Council of the City of Port Orchard, Washington, called to regular session by Protem Mayor Carolyn
Powers at 7:30 P.M. at City Hall, 216 Prospect Street. Councilmembers present: Clauson, Morrison,
Wyatt, Geiger, Powers, Van Zee, and Grable. Staff present: Deputy Clerk Merlino, Police Chief
Mathews, City Treasurer Tompkins, City Engineer Curles, Fire Chief Snow, City Clerk Parks, and City
Attorney's Hanson and Ryan.
Kay Morrison led the audience and Council in the Pledge of Allegiance.
Protem Mayor Powers asked for audience comments for items not listed on this agenda. No
response was received.
Kay Morrison, representing the Soroptimist International of Port Orchard, spoke to Council
concerning the Domestic Violence Summit scheduled for Saturday, October 18, 1997. Mrs. Morrison
also requested the Mayor's signature on a Proclamation recognizing the Month of October as
Domestic Violence Awareness Month.
Mayor Protem Powers opened Public Hearing scheduled for 7:35 PM regarding anticipated 1998 City
budget revenue sources, as required by Chapter 251, Laws of State of Washington, 1995.
Treasurer Tompkins presented Staff Report on anticipated 1998 City budget revenue sources. The
presentation highlighted Current Expense and Street Funds which are tax supported. The 1998
Property Taxes are projected in the amount of $1,086,292 for the Current Expense and Street Funds.
Mayor Protem Powers called for public input from the audience regarding the anticipated 1998 City
budget revenue sources. As no comments were received, Mayor Protem Powers closed the Public
Hearing. (Ordinance setting the 1998 Property Taxes will be presented for Council consideration at
the October 27, 1997 Council meeting.)
Mayor Protem Powers introduced a letter from Councilman Geiger requesting permission of the
Council to change his vote on the September 22, 1997 motion to table the motion concerning the
Agreement with Fire District No. 7 to provide fire protection. (See Sept. 22,1997 minutes, Page 3, paragraph 5).
Mayor Powers stated if there is no objection to Councilman Geiger changing his vote on the motion
to table the motion approving the Agreement To Provide Fire Protection with Fire District No. 7, the
record will be changed by General Consent. No objection was heard. The record will be changed
to reflect the following: (9122197 minutes - Page 3, paragraph 5 - Councilman Clauson moved to table the motion to
amend, sign, and submit the Agreement To Provide Fire Protection with Fire District No. 7 until the Ross Point
Annexation is resolved by the Kitsap County Boundary Review Board, seconded by Councilman Grable. And GaIrrie—du,ah

Motion failed with three ayes and four nos. Councilmen Morrison, Van Zee, Wyatt, and Geiger voting no.
Discussion on the original motion, as presented at the September 22,1997 City Council meeting,
resulted in the motion being withdrawn by its maker, Councilman Morrison, with the consent of the
second, Councilman Wyatt. Withdrawn Motion: Motion authorizing the City Attorney and Fire Chief to incorporate
Volunteer Firefighter concerns which were presented at the September 17, 1997 Study Session into the proposed Agreement To
Provide Fire Protection with Fire District No. 7 and also direct the Mayor to sign the amended Agreement and forward to Fire District
7.

Councilman Morrison moved to authorize the Mayor to sign the Agreement To Provide Fire
Protection with Fire District No. 7 and forward the contract to District No. 7 for their signatures,
seconded by Councilman Wyatt.
Councilman Geiger moved to amend motion to include the "Clarification of the Contract" dated
October 13, 1997 as part of the Agreement To Provide Fire Protection with Fire District No. 7,
seconded by Councilman Clauson and carried with 6 ayes and 1 nay. Councilman Grable voting
nay.
Councilman Clauson moved to further amend the motion to hold the Agreement To Provide Fire
Protection with Fire District No. 7 until the International Association of Firefighters, Local #2819,
which represented the City of Port Orchard firefighters has presented a letter supporting the
Agreement To Provide Fire Protection with Fire District No. 7. Upon receipt of this letter the
contract will be sent to Fire District No. 7, seconded by Van Zee. Motion passed with 6 ayes and 1
nay. Councilman Grable voting nay.
Original motion as twice amended authorizing the Mayor to sign the Agreement To Provide Fire
Protection with Fire District No. 7, including "Clarification of the Contract" dated October 13, 1997.
Upon receipt of letter of support from the International Association of Firefighters, Local #2819,
representing_ the City of Port Orchard the Fire Protection Agreement will be forwarded to Fire
District No. 7 for their consideration. Motion as twice amended passed with 6 ayes and 1 nay.
Councilman Grable voting nay. MEMO FOR THE RECORD: Agreement To Provide Fire
Protection will reflect commencement date of January 3, 1998.
By general consent, consideration of the September 22, 1997 City Council meeting minutes was
moved from the new business portion of the agenda to the Consent Agenda.
On motion by Councilman Clauson, seconded by Councilman Geiger, Council approved the following
consent agenda items:
a. Minutes of the following Council meeting:
(1) September 17, 1997 Special Meeting regarding proposed Fire Contract
(2) September 22, 1997 City Council meeting
(3) September 24, 1997 Special Meeting — Zoning Code Ordinance
b. Approval of Claim Warrants Number 27523-27635 in the amount of $124,769.61
and September 1997 Payroll Warrants.127953-128151 in the amount of
$223,419.82.
Councilman Wyatt, Chairman of Port Orchard Lodging Tax Advisory Board, reported on meeting
held September 24, 1997. At this meeting the Advisory Board (1) established their 1998
Preferred Allocation List which will be included in the 1998 Preliminary Budget; and (2) reviewed
request received from the Fathoms O' Fun Festival for an additional allocation of $1,700 from the
Community Events Fund Reserve Account.
On motion by Councilman Morrison, seconded by Councilman Van Zee, Council allocated an
additional $1,700 from the Community Events Fund Reserve to the Fathoms O' Fun Festival for
their Fireworks Fund, with disbursal of funds to Fathoms O' Fun prior to December 31, 1997.

On motion by Councilman Van Zee, seconded by Councilman Grable, Council authorized the Mayor
to sign a contract modification with Art Anderson and Associates providing for a new cost estimator to
review the new city hall re -design at a cost of $23,545.
On motion by Councilman Morrison, seconded by Councilman Geiger, Council approved the 1998
Animal Control Contract with Kitsap Humane Society at an annual cost of $19,822.00.
On motion by Councilman Clauson, seconded by Councilman Morrison, Council authorized the Mayor
to sign Change Order No. 1 for the Culverts and Main Project in the increased amount of $6,332.23.
On motion by Councilman Morrison, seconded by Councilmen Wyatt and Clauson, Council authorized
the City Engineer to proceed with sidewalk repairs at 904 Sidney Avenue.
On motion by Councilman Morrison, seconded by Councilman Grable, Council authorized the City
Engineer to purchase a traffic counter which records the speed of vehicles, in the approximate
amount of $900.00, contingent upon availability of funds after completion of the 904 Sidney Avenue
Sidewalk Repair Project.
On motion_ by Councilman Geiger, seconded by Councilman Clauson, Council excused
Councilwoman Powers from the November 24, 1997 City Council meeting.
Protem Mayor Powers adjourned meeting at 9:20 PM.
