Mayor Weatherill is chairing the Capital Facilities Committee of this
Planning Group.
Councilman Van Zee moved to authorize Mayor Weatherill to sign grant application for
City involvement in seeking grant funds to construct a Park and Ride Lot on Lloyd
Parkway. Seconded by Councilman Grable and approved with a vote of six ayes.
Councilman Clauson refrained from voting due to appearance of fairness.
After discussion on status of Entrance to City Sign Project, it was determined the
Council Planning Committee will review subject for site selection.
On motion by Councilman Geiger, seconded by Councilman Clauson, Council authorized Mayor
Weatherill to sign contract for Sewer Treatment Plant expansion.
Fire Chief Snow reported Mason County Fire has canceled interlocal agreement for repair
of fire apparatus. The mechanic who provided service expertise has left employment of
Mason County Fire. Chief Snow reviewed availability of other sources for this service.
On motion by Councilman Morrison, seconded by Councilman Wyatt, Council unanimously
authorized Fire Chief Snow to enter into service contract with Michael Williams to
repair fire apparatus.
