Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J.
Weatherill at 7:30 P.M. at City Hall, 216 Prospect Street. Councilmembers present: Wyatt,
Clauson, Morrison, Geiger, Powers, Van Zee, and Grable. Staff present: Police Chief Mathews,
Deputy Clerk Merlino, City Planner Gross, City Engineer Curles, Fire Chief Snow, City Clerk
Parks, and City Attorneys Hanson and Ryan.
City Planner Gross and Councilman Morrison led the audience and Council in the Pledge of
Allegiance.
Mayor Weatherill asked for audience comments for items not listed on this agenda. No response
was received.
Charlotte Garrido, Kitsap County Commissioner, addressed Council regarding the status of Kitsap
County's Growth Management Comprehensive Plan. Ms. Garrido requested the City's
partnership and support during the review of the County's Rural and Land Use Elements as these
two areas could impact the City in the future.
Kay Morrison, Port Orchard Library Chair, gave a brief update on the Port Orchard's Library
summer programs and statistics on the daily use of the library. In summary Mrs. Morrison
thanked the Council for their continued support of the Port Orchard Library.
Mayor Weatherill opened the 7:35 PM Public Hearing regarding the renewal of the six month
Residential Subdivision Moratorium.
City Planner Gross gave staff report stating that on March 10, 1997 the City Council extended the
Residential Subdivision Moratorium an additional six months to allow for the continuing
development of the zoning code ordinance. Extensive work has been done by the consultant,
Zoning Code Task Force, Planning Commission, and City Council. City Planner Gross requested
Council extend the moratorium an additional 6 months. It is expected that the new zoning code
review process will be adopted within the next six months.
Mayor Weatherill asked for audience comments concerning the extension of the Residential
Subdivision Moratorium. As no response was received, Mayor Weatherill closed the public input
portion of the Public Hearing and referred this matter to Council for their consideration.
On motion by Councilman Powers, seconded by Councilman Grable, Council adopted Resolution
No. 1789 setting forth facts, findings and conclusions relevant to the renewal of a six month
Residential Subdivision Moratorium. The Moratorium will expire on March 25, 1998.
On motion by Councilman Clauson, seconded by Councilman Grable, Council approved the
Consent Agenda items as follows:
a. Minutes of the following Council meeting:
(1) September 8, 1997 regular meeting
(2) September 17, 1997 Study Session — Zoning Code Ordinance

b. Approval of Claim Warrant Nos. 27460-27522 in the amount of $72,939.79.
C. Ordinance No. 1688 approving a zone reclassification from Residential Low to
Commercial General to allow a development of a foodmart, a six island gas station
and a detached car wash facility, located adjacent to Mile Hill Drive between the
National Guard Armory and the South Kitsap Mall, the owner is Northwest Equity
Investments II.
d. Ordinance No. 1689 approving a zone reclassification from Residential High to
Multiple Family 20 to allow a 60 unit assisted living facility for property located at
1761 Pottery Avenue, the owner is Doug Ostrom and his representative is W.M.
Palmer Consultants.
Mayor Weatherill called for a 5 minute recess with meeting reconvening at 8:00 PM.
On motion by Councilwoman Powers, seconded by Councilman Clauson, Council authorized an
expenditure of up to $8,500.00 to allow Art Anderson and Associates review the proposed City
Hall plans. The purpose of this review is to prepare a menu of cost reduction items for the project.
Council further requested all Councilmembers to prioritize a list of prospective construction cost
reduction items as submitted by the Architects, with the list submitted to the City Engineer by
Wednesday, September 24, 1997.
On motion by Councilman Clauson, seconded by Councilman Morrison, Council declared as
surplus 19 miscellaneous firearms (Attachment "A") as no longer needed by the City and
authorized the Police Chief to enter into an Agreement with ProArms to trade these 19 firearms for
miscellaneous equipment.
City Planner Gross reported on letter submitted by Matthew Randish, M&M Market and Deli, 451
South Kitsap Boulevard, requesting permission to place a "24 Hour' sign on the base of the
existing monument sign on Tremont street.
On motion by Councilwoman Powers, seconded by Councilman Morrison, Council authorized
Matthew Randish, M&M Market and Deli, 451 South Kitsap Boulevard, permission to place a "24
Hour" sign, measuring approximately two feet in diameter at the base of the existing monument
sign on Tremont Street.
On motion by Councilman Clauson, seconded by Councilman Van Zee, Council authorized the
City to provide water service to Mr. and Mrs. John McFadden, 5067 Geiger Road and Mr. and
Mrs. Fred Evans, 4931 Geiger Road, when the Geiger Water Main project is completed.
On motion by Councilman Van Zee, seconded by Councilman Clauson, Council authorized the
City Engineer to accept Technical Systems Incorporated proposal to install an ultrasonic level
sensor system and to repair the two flow meters at the Marina Sewer Pump Station, in the
approximate amount of $20,000.

On motion by Councilman Morrison, seconded by Councilman Wyatt, Council authorized the
Mayor to sign Change Order No. 1 for additional work on the Prospect Alley Repair contract in the
approximate amount of $8,905.00.
At 9:10 PM Mayor Weatherill adjourned Council into Executive Session for 5 minutes and
continued Executive Session for an additional 60 minutes to discuss the proposed Fire Protection
Agreement.
Mayor Weatherill reconvened Council into regular session at 10:15 PM.
Councilman Morrison moved to authorize the City Attorney and the Fire Chief to incorporate
Volunteer Firefighter concerns which were presented at the September 17, 1997 Study Session
into the proposed Fire Protection Agreement and also directed the Mayor to sign the amended
Agreement and forward to Fire District No. 7. Motion seconded by Councilman Wyatt.
Councilman Clauson moved to table the motion to amend, sign and submit the Fire Protection
Agreement to Fire District 7 until the Ross Point Annexation is resolved by the Kitsap County
Boundary Review Board, seconded by Councilman Grable and carried with a vote of four ayes
and three nos. Councilmembers Clauson, Powers, Gei er and Grable voting in the affirmative.
