12/08/1997 - Regular - MinutesPort Orchard, Washington December 8, 1997 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at 7:30 P.M. at City Hall, 216 Prospect Street. Councilmembers present: Clauson, Morrison, Wyatt, Geiger, Powers, Van Zee, and Grable. Staff present: Deputy Clerk Merlino, Police Sargent Loflin, City Engineer Curies, Fire Chief Snow, City Clerk Parks, and City Attorney's Hanson and Ryan. Councilman Grable led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this agenda. No response was received. Bob Ferguson, Kitsap Transit, spoke to Council requesting permission for Mayor Weatherill to sign the revised Administering Commute Trip Reduction Plans/Ordinances Agreement. Revisions to this agreement include a reduction to the goal requirements for coming years and an extension on the life of the contract period to the year 2005. On motion by Councilwoman Powers, seconded by Councilman Morrison, Council authorized the Mayor to sign the Interlocal Agreement Administering Commute Trip Reduction Plans/Ordinances Agreement between Kitsap County, City of Bainbridge Island, City of Bremerton, City of Port Orchard, City of Poulsbo and Kitsap Transit. Art Griffith, consultant for Grey and Osborne, discussed the water system disinfection process. Mr. Griffith presented 4 options for the three city wells. The consultants concluded that after a thorough study, it was determined the pellet system would be the most cost effective process for the City Hall Well and Well 6 and the on -site generation system for Well 8. Denise Lahmann from the State Health Department advised the. City does not have a choice on whether to chlorinate or not, the city is currently working under a waiver from the Department of Health to allow for implementation of the chlorinating process. Councilwoman Powers moved to authorize the City Engineer to proceed with the implementation of the pellet system for the City Hall Well and Well 6 and the on -site generation system for Well 8, seconded by Councilman Geiger. Councilman Clauson moved to amend motion to proceed with the process of chlorinating the water system, however, also review the possibility of using Bromide or an alternative chemical as a disinfectant instead of Chlorine, seconded by Councilman Wyatt. Motion passed with 6 ayes and 1 nay. Councilman Van Zee voting nay. Council unanimously approved the original motion as amended authorizing the City Engineer to proceed with the implementation of the pellet system for the City Hall Well and Well 6 and the on - site generation system for Well 8, also to review the possibility of using Bromide or an alternative chemical as a disinfectant instead of Chlorine. December 8, 1997 Page 2of4 Mayor Weatherill opened the 7:35 PM Public Hearing regarding a modified site plan (additional building square footage) for a previously approved Zone Reclassification for the project known as Stafford Suites, located at 1761 Pottery Avenue, Doug Ostrom, applicant. LEGAL DESCRIPTION: Attachment "A" City Engineer briefed Council on the technical error computing the square footage of the Stafford Suite Project. City Engineer Curies stated on September 8, 1997, the City Council approved the rezone application materials and site plan describing the structure as being 31,200 square feet when in fact the site plan reflected the project as 56,000 square feet. Because the square footage is listed in the approving ordinance and because an increase in building size is considered a major modification to an approved reclassification site plan, the public hearing was necessary. William Palmer, representing the applicant, advised Council there is a discrepancy in the square footage of the project, however, there is no change to the number of units, footprint of the site plan, storm drainage or landscaping plans. Tom Stansbery, 720 Smith Street, member of the Planning Commission, advised Council he had made the motion to approve the Stafford Suite project with the perception the square footage of the project had been reduced from the original 56,000 to 31,200. Mayor Weatherill called for additional audience comments regarding the modified site plan for the project known as Stafford Suites. As no further comments were received, Mayor Weatherill closed the public input portion of the Public Hearing and referred this matter to Council for their consideration. On motion by Councilman Clauson, seconded by Councilman Van Zee, Council moved to amend Ordinance No. 1689 modifying the square footage allowance for the facility known as Stafford Suites located at 1761 Pottery Avenue from 31,200 square feet to 56,000 square feet, to correct a technical error. On motion by Councilman Geiger, seconded by Councilman Clauson, Council removed Item 5(f) from the Consent Agenda for further review, (Item 5(f). "Proposed Resolution No. 1791 authorizing the obligation of funding for the traffic signal at Tremont Street and the Port Orchard Boulevard") and approved the following consent agenda items: a. Minutes of the following Council meeting: (1) November 24, 1997 regular meeting (2) November 19, 1997 Zone code Meeting (3) December 1, 1997 —1998 Budget Public Hearing b. Approval of Claim Warrants Number 27869 - 27946 in the amount of $332,145.73 and November 1997 Payroll Warrants 128418-128610 in the amount of $221,712.76. C. Surplus of miscellaneous computer equipment d. Ordinance No. 1691 relating to and providing for the annexation of territory to the City of Port Orchard, commonly known as Ross Point Annexation. December 8, 1997 Page 3 of 4 e. Ordinance No. 1692 adopting the budget for the year 1998. g. Resolution No. 1792 approving the issuance of a Special Use Permit to Ken's Auto Body to allow a 15-space employee only parking lot and garage with a lunchroom located one lot east of Sidney Avenue on the south side of Granat Street, Ken and Audrey Davis, applicants. Councilman Van Zee questioned Consent Agenda Item 5(f) proposed Resolution No. 1791 authorizing the obligation of funding for the traffic signal at Tremont Street and the Port Orchard Boulevard. Councilman Van Zee expressed a concern with installing an additional traffic light in the Tremont Street corridor. City Engineer Curles advised Councilman Van Zee the traffic light proposed at Tremont Street and the Port Orchard Boulevard will be a traffic activated light. On motion by Councilman Van Zee, seconded by Councilman Geiger, Council adopted Resolution No. 1791 authorizing the obligation of funding for the traffic signal at Tremont Street and the Port Orchard Boulevard. Mayor Weatherill referred to RCW 46.61.440 "Maximum speed limit when passing school or playground crosswalks — penalty, disposition of proceeds". After much discussion, Mayor Weatherill requested the City Attorney to review and clarify for Council what constitutes a school zone and report back at the next council meeting. On motion by Councilman Clauson, seconded by Councilman Van Zee, Council approved a fireworks stand located at the South Kitsap Mall Parking lot, as submitted by Rochelle's Fine Fabrics from 6 PM to midnight on December 31, 1997. On motion by Councilman Clauson, seconded by Councilman Van Zee, Council excused Councilman Wyatt from the December 22, 1997 council meeting. On motion by Councilman Morrison, seconded by Councilwoman Powers, Council declared as surplus miscellaneous items from the Police evidence room (Attachment "B"), and authorized the Police Department to dispose of these items in the best interest of the City. On motion by Councilman Van Zee, seconded by Councilman Geiger, Council authorized the City Engineer to hire three college students to clean out the debris from the house located at 2528 Mitchell Avenue and bill the property owners for the expenses incurred. On motion by Councilman Geiger, seconded by Councilman Clauson, Council authorized the Mayor to sign an Interlocal Agreement to hire Mary McClure to facilitate the transportation issues as part of the Transportation Advisory Committee with the city to pay an equal share not to exceed $1,000. On motion by Councilman Geiger, seconded by Councilman Morrison, Council authorized the City Engineer to hire a surveyor to prepare a topography map of the Sedgwick Reservoir site. December 8, 1997 Page 4 of 4 On motion by Councilman Morrison, seconded by Councilman Van Zee, Council authorized the City Engineer to send a letter to Kitsap County Board of County Commissioners regarding the City's desire to extend the western boundary of the city and annex the McCormick Woods area, subject to concurrence of the Growth Management Committee.
