ORDINANCE
The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular
Council meeting held September 23, 2002.
ORDINANCE NO. 1870
AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON,
VACATING THE EASTERLY HALF OF FARRAGUT AVENUE RIGHT OF
WAY ADJACENT TO TAX PARCEL NO. 4027-026-007-0009 (PLATTED
AS PROSPECT COURT), PETITIONED BY JOHN AND CLARA
HAUSCHILD.
Copies of Ordinance No. 1870 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 1870 will be
provided at a nominal charge.

AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
VACATING THE EASTERLY HALF OF FARRAGUT AVENUE RIGHT OF
WAY ADJACENT TO TAX PARCEL NO. 4027-026-007-0009 (Platted as
Prospect Court), PETITIONED BY JOHN AND CLARA HAUSCHILD.

WHEREAS, a Petition to Vacate the easterly half of Farragut Avenue right-of-way, adjacent
to tax parcel 4027-026-007-0009 (Prospect Court), legally described below, was received by the City, said
petition being signed by all property owners abutting the portion of the street to be vacated; and
WHEREAS, in accordance with RCW 35.79.030, a Public Hearing was held Monday,
September 9. 2002 at 7:35 PM in the City Council Chambers, City Hall, 216 Prospect Street, Port Orchard,
Washington, and
WHEREAS, the City Council did vote to approve the Petition to Vacate the easterly half of
Farragut Avenue right-of-way, adjacent to tax parcel 4027-026-007-0009 (platted as Prospect Court), as
submitted by John and Clara Hauschild, and
WHEREAS, the petitioners have compensated the City as required by RCW 35.79.030, now
therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES
ORDAIN AS FOLLOWS:
SlXUUiL That the easterly half of Farragut Avenue right-of-way, adjacent to tax
parcel 4027-026-007-0009 (Prospect Court), as described in Exhibit “A attached hereto and by reference
incorporated herein is hereby vacated.
SECTlnN. The Mayor is hereby authorized and directed to execute a quit claim deed to
said property, conveying the City’s interest therein to the abutting property owner(s). subject to such
easements as the City Engineer determines are necessary for City utility purposes.
SECTlON. This ordinance shall be in full force and effect 5 days after publication. A
summary of this ordinance, as authorized by state statute, may be published.
